《違反和解除勞(lao)動(dong)(dong)合同(tong)(tong)的(de)經(jing)濟(ji)補(bu)償(chang)辦法》第六條(tiao),勞(lao)動(dong)(dong)者(zhe)(zhe)患病或者(zhe)(zhe)非(fei)因工(gong)(gong)(gong)(gong)負傷(shang),經(jing)勞(lao)動(dong)(dong)鑒定委員會確(que)認不(bu)能從事原工(gong)(gong)(gong)(gong)作(zuo)、也不(bu)能從事用(yong)人(ren)(ren)單位(wei)另(ling)行(xing)安排(pai)的(de)工(gong)(gong)(gong)(gong)作(zuo)而解除勞(lao)動(dong)(dong)合同(tong)(tong)的(de),用(yong)人(ren)(ren)單位(wei)應按其(qi)在本(ben)單位(wei)的(de)工(gong)(gong)(gong)(gong)作(zuo)年限,每滿一(yi)年發(fa)給(gei)相(xiang)當(dang)于(yu)一(yi)個月工(gong)(gong)(gong)(gong)資(zi)(zi)的(de)經(jing)濟(ji)補(bu)償(chang)金,同(tong)(tong)時(shi)還應發(fa)給(gei)不(bu)低于(yu)六個月工(gong)(gong)(gong)(gong)資(zi)(zi)的(de)醫療補(bu)助(zhu)費。
