答(da) 《職(zhi)(zhi)(zhi)工(gong)帶薪年(nian)休假(jia)條例》第五條:“單(dan)位確(que)因工(gong)作(zuo)需要(yao)不(bu)能(neng)安(an)排職(zhi)(zhi)(zhi)工(gong)休年(nian)休假(jia)的(de),經職(zhi)(zhi)(zhi)工(gong)本(ben)人同(tong)意,可以不(bu)安(an)排職(zhi)(zhi)(zhi)工(gong)休年(nian)休假(jia)。對職(zhi)(zhi)(zhi)工(gong)應休未休的(de)年(nian)休假(jia)天數,單(dan)位應當按照該職(zhi)(zhi)(zhi)工(gong)日工(gong)資收入的(de)300%支付年(nian)休假(jia)工(gong)資報酬(chou)。”所以,在征得員工(gong)同(tong)意的(de)前(qian)提(ti)下,單(dan)位可以將未休年(nian)休假(jia)通(tong)過折(zhe)錢的(de)方(fang)式給員工(gong)。不(bu)過要(yao)注意,折(zhe)錢的(de)標準是給3倍(bei)(bei)的(de)工(gong)資。考慮(lv)到正(zheng)常(chang)的(de)一倍(bei)(bei)工(gong)資已經發放(fang)了,所以在具體操作(zuo)時(shi),補發2倍(bei)(bei)工(gong)資即可。
