1月20日上午(wu),在濟(ji)南市歷(li)下區歷(li)山路(lu)(lu)上,環衛工人張大姐(jie)正在埋頭清掃馬路(lu)(lu)。張大姐(jie)告訴(su)記者,她和(he)(he)老公從事環衛工作已經(jing)10年了,近幾年感(gan)覺待遇比以前(qian)好了很多(duo),她和(he)(he)企事業單位職工一樣(yang),享受老有所養(yang)、病有所醫的實惠。
1月20日上午,氣溫零下(xia)6℃,歷下(xia)區城管局解放路環衛(wei)所(suo)的(de)工(gong)作(zuo)人(ren)員為(wei)一線環衛(wei)工(gong)人(ren)劉大(da)叔送來姜茶。“冬天太(tai)冷(leng),容(rong)易感冒(mao)(mao),環衛(wei)所(suo)每(mei)天給我們送一杯姜茶,喝了暖和,防(fang)感冒(mao)(mao)。”從事9年環衛(wei)工(gong)作(zuo)的(de)劉大(da)叔笑著說。
臨時工(gong)、勞(lao)務派遣人(ren)(ren)員(yuan)(yuan)、編外人(ren)(ren)員(yuan)(yuan)……提起這些群體,人(ren)(ren)們(men)最先(xian)想到的常常是工(gong)資低、福利差(cha)、工(gong)作崗(gang)位“朝不保夕”等字眼。現實生活中,確(que)實有這么一群人(ren)(ren),他們(men)或是從事(shi)體力勞(lao)動養家(jia)糊口(kou),辛(xin)苦勞(lao)作一年,收入(ru)卻十分(fen)微薄;或是擠進了那些令(ling)人(ren)(ren)羨慕(mu)的機關事(shi)業單位,可(ke)在單位內部卻始終無法享受到與(yu)“編制(zhi)內”人(ren)(ren)員(yuan)(yuan)同等的待(dai)遇(yu)。
不過,在濟南市歷下區,所(suo)有(you)“非正式”一(yi)線環衛工(gong)(gong)(gong)人不僅有(you)單(dan)位辦理的(de)五險一(yi)金,能享受月(yue)工(gong)(gong)(gong)資(zi)每年上漲100元的(de)工(gong)(gong)(gong)資(zi)待(dai)遇(yu)(yu)自然增長(chang)機制,每年還能領到(dao)過節費(fei)、取(qu)暖費(fei)、高溫補助(zhu)等(deng)總計2600元左右的(de)福利。用(yong)歷下區環衛工(gong)(gong)(gong)老孔(kong)的(de)話來(lai)說(shuo),“待(dai)遇(yu)(yu)越(yue)來(lai)越(yue)好,跟正式工(gong)(gong)(gong)之間的(de)差距也越(yue)來(lai)越(yue)小(xiao)啦。”
勞(lao)(lao)(lao)動(dong)(dong)(dong)報酬(chou)(chou)權是勞(lao)(lao)(lao)動(dong)(dong)(dong)者的基(ji)本勞(lao)(lao)(lao)動(dong)(dong)(dong)權利(li)。《勞(lao)(lao)(lao)動(dong)(dong)(dong)法》第46條明確規(gui)定:“工(gong)(gong)(gong)(gong)(gong)(gong)資分配應(ying)當遵(zun)循(xun)按勞(lao)(lao)(lao)分配原則,實(shi)行同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)。”想(xiang)要真正將同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)落(luo)(luo)到實(shi)處,不僅(jin)要有(you)法律保障(zhang),更需要各省制定符合自(zi)身情(qing)況的好政策。近(jin)年(nian)來(lai),在(zai)作(zuo)為人(ren)口大(da)省和(he)用(yong)工(gong)(gong)(gong)(gong)(gong)(gong)大(da)省的山(shan)(shan)東(dong),“同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)不同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)”現象正伴隨著人(ren)社(she)部門(men)的改(gai)革步伐(fa)而(er)逐漸改(gai)善。2012年(nian)以來(lai),山(shan)(shan)東(dong)大(da)力推進(jin)規(gui)范勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)和(he)同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo),省人(ren)社(she)廳聯合有(you)關部門(men)連續推出相關政策文件,針(zhen)對(dui)不同(tong)(tong)(tong)(tong)(tong)的用(yong)人(ren)單(dan)(dan)位(wei)和(he)不同(tong)(tong)(tong)(tong)(tong)的勞(lao)(lao)(lao)動(dong)(dong)(dong)者,分類施策,從規(gui)范企業(ye)(ye)勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)用(yong)工(gong)(gong)(gong)(gong)(gong)(gong)行為、保護機關事業(ye)(ye)單(dan)(dan)位(wei)編外人(ren)員合法權益、保障(zhang)農民工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)資支付等(deng)多個(ge)側面(mian)和(he)角度來(lai)推進(jin)同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)落(luo)(luo)實(shi)。目前,全省企業(ye)(ye)已(yi)經基(ji)本落(luo)(luo)實(shi)同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou),機關事業(ye)(ye)單(dan)(dan)位(wei)同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)正式(shi)起步并(bing)在(zai)全國領(ling)先,對(dui)于勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)人(ren)員、臨時工(gong)(gong)(gong)(gong)(gong)(gong)、編外人(ren)員來(lai)說,同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)已(yi)不再是個(ge)夢。
五(wu)險一金(jin)全覆蓋(gai),濟南歷(li)下區環(huan)衛(wei)工幸(xing)福指數直(zhi)線(xian)上(shang)升(sheng)。
“干了16年環(huan)(huan)衛(wei)(wei)工(gong)(gong)(gong),最近(jin)這幾(ji)年明顯感覺(jue)到待遇比以前好多(duo)啦(la)。”50歲的(de)老(lao)孔(kong)是(shi)濟南市歷(li)下區城管局解放路環(huan)(huan)衛(wei)(wei)所的(de)一名環(huan)(huan)衛(wei)(wei)工(gong)(gong)(gong),常(chang)年負(fu)責歷(li)山(shan)路沿線(xian)約500米的(de)一段路面衛(wei)(wei)生(sheng)工(gong)(gong)(gong)作(zuo)。老(lao)孔(kong)說,他所在的(de)環(huan)(huan)衛(wei)(wei)所有一百多(duo)人,絕大多(duo)數(shu)是(shi)在一線(xian)工(gong)(gong)(gong)作(zuo)的(de)環(huan)(huan)衛(wei)(wei)工(gong)(gong)(gong)人,大伙兒的(de)一個共同特點就(jiu)是(shi)“非正式工(gong)(gong)(gong)”。以前,“非正式工(gong)(gong)(gong)”的(de)工(gong)(gong)(gong)資比正式員工(gong)(gong)(gong)低不少,更別提醫療、養老(lao)等方面的(de)保障(zhang)了。
變化始于3年前。老孔告訴記(ji)者,2012年起,他和工(gong)(gong)友們陸(lu)續接(jie)到單位辦理五(wu)險(xian)一金的通知,“剛開(kai)始咱根本弄不(bu)清(qing)這五(wu)險(xian)一金有(you)啥好處,后來(lai)明白了(le),這可是(shi)咱后半輩(bei)子(zi)的保障。”老孔笑著(zhu)說,除了(le)五(wu)險(xian)一金,每(mei)(mei)年的冬(dong)季取暖費、夏季高溫補助(zhu)、過節(jie)慰問(wen)品(pin)、每(mei)(mei)月5斤雞蛋等福利一樣(yang)不(bu)少,而且不(bu)分(fen)正式(shi)工(gong)(gong)和“非(fei)正式(shi)工(gong)(gong)”,每(mei)(mei)個環衛(wei)工(gong)(gong)都(dou)有(you)。
據歷下區(qu)城市管理局(ju)相關負責人(ren)介紹,目前,歷下區(qu)城管局(ju)有(you)(you)16個環(huan)衛(wei)(wei)所(suo)(suo),每個所(suo)(suo)有(you)(you)一百多名員工(gong)(gong)(gong)(gong),絕大多數都是(shi)勞務派遣(qian)人(ren)員,光是(shi)一線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)加起來就(jiu)將近(jin)2000人(ren)。2012年3月,區(qu)里開始為一線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)辦理五險一金(jin),并(bing)對超(chao)齡人(ren)員設置(zhi)專(zhuan)人(ren)專(zhuan)項賬戶,向不(bu)符合入(ru)保條件(jian)的(de)(de)一線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)發(fa)放補(bu)貼(tie);為環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)建立工(gong)(gong)(gong)(gong)資(zi)待遇自然增長(chang)(chang)機制,每年為一線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)每人(ren)每月增長(chang)(chang)工(gong)(gong)(gong)(gong)資(zi)100元(yuan);提(ti)供免費的(de)(de)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)公寓(yu),并(bing)對暫無(wu)住(zhu)房的(de)(de)外(wai)來環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)提(ti)供住(zhu)房補(bu)貼(tie)等(deng)。經過3年多的(de)(de)不(bu)懈努(nu)力,如(ru)今,歷下區(qu)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)平均月工(gong)(gong)(gong)(gong)資(zi)達到2000余元(yuan),高于(yu)最低工(gong)(gong)(gong)(gong)資(zi)標準25%,此(ci)外(wai),每人(ren)每年可領到2600元(yuan)左右的(de)(de)各項福利補(bu)貼(tie)。吃(chi)飯住(zhu)房不(bu)用發(fa)愁,工(gong)(gong)(gong)(gong)資(zi)福利年年上(shang)(shang)漲,生(sheng)病退休(xiu)有(you)(you)了保障,全區(qu)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)再也不(bu)用為了“非正式工(gong)(gong)(gong)(gong)”的(de)(de)身份(fen)發(fa)愁,幸福指(zhi)數直線上(shang)(shang)升。
督促企業(ye)落實(shi)同工同酬,中行2960名派遣員工完成身份轉(zhuan)換。
勞務派(pai)遣用(yong)(yong)工(gong)(gong)(gong)(gong)是企(qi)業(ye)合(he)(he)同(tong)(tong)(tong)(tong)制用(yong)(yong)工(gong)(gong)(gong)(gong)的補充(chong)形式,目(mu)的是解決企(qi)業(ye)臨時性(xing)用(yong)(yong)工(gong)(gong)(gong)(gong)和(he)(he)(he)勞動(dong)者短期(qi)就業(ye)的問題(ti)。但在(zai)實(shi)踐中,這一(yi)補充(chong)性(xing)用(yong)(yong)工(gong)(gong)(gong)(gong)制度被(bei)一(yi)些單位(wei)濫用(yong)(yong):一(yi)些用(yong)(yong)工(gong)(gong)(gong)(gong)單位(wei)在(zai)同(tong)(tong)(tong)(tong)一(yi)工(gong)(gong)(gong)(gong)作(zuo)崗位(wei)混崗使用(yong)(yong)派(pai)遣制員工(gong)(gong)(gong)(gong)和(he)(he)(he)本單位(wei)職(zhi)工(gong)(gong)(gong)(gong),實(shi)行不同(tong)(tong)(tong)(tong)的勞動(dong)報酬(chou)分配制度和(he)(he)(he)辦法,派(pai)遣制員工(gong)(gong)(gong)(gong)相對于用(yong)(yong)工(gong)(gong)(gong)(gong)單位(wei)職(zhi)工(gong)(gong)(gong)(gong)勞動(dong)報酬(chou)明顯偏低,有的只(zhi)相當于用(yong)(yong)工(gong)(gong)(gong)(gong)單位(wei)合(he)(he)同(tong)(tong)(tong)(tong)制職(zhi)工(gong)(gong)(gong)(gong)的50%左右,直接影響了(le)勞務派(pai)遣職(zhi)工(gong)(gong)(gong)(gong)的工(gong)(gong)(gong)(gong)作(zuo)熱情和(he)(he)(he)歸屬感。以規(gui)范勞務派(pai)遣用(yong)(yong)工(gong)(gong)(gong)(gong)為重(zhong)點(dian),督促企(qi)業(ye)落實(shi)同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬(chou),成為我省推(tui)進相關改革的又一(yi)重(zhong)要舉措。
以中(zhong)(zhong)國銀行(xing)山東(dong)省分行(xing)為例(li),到(dao)2013年末,該行(xing)仍有近3000名(ming)派(pai)(pai)(pai)遣員(yuan)(yuan)工(gong)(gong)(gong),占全(quan)行(xing)員(yuan)(yuan)工(gong)(gong)(gong)總數的(de)17.09%。在(zai)這(zhe)(zhe)些派(pai)(pai)(pai)遣員(yuan)(yuan)工(gong)(gong)(gong)中(zhong)(zhong),有90%左右都在(zai)各個營(ying)業網點工(gong)(gong)(gong)作(zuo),是(shi)銀行(xing)基層隊伍(wu)的(de)重要組成部分,可由于受到(dao)“勞(lao)務派(pai)(pai)(pai)遣”的(de)身份限制(zhi),他們在(zai)工(gong)(gong)(gong)資(zi)待遇方面(mian)與(yu)正式(shi)員(yuan)(yuan)工(gong)(gong)(gong)仍有一(yi)定(ding)差(cha)距。不過,這(zhe)(zhe)一(yi)現象在(zai)近兩年得到(dao)了有效改善,通(tong)過制(zhi)定(ding)《中(zhong)(zhong)國銀行(xing)山東(dong)省分行(xing)調(diao)整勞(lao)務派(pai)(pai)(pai)遣用(yong)工(gong)(gong)(gong)管理政策工(gong)(gong)(gong)作(zuo)方案》,中(zhong)(zhong)行(xing)山東(dong)省分行(xing)明確了以勞(lao)動合同用(yong)工(gong)(gong)(gong)作(zuo)為基本用(yong)工(gong)(gong)(gong)形式(shi),2014年以來,全(quan)轄2960名(ming)派(pai)(pai)(pai)遣員(yuan)(yuan)工(gong)(gong)(gong)已全(quan)部轉換為合同制(zhi)員(yuan)(yuan)工(gong)(gong)(gong),整個轉換過程公開(kai)透(tou)明,有效保障(zhang)了員(yuan)(yuan)工(gong)(gong)(gong)利益。
記者從省人社廳(ting)了解到,為促進勞(lao)(lao)(lao)動者短期(qi)就業(ye),從源(yuan)頭上解決和(he)減少(shao)同工同酬問(wen)題,山東在完善用工機制(zhi)、規范(fan)勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)方面采取(qu)了一系(xi)列措(cuo)施(shi)。一方面嚴(yan)格(ge)執(zhi)行(xing)人力資源(yuan)社會保障部《勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)行(xing)政許(xu)(xu)可(ke)(ke)實(shi)施(shi)辦法》,自2013年(nian)7月1日起,對(dui)新(xin)設立(li)的(de)(de)勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)單(dan)位經營(ying)勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)業(ye)務(wu)實(shi)行(xing)行(xing)政許(xu)(xu)可(ke)(ke);對(dui)已(yi)經經營(ying)勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)業(ye)務(wu)的(de)(de)勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)單(dan)位,要求其(qi)在一年(nian)內取(qu)得經營(ying)勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)業(ye)務(wu)的(de)(de)行(xing)政許(xu)(xu)可(ke)(ke);自2014年(nian)7月1日起,未取(qu)得行(xing)政許(xu)(xu)可(ke)(ke)的(de)(de),任何(he)單(dan)位和(he)個人不(bu)得經營(ying)勞(lao)(lao)(lao)務(wu)派(pai)(pai)遣(qian)(qian)業(ye)務(wu)。截至目前(qian),全省已(yi)對(dui)1067戶派(pai)(pai)遣(qian)(qian)單(dan)位實(shi)施(shi)許(xu)(xu)可(ke)(ke)。
另一方面則(ze)是從(cong)嚴控制(zhi)(zhi)用(yong)工(gong)(gong)(gong)(gong)企(qi)業(ye)使用(yong)派遣制(zhi)(zhi)員工(gong)(gong)(gong)(gong)的(de)比例。以獨(du)立(li)法(fa)人(ren)單位(wei)的(de)所有職(zhi)工(gong)(gong)(gong)(gong)為(wei)基數進(jin)行(xing)核算,從(cong)使用(yong)勞務(wu)派遣工(gong)(gong)(gong)(gong)的(de)比例上(shang)進(jin)行(xing)限制(zhi)(zhi)。對超過(guo)規定比例使用(yong)勞務(wu)派遣工(gong)(gong)(gong)(gong)的(de)用(yong)工(gong)(gong)(gong)(gong)單位(wei),依(yi)照法(fa)律規定每(mei)超過(guo)1人(ren)處(chu)以5000元以上(shang)20000元以下(xia)的(de)罰款(kuan)。對個別國有企(qi)業(ye)的(de)特殊情況,采取企(qi)業(ye)申請、報人(ren)力資源社會(hui)保障行(xing)政部門備案的(de)辦法(fa),在規定時間內實現過(guo)渡。
省委省政府(fu)帶頭落(luo)實同(tong)工同(tong)酬,編(bian)外人員月工資提高400元。
近年來(lai),隨(sui)著(zhu)社會公共服務(wu)需求的(de)(de)不斷擴大(da),一些機(ji)(ji)關事業單(dan)(dan)位(wei)使用(yong)了(le)大(da)量的(de)(de)編(bian)外(wai)人員(yuan)(yuan)。據省人社廳勞動(dong)關系處相關負責人介紹,機(ji)(ji)關事業單(dan)(dan)位(wei)未(wei)納入正式職工管(guan)理人員(yuan)(yuan)主要(yao)有(you)三種(zhong)形式:單(dan)(dan)位(wei)直接簽(qian)訂勞動(dong)合同(tong)人員(yuan)(yuan)、單(dan)(dan)位(wei)使用(yong)的(de)(de)勞務(wu)派遣人員(yuan)(yuan)、單(dan)(dan)位(wei)按照機(ji)(ji)關事業單(dan)(dan)位(wei)人員(yuan)(yuan)管(guan)理方式聘用(yong)的(de)(de)人員(yuan)(yuan)。他們中的(de)(de)不少(shao)人做著(zhu)跟“編(bian)制內”人員(yuan)(yuan)差(cha)不多的(de)(de)工作(zuo),可獲得(de)的(de)(de)報酬卻有(you)不小(xiao)差(cha)距。
如今,編(bian)制內外看似“鐵板一塊”的待遇差距正在(zai)逐步縮小。全國人(ren)大(da)關于修改勞動(dong)合(he)同(tong)法(fa)的決定公(gong)布后,山東加強對用工(gong)(gong)單位(wei)(wei)的執法(fa)檢查,召開了機關事(shi)業單位(wei)(wei)推(tui)進(jin)同(tong)工(gong)(gong)同(tong)酬(chou)(chou)工(gong)(gong)作座談(tan)會,結合(he)全省(sheng)(sheng)機關事(shi)業單位(wei)(wei)“吃空餉(xiang)”專(zhuan)項整(zheng)治工(gong)(gong)作,妥善處(chu)理機關事(shi)業單位(wei)(wei)歷史形(xing)成(cheng)的編(bian)制外人(ren)員(yuan)問題,積極推(tui)進(jin)機關事(shi)業單位(wei)(wei)同(tong)工(gong)(gong)同(tong)酬(chou)(chou)。據了解(jie),2014年12月1日(ri)起,省(sheng)(sheng)委、省(sheng)(sheng)人(ren)大(da)、省(sheng)(sheng)政府、省(sheng)(sheng)政協辦公(gong)廳將編(bian)外人(ren)員(yuan)中的汽車(che)司機、廚師、水電維修工(gong)(gong)等技能崗位(wei)(wei)和(he)其他崗位(wei)(wei)人(ren)員(yuan)的月工(gong)(gong)資提(ti)高達2100元和(he)2000元,較之前分別提(ti)高400元和(he)300元,工(gong)(gong)資水平超(chao)過了濟南市同(tong)類職業人(ren)員(yuan)工(gong)(gong)資指導價(jia)位(wei)(wei)低位(wei)(wei)數。
記者(zhe)從省人(ren)社(she)廳(ting)了解到,截(jie)至2014年(nian)底,全省多(duo)數省直機關事業單(dan)位(wei)(wei)已經按照要求對編(bian)外人(ren)員(yuan)(yuan)管(guan)理進行了規范,一部(bu)分(fen)單(dan)位(wei)(wei)將“臨(lin)時人(ren)員(yuan)(yuan)”改為(wei)規范的(de)勞(lao)務派遣用工(gong)(gong),一部(bu)分(fen)單(dan)位(wei)(wei)改為(wei)直接簽(qian)訂勞(lao)動(dong)合同(tong)(tong)(tong),按照社(she)會(hui)保險(xian)法規定參加社(she)會(hui)保險(xian),工(gong)(gong)資水平也(ye)有了一定程度提高,部(bu)分(fen)編(bian)外人(ren)員(yuan)(yuan)的(de)工(gong)(gong)資收入已經達到或接近同(tong)(tong)(tong)崗位(wei)(wei)、同(tong)(tong)(tong)等資歷人(ren)員(yuan)(yuan)的(de)收入水平。
2015年(nian)3月,山東省在深入(ru)調研(yan)基礎上,以保障(zhang)勞(lao)動者合(he)法權(quan)益(yi)為切入(ru)點,出臺了《關(guan)(guan)(guan)于維護機(ji)關(guan)(guan)(guan)事(shi)(shi)(shi)業單(dan)(dan)位(wei)未(wei)(wei)納入(ru)正式(shi)職工管(guan)理(li)人(ren)員勞(lao)動保障(zhang)權(quan)益(yi)的(de)通知》:明(ming)確了機(ji)關(guan)(guan)(guan)事(shi)(shi)(shi)業單(dan)(dan)位(wei)未(wei)(wei)納入(ru)正式(shi)職工管(guan)理(li)的(de)人(ren)員的(de)管(guan)理(li)方式(shi);規(gui)定(ding)了機(ji)關(guan)(guan)(guan)事(shi)(shi)(shi)業單(dan)(dan)位(wei)使(shi)用未(wei)(wei)納入(ru)正式(shi)職工管(guan)理(li)的(de)人(ren)員,應當為其繳納相應的(de)“五險一金”;明(ming)確要求機(ji)關(guan)(guan)(guan)事(shi)(shi)(shi)業單(dan)(dan)位(wei)要制定(ding)符合(he)同工同酬分配(pei)(pei)原則的(de)勞(lao)動報酬分配(pei)(pei)辦法……對于多數身在機(ji)關(guan)(guan)(guan)事(shi)(shi)(shi)業單(dan)(dan)位(wei)的(de)編外人(ren)員來(lai)說(shuo),這無疑將帶來(lai)真正的(de)福(fu)音。

同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)(chou)是指同(tong)(tong)一個單(dan)位(wei)內(nei)同(tong)(tong)類崗位(wei)的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)者實行相(xiang)同(tong)(tong)的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)報(bao)酬(chou)(chou)分配辦法,通過各種制度、措施逐步(bu)減少收入(ru)差距,是現階(jie)段落實同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)(chou)的(de)(de)工(gong)(gong)(gong)作方向。2012年12月(yue)28日全國人大常委(wei)會決定修改(gai)《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法》后,山東省(sheng)加(jia)快了(le)《山東省(sheng)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)條例》的(de)(de)修訂(ding)工(gong)(gong)(gong)作,針(zhen)對勞(lao)(lao)(lao)務(wu)派遣、同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)(chou)問(wen)題開展專(zhuan)題調(diao)研(yan),進一步(bu)完(wan)善勞(lao)(lao)(lao)務(wu)派遣的(de)(de)法律規定。
為便于各地(di)準確掌握同(tong)(tong)工(gong)(gong)同(tong)(tong)酬的(de)(de)內(nei)涵(han),便于實(shi)際操作,省人(ren)(ren)社(she)廳召開(kai)不(bu)同(tong)(tong)類(lei)型、不(bu)同(tong)(tong)層次的(de)(de)研(yan)討會(hui),反復(fu)征(zheng)求(qiu)地(di)方主(zhu)管部門(men)、用(yong)人(ren)(ren)單位(wei)意(yi)見,并商人(ren)(ren)力(li)資(zi)(zi)源社(she)會(hui)保障部同(tong)(tong)意(yi)后,形成了對同(tong)(tong)工(gong)(gong)同(tong)(tong)酬進(jin)行(xing)(xing)(xing)界定(ding)的(de)(de)初步意(yi)見:一是(shi)用(yong)工(gong)(gong)單位(wei)使用(yong)勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣工(gong)(gong)應嚴(yan)格限(xian)定(ding)在臨時性、輔助性或者(zhe)替代性工(gong)(gong)作崗位(wei)的(de)(de)范圍之內(nei),不(bu)得超過國家規定(ding)的(de)(de)比例。二(er)是(shi)用(yong)工(gong)(gong)單位(wei)在2012年12月28日前與(yu)勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣單位(wei)簽訂的(de)(de)勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣協議(yi)、勞(lao)(lao)務(wu)派(pai)(pai)(pai)遣單位(wei)簽訂的(de)(de)勞(lao)(lao)動(dong)合同(tong)(tong),除違背同(tong)(tong)工(gong)(gong)同(tong)(tong)酬原(yuan)(yuan)則的(de)(de)內(nei)容外,應當(dang)(dang)繼(ji)續履行(xing)(xing)(xing)至期限(xian)屆滿。三是(shi)用(yong)工(gong)(gong)單位(wei)應當(dang)(dang)按照(zhao)同(tong)(tong)工(gong)(gong)同(tong)(tong)酬原(yuan)(yuan)則,對被派(pai)(pai)(pai)遣勞(lao)(lao)動(dong)者(zhe)與(yu)本(ben)單位(wei)同(tong)(tong)類(lei)崗位(wei)的(de)(de)勞(lao)(lao)動(dong)者(zhe)實(shi)行(xing)(xing)(xing)相(xiang)同(tong)(tong)的(de)(de)勞(lao)(lao)動(dong)報酬分配(pei)辦法。用(yong)工(gong)(gong)單位(wei)無(wu)同(tong)(tong)類(lei)崗位(wei)勞(lao)(lao)動(dong)者(zhe)的(de)(de),應當(dang)(dang)參(can)照(zhao)當(dang)(dang)地(di)人(ren)(ren)力(li)資(zi)(zi)源市場工(gong)(gong)資(zi)(zi)指導(dao)價(jia)位(wei),做到同(tong)(tong)工(gong)(gong)同(tong)(tong)酬。
2013年(nian)8月1日修訂(ding)的《山東(dong)省(sheng)勞(lao)動(dong)合同(tong)(tong)條例(li)》第四十(shi)八條規(gui)定,細化勞(lao)務派(pai)(pai)遣關(guan)于“臨時性、輔助性、替代性”崗位(wei)(wei)的規(gui)定,明確“替代性工(gong)(gong)(gong)(gong)作崗位(wei)(wei)是(shi)指用工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)的勞(lao)動(dong)者(zhe)因脫產學習、休(xiu)假(jia)等原因無法工(gong)(gong)(gong)(gong)作,一(yi)(yi)年(nian)之內(nei)可以由(you)其他勞(lao)動(dong)者(zhe)替代工(gong)(gong)(gong)(gong)作的崗位(wei)(wei)”,進一(yi)(yi)步明確了(le)“替代性工(gong)(gong)(gong)(gong)作崗位(wei)(wei)”的適用范圍(wei),有(you)效(xiao)壓縮了(le)企業(ye)大規(gui)模使用勞(lao)務派(pai)(pai)遣工(gong)(gong)(gong)(gong)的空間。《條例(li)》還明確了(le)同(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)酬的實質(zhi),第五十(shi)條明確要求,“用工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)應(ying)當保(bao)障被派(pai)(pai)遣勞(lao)動(dong)者(zhe)與(yu)本單(dan)位(wei)(wei)職工(gong)(gong)(gong)(gong)享(xiang)有(you)同(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)酬的權利,實行相同(tong)(tong)的勞(lao)動(dong)報(bao)酬分配(pei)辦(ban)法。”
