山東省:餐飲行業最低工資可集體協商(圖)

RTX.png“這個月我拿到(dao)了1600元(yuan)的(de)(de)工(gong)資(zi),雖然少點,但不擔心以后(hou)收入不穩定了。”今天,在淄博周村區(qu)一家餐飲企業(ye)工(gong)作的(de)(de)小鄭(zheng)高(gao)興(xing)(xing)地告訴記者。讓小鄭(zheng)更(geng)高(gao)興(xing)(xing)的(de)(de)是(shi),明年他的(de)(de)工(gong)資(zi)至(zhi)少會(hui)增長8%。在實行餐飲行業(ye)工(gong)資(zi)集體(ti)協商(shang)后(hou),像小鄭(zheng)一樣,很多餐飲企業(ye)職工(gong)的(de)(de)工(gong)資(zi)今后(hou)更(geng)有保障了。

近日,省財貿(mao)金融(rong)工(gong)會(hui)(hui)(hui)、省旅(lv)游(you)飯(fan)店(dian)(dian)協(xie)(xie)會(hui)(hui)(hui)、省烹飪協(xie)(xie)會(hui)(hui)(hui)聯合制(zhi)定(ding)了(le)《全(quan)省餐飲行(xing)業工(gong)資集體(ti)(ti)協(xie)(xie)商(shang)指導(dao)意(yi)見》(以(yi)(yi)下簡稱(cheng)《意(yi)見》),供開展餐飲行(xing)業集體(ti)(ti)協(xie)(xie)商(shang)的(de)行(xing)業協(xie)(xie)會(hui)(hui)(hui)和行(xing)業工(gong)會(hui)(hui)(hui),以(yi)(yi)及開展企(qi)業工(gong)資集體(ti)(ti)協(xie)(xie)商(shang)或調整(zheng)內部工(gong)資分配制(zhi)度的(de)企(qi)業和工(gong)會(hui)(hui)(hui)參考(kao)。涉及的(de)經(jing)營(ying)類型以(yi)(yi)單店(dian)(dian)和連(lian)鎖等社會(hui)(hui)(hui)餐飲企(qi)業為主(zhu),酒店(dian)(dian)中的(de)餐飲部門、個體(ti)(ti)經(jing)營(ying)戶可(ke)以(yi)(yi)參照(zhao);適(shi)用對(dui)象為部門經(jing)理以(yi)(yi)下的(de)普通員工(gong)。今(jin)后,不僅(jin)在(zai)周村,在(zai)全(quan)省范圍(wei)內,加入旅(lv)游(you)飯(fan)店(dian)(dian)協(xie)(xie)會(hui)(hui)(hui)和烹飪協(xie)(xie)會(hui)(hui)(hui)的(de)300余家餐飲企(qi)業,更多普通職工(gong)的(de)勞動(dong)經(jing)濟(ji)權益將得(de)到切(qie)實維護。

省(sheng)財貿金融工(gong)會主任李穎介紹,近年來我(wo)省(sheng)餐飲(yin)業(ye)發展態勢良好。今年一季度,全省(sheng)累計實現餐飲(yin)收入739.2億元,比(bi)上年增長(chang)13.1%,高于同期社(she)會消費品(pin)零(ling)售(shou)總(zong)額(e)增幅3.3個(ge)百(bai)分點(dian)。同時(shi),也普(pu)遍面臨(lin)員工(gong)流動率高和(he)結(jie)構(gou)性缺工(gong)問題,特別是互聯網派生的餐飲(yin)業(ye)用工(gong)繼續增長(chang),勞動關系復雜性增強,工(gong)時(shi)長(chang)、參保率低等問題依然(ran)沒有解決。

針對問題(ti),《意見》把開展(zhan)工(gong)(gong)資集體協(xie)商的(de)主題(ti)聚焦到合(he)理確(que)定職工(gong)(gong)工(gong)(gong)資福(fu)利(li)水平和(he)工(gong)(gong)資調(diao)整幅(fu)度(du)上,兼顧企(qi)(qi)業可持續發展(zhan)和(he)員工(gong)(gong)核心利(li)益的(de)保障,重點推(tui)動六個(ge)方面的(de)協(xie)商:協(xie)商不(bu)同崗位(wei)的(de)工(gong)(gong)資支付最低標準(zhun);協(xie)商固定工(gong)(gong)資調(diao)整幅(fu)度(du);協(xie)商工(gong)(gong)資福(fu)利(li)制度(du)和(he)結(jie)構;依法協(xie)商行業基本用工(gong)(gong)標準(zhun);協(xie)商確(que)定工(gong)(gong)資相(xiang)關(guan)的(de)福(fu)利(li)項目;協(xie)商勞(lao)資雙(shuang)方共(gong)謀企(qi)(qi)業發展(zhan)、共(gong)渡難關(guan)。

協商不(bu)同(tong)(tong)崗(gang)(gang)位(wei)的(de)(de)工(gong)資(zi)支付最(zui)低(di)標(biao)(biao)準(zhun)(zhun)受(shou)關注度較高,《意見》規定(ding)(ding),餐飲行(xing)業(ye)(ye)(ye)或(huo)企(qi)業(ye)(ye)(ye)可以根據本(ben)地(di)(di)區最(zui)低(di)工(gong)資(zi)標(biao)(biao)準(zhun)(zhun)、社會平均工(gong)資(zi)、企(qi)業(ye)(ye)(ye)承(cheng)受(shou)能力等(deng)因素,重點就(jiu)本(ben)地(di)(di)區餐飲業(ye)(ye)(ye)工(gong)資(zi)支付的(de)(de)最(zui)低(di)標(biao)(biao)準(zhun)(zhun)進行(xing)協商。根據具體情況,可按照崗(gang)(gang)位(wei)、技(ji)能水平分別確定(ding)(ding)最(zui)低(di)標(biao)(biao)準(zhun)(zhun),也可按不(bu)同(tong)(tong)區域、規模、檔(dang)次(ci)、業(ye)(ye)(ye)態的(de)(de)企(qi)業(ye)(ye)(ye)或(huo)者淡季、旺季等(deng)劃分。周村確定(ding)(ding)的(de)(de)1600元(yuan)/月的(de)(de)行(xing)業(ye)(ye)(ye)標(biao)(biao)準(zhun)(zhun),就(jiu)是以當地(di)(di)最(zui)低(di)工(gong)資(zi)標(biao)(biao)準(zhun)(zhun)為(wei)準(zhun)(zhun)上(shang)浮(fu)了10%,并且(qie)規定(ding)(ding)各企(qi)業(ye)(ye)(ye)最(zui)低(di)工(gong)資(zi)不(bu)得低(di)于行(xing)業(ye)(ye)(ye)標(biao)(biao)準(zhun)(zhun)。

工(gong)(gong)資(zi)集(ji)體(ti)協商(shang)(shang)在山東餐飲(yin)行業(ye)(ye)(ye)處(chu)(chu)于起步階段(duan)。從已經(jing)開展(zhan)工(gong)(gong)資(zi)集(ji)體(ti)協商(shang)(shang)的有(you)些行業(ye)(ye)(ye)來看,集(ji)體(ti)協商(shang)(shang)的難(nan)點是如何(he)處(chu)(chu)理好(hao)企(qi)業(ye)(ye)(ye)效益(yi)與職工(gong)(gong)工(gong)(gong)資(zi)水(shui)平的關系。“開展(zhan)工(gong)(gong)資(zi)集(ji)體(ti)協商(shang)(shang)并(bing)不是單純(chun)為了給職工(gong)(gong)漲工(gong)(gong)資(zi),而是搭(da)建企(qi)業(ye)(ye)(ye)與職工(gong)(gong)平等(deng)協商(shang)(shang)的平臺,確定雙方利益(yi)的結合點,在企(qi)業(ye)(ye)(ye)提質增效的同時確保職工(gong)(gong)的基本權益(yi),實(shi)現企(qi)業(ye)(ye)(ye)和(he)職工(gong)(gong)的雙贏。”李穎說。
