未工作至滿年休假的工作期限就離職了怎么辦?

有個員工(gong)(gong)提前把年(nian)假修完(wan)了,但(dan)是他未工(gong)(gong)作至(zhi)滿年(nian)休假的工(gong)(gong)作期限就離(li)職了怎么辦?

帶薪休假分為兩種,一(yi)種是國家規(gui)定(ding)(ding)的帶薪年(nian)休假,一(yi)種是公(gong)司在國家規(gui)定(ding)(ding)的年(nian)休假之外(wai),額外(wai)給(gei)予的年(nian)休假。前(qian)者(zhe)有法(fa)律強制性(xing),后者(zhe)則(ze)有公(gong)司自(zi)由性(xing)。前(qian)者(zhe)法(fa)律有明確(que)規(gui)定(ding)(ding),如(ru)果一(yi)個員(yuan)工離(li)職時,把不屬于自(zi)己(ji)應休的年(nian)假給(gei)休了(le),公(gong)司無權要(yao)求(qiu)員(yuan)工退還(huan)給(gei)公(gong)司,同樣也不能折錢還(huan)給(gei)公(gong)司。后者(zhe)則(ze)可以(yi)根(gen)據公(gong)司與員(yuan)工的勞動合同,或(huo)(huo)公(gong)司自(zi)己(ji)的規(gui)章制度來決定(ding)(ding)如(ru)何做。如(ru)果有明確(que)約(yue)定(ding)(ding)或(huo)(huo)規(gui)定(ding)(ding)要(yao)員(yuan)工還(huan)給(gei)公(gong)司的,按照約(yue)定(ding)(ding)或(huo)(huo)規(gui)定(ding)(ding)執行。
