辭職未提前30天通知單位,被扣工資合法嗎?

我(wo)要(yao)離(li)職了(le),但是公司(si)通(tong)知要(yao)提(ti)前30天提(ti)出,要(yao)不(bu)然就要(yao)扣工資,這樣做合法嗎?

《勞(lao)(lao)(lao)動(dong)法》第3條(tiao)規定(ding),勞(lao)(lao)(lao)動(dong)者享有取得勞(lao)(lao)(lao)動(dong)報酬的權利。《工(gong)(gong)資支(zhi)付(fu)(fu)暫行(xing)規定(ding)》第9條(tiao)規定(ding),勞(lao)(lao)(lao)動(dong)關系(xi)雙方依法解除(chu)或終止勞(lao)(lao)(lao)動(dong)合同(tong)時,用人(ren)單(dan)位(wei)應(ying)(ying)在解除(chu)或終止勞(lao)(lao)(lao)動(dong)合同(tong)時一次付(fu)(fu)清(qing)勞(lao)(lao)(lao)動(dong)者工(gong)(gong)資。勞(lao)(lao)(lao)動(dong)者提供(gong)了勞(lao)(lao)(lao)動(dong),用人(ren)單(dan)位(wei)應(ying)(ying)當支(zhi)付(fu)(fu)勞(lao)(lao)(lao)動(dong)報酬,解除(chu)勞(lao)(lao)(lao)動(dong)關系(xi)時雙方應(ying)(ying)當結清(qing)工(gong)(gong)資。工(gong)(gong)資作為正(zheng)常勞(lao)(lao)(lao)動(dong)所得,在無法定(ding)情形下(xia),用人(ren)單(dan)位(wei)無權扣除(chu)工(gong)(gong)資。
