事假請得多要被扣雙倍工資?
問 最近我才換(huan)了(le)加新單位,新單位規定事假請得多要被扣(kou)雙(shuang)倍工資,這樣(yang)合理么?
答 《勞(lao)(lao)動合同(tong)法(fa)》第四條第二至四款規定(ding):“用人單(dan)位在制(zhi)定(ding)、修(xiu)改(gai)或(huo)者(zhe)(zhe)(zhe)(zhe)決定(ding)有關勞(lao)(lao)動報(bao)酬、工(gong)(gong)(gong)作(zuo)時(shi)(shi)間(jian)、休息休假、勞(lao)(lao)動安全衛生、保險福利、職(zhi)工(gong)(gong)(gong)培訓、勞(lao)(lao)動紀律以(yi)(yi)及(ji)勞(lao)(lao)動定(ding)額管理(li)等直(zhi)接涉及(ji)勞(lao)(lao)動者(zhe)(zhe)(zhe)(zhe)切身利益的(de)(de)規章(zhang)制(zhi)度(du)或(huo)者(zhe)(zhe)(zhe)(zhe)重(zhong)(zhong)大(da)事(shi)(shi)項時(shi)(shi),應(ying)當(dang)經職(zhi)工(gong)(gong)(gong)代表大(da)會(hui)或(huo)者(zhe)(zhe)(zhe)(zhe)全體(ti)職(zhi)工(gong)(gong)(gong)討論,提出(chu)方(fang)案和意見,與工(gong)(gong)(gong)會(hui)或(huo)者(zhe)(zhe)(zhe)(zhe)職(zhi)工(gong)(gong)(gong)代表平等協(xie)商確定(ding)。在規章(zhang)制(zhi)度(du)和重(zhong)(zhong)大(da)事(shi)(shi)項決定(ding)實施過程中(zhong),工(gong)(gong)(gong)會(hui)或(huo)者(zhe)(zhe)(zhe)(zhe)職(zhi)工(gong)(gong)(gong)認(ren)為(wei)不適當(dang)的(de)(de),有權(quan)向用人單(dan)位提出(chu),通(tong)過協(xie)商予以(yi)(yi)修(xiu)改(gai)完善。用人單(dan)位應(ying)當(dang)將(jiang)直(zhi)接涉及(ji)勞(lao)(lao)動者(zhe)(zhe)(zhe)(zhe)切身利益的(de)(de)規章(zhang)制(zhi)度(du)和重(zhong)(zhong)大(da)事(shi)(shi)項決定(ding)公(gong)示(shi),或(huo)者(zhe)(zhe)(zhe)(zhe)告(gao)知勞(lao)(lao)動者(zhe)(zhe)(zhe)(zhe)。”
