加班不給加班費用調休代替合法嗎?

我(wo)們公司最近讓(rang)我(wo)們加班了(le),想咨(zi)詢一下,加班不給加班費(fei)用調休代替合法嗎?

1、正常工(gong)(gong)作日延長工(gong)(gong)作時(shi)間(jian)進行加(jia)班(ban)的,應當支(zhi)(zhi)付不(bu)(bu)低(di)(di)于工(gong)(gong)資的150%的工(gong)(gong)資報酬(chou)。該(gai)加(jia)班(ban)時(shi)間(jian)不(bu)(bu)可以用調(diao)(diao)休處(chu)理,只能支(zhi)(zhi)付相應的工(gong)(gong)資報酬(chou)。 2、安(an)排(pai)(pai)(pai)周(zhou)末加(jia)班(ban)的,用人單(dan)位(wei)可以安(an)排(pai)(pai)(pai)調(diao)(diao)休代替。但如果用人單(dan)位(wei)無法安(an)排(pai)(pai)(pai)調(diao)(diao)休的,應當支(zhi)(zhi)付不(bu)(bu)低(di)(di)于工(gong)(gong)資的200%的工(gong)(gong)資報酬(chou)。 3、法定節(jie)假日加(jia)班(ban)的,該(gai)時(shi)段的加(jia)班(ban)即使后期安(an)排(pai)(pai)(pai)員工(gong)(gong)調(diao)(diao)休,用人單(dan)位(wei)也應支(zhi)(zhi)付不(bu)(bu)低(di)(di)于工(gong)(gong)資的300%的工(gong)(gong)資報酬(chou)。
