答 用人單位(wei)在休息日(ri)安(an)排(pai)勞(lao)動(dong)者(zhe)(zhe)加(jia)(jia)(jia)班(ban)(ban)(ban)(ban)的(de),可(ke)以首先安(an)排(pai)勞(lao)動(dong)者(zhe)(zhe)補休,在無法安(an)排(pai)補休時(shi),應當支(zhi)(zhi)付(fu)(fu)加(jia)(jia)(jia)班(ban)(ban)(ban)(ban)費。但是,對于用人單位(wei)安(an)排(pai)延(yan)時(shi)加(jia)(jia)(jia)班(ban)(ban)(ban)(ban)和法定節假日(ri)加(jia)(jia)(jia)班(ban)(ban)(ban)(ban),就不能以安(an)排(pai)補休為由拒絕支(zhi)(zhi)付(fu)(fu)勞(lao)動(dong)者(zhe)(zhe)的(de)加(jia)(jia)(jia)班(ban)(ban)(ban)(ban)工(gong)資(zi),用人單位(wei)必須按照(zhao)日(ri)工(gong)資(zi)基數的(de)150%或(huo)300%支(zhi)(zhi)付(fu)(fu)加(jia)(jia)(jia)班(ban)(ban)(ban)(ban)工(gong)資(zi)。
