答 《勞動(dong)(dong)(dong)合(he)(he)同(tong)法》第18條規(gui)定(ding):“勞動(dong)(dong)(dong)合(he)(he)同(tong)對勞動(dong)(dong)(dong)報酬和勞動(dong)(dong)(dong)條件等(deng)標(biao)準約定(ding)不明確,引發爭議的(de),用(yong)(yong)人單位與(yu)勞動(dong)(dong)(dong)者(zhe)(zhe)可(ke)以重新協商(shang);協商(shang)不成的(de),適用(yong)(yong)集體合(he)(he)同(tong)規(gui)定(ding);沒(mei)(mei)有(you)集體合(he)(he)同(tong)或(huo)者(zhe)(zhe)集體合(he)(he)同(tong)未規(gui)定(ding)勞動(dong)(dong)(dong)報酬的(de),實行同(tong)工同(tong)酬;沒(mei)(mei)有(you)集體合(he)(he)同(tong)或(huo)者(zhe)(zhe)集體合(he)(he)同(tong)未規(gui)定(ding)勞動(dong)(dong)(dong)條件等(deng)標(biao)準的(de),適用(yong)(yong)國(guo)家有(you)關規(gui)定(ding)。”
