最(zui)近公司讓我們加了三天(tian)班,想咨(zi)詢一下(xia)大家,加班費算(suan)在最(zui)低工資標準里么?

勞(lao)動(dong)(dong)和社會保障部頒布的(de)《最低工(gong)(gong)資(zi)(zi)規定》規定:在勞(lao)動(dong)(dong)者(zhe)提供正常勞(lao)動(dong)(dong)的(de)情況下,用人(ren)單(dan)位(wei)應支(zhi)付(fu)給勞(lao)動(dong)(dong)者(zhe)的(de)工(gong)(gong)資(zi)(zi)在剔(ti)除下列各項以后,不(bu)得低于(yu)當(dang)地最低工(gong)(gong)資(zi)(zi)標準:(一)延(yan)長工(gong)(gong)作時間(jian)(jian)工(gong)(gong)資(zi)(zi);(二(er))中班(ban)、夜班(ban)、高溫、低溫、井下、有(you)毒有(you)害等(deng)特殊(shu)工(gong)(gong)作環境、條件下的(de)津貼;(三(san))法律、法規和國家規定的(de)勞(lao)動(dong)(dong)者(zhe)福利待遇等(deng)。實行計(ji)件工(gong)(gong)資(zi)(zi)或(huo)提成工(gong)(gong)資(zi)(zi)等(deng)工(gong)(gong)資(zi)(zi)形(xing)式的(de)用人(ren)單(dan)位(wei),在科(ke)學(xue)合理的(de)勞(lao)動(dong)(dong)定額基礎上,其支(zhi)付(fu)勞(lao)動(dong)(dong)者(zhe)的(de)工(gong)(gong)資(zi)(zi)不(bu)得低于(yu)相應的(de)最低工(gong)(gong)資(zi)(zi)標準。據此,延(yan)長工(gong)(gong)作時間(jian)(jian)工(gong)(gong)資(zi)(zi)(即(ji)加(jia)班(ban)費)不(bu)能作為(wei)最低工(gong)(gong)資(zi)(zi)的(de)組成部分(fen)。
