不能補休的該怎么辦啊?

答(da) 《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)法》第44條、勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)部(bu)《工(gong)資(zi)(zi)支付(fu)暫(zan)行規定(ding)(ding)(ding)(ding)》第十三條,用人單(dan)位在勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者完成(cheng)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)定(ding)(ding)(ding)(ding)額或(huo)規定(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)工(gong)作(zuo)(zuo)任務后(hou),根據實際需要安(an)(an)(an)排(pai)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在法定(ding)(ding)(ding)(ding)標準(zhun)工(gong)作(zuo)(zuo)時(shi)間(jian)以外(wai)加(jia)(jia)班(ban)加(jia)(jia)點的(de)(de)(de)(de)(de)(de),事后(hou)應盡量給(gei)予同(tong)等(deng)時(shi)間(jian)的(de)(de)(de)(de)(de)(de)補休(xiu)。確實不能補休(xiu)的(de)(de)(de)(de)(de)(de),應按以下標準(zhun)支付(fu)加(jia)(jia)班(ban)加(jia)(jia)點工(gong)資(zi)(zi): (1)依法安(an)(an)(an)排(pai)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在日法定(ding)(ding)(ding)(ding)標準(zhun)工(gong)作(zuo)(zuo)時(shi)間(jian)以外(wai)延長工(gong)作(zuo)(zuo)時(shi)間(jian)(加(jia)(jia)點)的(de)(de)(de)(de)(de)(de),按照勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)規定(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者本人小時(shi)工(gong)資(zi)(zi)標準(zhun)的(de)(de)(de)(de)(de)(de)150%支付(fu)工(gong)資(zi)(zi)。 (2)依法安(an)(an)(an)排(pai)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在休(xiu)息日工(gong)作(zuo)(zuo)的(de)(de)(de)(de)(de)(de),按照勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)規定(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者本人日或(huo)小時(shi)工(gong)資(zi)(zi)標準(zhun)的(de)(de)(de)(de)(de)(de)200%支付(fu)工(gong)資(zi)(zi)。 (3)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在法定(ding)(ding)(ding)(ding)休(xiu)假(jia)節日工(gong)作(zuo)(zuo)的(de)(de)(de)(de)(de)(de),按照勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)規定(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者本人日或(huo)小時(shi)工(gong)資(zi)(zi)標準(zhun)的(de)(de)(de)(de)(de)(de)300%支付(fu)工(gong)資(zi)(zi)。
