公司不安排休假的可以用工資補么?

答 《職(zhi)(zhi)工(gong)(gong)帶薪年(nian)(nian)休(xiu)(xiu)假條例》第五條第三款規定:“單位確因工(gong)(gong)作需(xu)要不(bu)能安排(pai)職(zhi)(zhi)工(gong)(gong)休(xiu)(xiu)年(nian)(nian)休(xiu)(xiu)假的,經(jing)職(zhi)(zhi)工(gong)(gong)本人同(tong)意,可(ke)以不(bu)安排(pai)職(zhi)(zhi)工(gong)(gong)休(xiu)(xiu)年(nian)(nian)休(xiu)(xiu)假。對職(zhi)(zhi)工(gong)(gong)應休(xiu)(xiu)未(wei)休(xiu)(xiu)的年(nian)(nian)休(xiu)(xiu)假天數,單位應當(dang)按照(zhao)該職(zhi)(zhi)工(gong)(gong)日工(gong)(gong)資(zi)(zi)收(shou)入(ru)的300%支(zhi)付年(nian)(nian)休(xiu)(xiu)假工(gong)(gong)資(zi)(zi)報酬。”這就是說,用人單位經(jing)職(zhi)(zhi)工(gong)(gong)本人同(tong)意,不(bu)安排(pai)職(zhi)(zhi)工(gong)(gong)休(xiu)(xiu)年(nian)(nian)假,而且未(wei)休(xiu)(xiu)年(nian)(nian)假期間的工(gong)(gong)資(zi)(zi)已經(jing)正常發放(fang)的,用人單位只需(xu)再(zai)支(zhi)付勞動者日工(gong)(gong)資(zi)(zi)收(shou)入(ru)的200%就可(ke)以了。
