單位是否有權利要求員工使用年休假呢?

我(wo)們公(gong)司有年休假(jia)制度,想咨詢一下,單(dan)位是否有權利要求員工(gong)使用(yong)年休假(jia)呢?

國務院《職(zhi)工(gong)(gong)(gong)帶薪年休(xiu)(xiu)假(jia)條(tiao)例(li)》第五條(tiao)規定:“單(dan)位(wei)根據生產、工(gong)(gong)(gong)作的具體情(qing)況,并(bing)考(kao)慮職(zhi)工(gong)(gong)(gong)本人(ren)意愿(yuan),統籌安排職(zhi)工(gong)(gong)(gong)年休(xiu)(xiu)假(jia)。”這里(li)明確規定了,年休(xiu)(xiu)假(jia)的使用由(you)單(dan)位(wei)統籌安排。所以年休(xiu)(xiu)假(jia)什么時候休(xiu)(xiu),主要還是(shi)由(you)單(dan)位(wei)決定。當然,這一條(tiao)里(li)還有一句(ju)“考(kao)慮職(zhi)工(gong)(gong)(gong)本人(ren)意愿(yuan)”。如果員(yuan)(yuan)工(gong)(gong)(gong)本人(ren)非常強烈抵制的,單(dan)位(wei)也無(wu)法強行要求員(yuan)(yuan)工(gong)(gong)(gong)休(xiu)(xiu)假(jia)。畢竟(jing)腿長在員(yuan)(yuan)工(gong)(gong)(gong)腳上(shang),員(yuan)(yuan)工(gong)(gong)(gong)不(bu)要休(xiu)(xiu)假(jia),單(dan)位(wei)也無(wu)法八抬大轎把(ba)人(ren)抬回(hui)去。
