我(wo)跟公司(si)簽訂(ding)過競(jing)業(ye)協議,想咨詢一下,競(jing)業(ye)協議的(de)補償(chang),一般是怎么計算的(de)?

當事人(ren)(ren)在勞動(dong)(dong)合(he)同(tong)(tong)或者(zhe)保密協議中約(yue)定(ding)了(le)競業限(xian)制,但未約(yue)定(ding)解除或者(zhe)終止(zhi)勞動(dong)(dong)合(he)同(tong)(tong)后給予(yu)勞動(dong)(dong)者(zhe)經濟補償,勞動(dong)(dong)者(zhe)履(lv)行(xing)了(le)競業限(xian)制義務,要求用人(ren)(ren)單位按照(zhao)勞動(dong)(dong)者(zhe)在勞動(dong)(dong)合(he)同(tong)(tong)解除或者(zhe)終止(zhi)前十二個(ge)月(yue)平均工資的(de)30%按月(yue)支(zhi)付(fu)經濟補償的(de),人(ren)(ren)民法(fa)院應予(yu)支(zhi)持。前款規定(ding)的(de)月(yue)平均工資的(de)30%低(di)于(yu)勞動(dong)(dong)合(he)同(tong)(tong)履(lv)行(xing)地最低(di)工資標(biao)準的(de),按照(zhao)勞動(dong)(dong)合(he)同(tong)(tong)履(lv)行(xing)地最低(di)工資標(biao)準支(zhi)付(fu)。
