答 當(dang)事人(ren)在勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)或者保密協(xie)議中(zhong)約定了(le)(le)競業限制,但未約定解除或者終止勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)后給予(yu)勞(lao)(lao)(lao)動(dong)者經(jing)(jing)濟(ji)補(bu)償(chang),勞(lao)(lao)(lao)動(dong)者履行(xing)了(le)(le)競業限制義(yi)務,要(yao)求用人(ren)單位按(an)照勞(lao)(lao)(lao)動(dong)者在勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)解除或者終止前十二個月(yue)平均(jun)工(gong)(gong)資(zi)的(de)30%按(an)月(yue)支(zhi)(zhi)付經(jing)(jing)濟(ji)補(bu)償(chang)的(de),人(ren)民法(fa)院應予(yu)支(zhi)(zhi)持(chi)。前款規定的(de)月(yue)平均(jun)工(gong)(gong)資(zi)的(de)30%低(di)于勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)履行(xing)地最低(di)工(gong)(gong)資(zi)標準(zhun)的(de),按(an)照勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(tong)(tong)履行(xing)地最低(di)工(gong)(gong)資(zi)標準(zhun)支(zhi)(zhi)付。
