試用期中也能獲得補償金么?

答 在試(shi)用(yong)(yong)(yong)(yong)期(qi)中(zhong),除(chu)(chu)有證據證明勞(lao)(lao)(lao)動(dong)(dong)者(zhe)不(bu)符合(he)錄用(yong)(yong)(yong)(yong)條件外,用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)不(bu)得(de)解(jie)除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)合(he)同,用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)在試(shi)用(yong)(yong)(yong)(yong)期(qi)解(jie)除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)合(he)同的,應(ying)當向(xiang)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)說明理(li)由。”在這種情況下,用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)解(jie)除(chu)(chu)勞(lao)(lao)(lao)動(dong)(dong)合(he)同無須支(zhi)付經(jing)濟補償金(jin)。用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)位(wei)若單(dan)方提出解(jie)除(chu)(chu)合(he)同,或者(zhe)企(qi)業本身經(jing)濟性裁(cai)員等重大變動(dong)(dong)而辭退試(shi)用(yong)(yong)(yong)(yong)期(qi)員工的話,是需要提前三十日(ri)通知(zhi)并給(gei)相應(ying)補償金(jin)。
