1月20日上午,在濟(ji)南市歷下區(qu)歷山路上,環衛工人張大(da)姐正在埋頭(tou)清掃馬路。張大(da)姐告訴(su)記者,她和老(lao)公從事(shi)環衛工作已經10年(nian)(nian)了(le),近幾年(nian)(nian)感覺待遇比以前好了(le)很多,她和企事(shi)業(ye)單(dan)位(wei)職工一(yi)樣,享受(shou)老(lao)有所養、病有所醫(yi)的實惠。
1月20日上(shang)午,氣(qi)溫零下6℃,歷下區城管局解放路環衛(wei)所的工(gong)作人員(yuan)為一線(xian)環衛(wei)工(gong)人劉(liu)大叔(shu)送來(lai)姜茶。“冬(dong)天(tian)太冷,容(rong)易感(gan)冒(mao),環衛(wei)所每天(tian)給我們送一杯姜茶,喝了暖和,防感(gan)冒(mao)。”從(cong)事9年環衛(wei)工(gong)作的劉(liu)大叔(shu)笑(xiao)著說。
臨(lin)時工(gong)(gong)、勞務(wu)派遣人(ren)(ren)員、編(bian)(bian)外人(ren)(ren)員……提起這(zhe)些群體,人(ren)(ren)們最(zui)先想到的常(chang)常(chang)是工(gong)(gong)資低、福利(li)差、工(gong)(gong)作崗位“朝不保夕”等(deng)字眼。現實生活(huo)中,確實有這(zhe)么一(yi)群人(ren)(ren),他們或是從事體力(li)勞動養家糊(hu)口,辛苦勞作一(yi)年(nian),收入卻(que)十分微薄;或是擠進了(le)那些令人(ren)(ren)羨(xian)慕的機關事業(ye)單位,可在單位內部卻(que)始終無法享受(shou)到與“編(bian)(bian)制內”人(ren)(ren)員同等(deng)的待遇(yu)。
不過,在(zai)濟南市(shi)歷下(xia)區,所(suo)有“非正式”一(yi)線環衛工人(ren)不僅(jin)有單位辦(ban)理的五(wu)險一(yi)金,能享受月工資(zi)每年上漲100元(yuan)的工資(zi)待遇(yu)自然增長機制,每年還能領到過節費(fei)、取暖費(fei)、高溫補助等(deng)總計2600元(yuan)左右的福(fu)利。用歷下(xia)區環衛工老(lao)孔的話來說,“待遇(yu)越(yue)來越(yue)好,跟正式工之(zhi)間的差(cha)距也(ye)越(yue)來越(yue)小啦。”
勞(lao)(lao)動報(bao)酬(chou)權(quan)是(shi)勞(lao)(lao)動者(zhe)的(de)基本(ben)勞(lao)(lao)動權(quan)利。《勞(lao)(lao)動法》第46條(tiao)明確(que)規定(ding):“工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)分(fen)配(pei)應當遵循按勞(lao)(lao)分(fen)配(pei)原(yuan)則,實(shi)(shi)行同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)。”想要(yao)真正將同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)落到(dao)實(shi)(shi)處,不(bu)僅要(yao)有法律保(bao)障(zhang),更需要(yao)各省制定(ding)符合自(zi)身(shen)情況的(de)好政(zheng)策。近年來(lai),在(zai)作為人(ren)(ren)口大省和(he)用(yong)工(gong)(gong)(gong)(gong)(gong)(gong)大省的(de)山東,“同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)不(bu)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)”現(xian)象正伴隨(sui)著人(ren)(ren)社部門的(de)改革(ge)步伐而逐漸改善。2012年以來(lai),山東大力推(tui)進(jin)規范勞(lao)(lao)務(wu)(wu)派遣(qian)和(he)同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)工(gong)(gong)(gong)(gong)(gong)(gong)作,省人(ren)(ren)社廳聯合有關部門連續推(tui)出相(xiang)關政(zheng)策文件,針對不(bu)同(tong)(tong)(tong)(tong)(tong)(tong)的(de)用(yong)人(ren)(ren)單(dan)位和(he)不(bu)同(tong)(tong)(tong)(tong)(tong)(tong)的(de)勞(lao)(lao)動者(zhe),分(fen)類施策,從規范企(qi)業(ye)勞(lao)(lao)務(wu)(wu)派遣(qian)用(yong)工(gong)(gong)(gong)(gong)(gong)(gong)行為、保(bao)護(hu)機(ji)關事(shi)業(ye)單(dan)位編(bian)外人(ren)(ren)員(yuan)(yuan)合法權(quan)益、保(bao)障(zhang)農民工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)支(zhi)付(fu)等多個(ge)側面和(he)角度來(lai)推(tui)進(jin)同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)落實(shi)(shi)。目(mu)前,全(quan)省企(qi)業(ye)已(yi)(yi)經基本(ben)落實(shi)(shi)同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou),機(ji)關事(shi)業(ye)單(dan)位同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)工(gong)(gong)(gong)(gong)(gong)(gong)作正式起步并在(zai)全(quan)國領(ling)先,對于勞(lao)(lao)務(wu)(wu)派遣(qian)人(ren)(ren)員(yuan)(yuan)、臨(lin)時工(gong)(gong)(gong)(gong)(gong)(gong)、編(bian)外人(ren)(ren)員(yuan)(yuan)來(lai)說(shuo),同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)已(yi)(yi)不(bu)再是(shi)個(ge)夢。
五險一金全覆(fu)蓋,濟南(nan)歷下區環衛工(gong)幸福指數直線上升(sheng)。
“干(gan)了16年環(huan)(huan)衛(wei)(wei)工,最近這(zhe)幾年明顯感覺到(dao)待遇比以(yi)前(qian)好(hao)多啦。”50歲(sui)的老(lao)孔是(shi)濟南市(shi)歷(li)(li)下區城管(guan)局解放路環(huan)(huan)衛(wei)(wei)所的一名(ming)環(huan)(huan)衛(wei)(wei)工,常年負責歷(li)(li)山路沿線約500米的一段路面衛(wei)(wei)生工作。老(lao)孔說(shuo),他所在的環(huan)(huan)衛(wei)(wei)所有一百多人,絕大(da)多數是(shi)在一線工作的環(huan)(huan)衛(wei)(wei)工人,大(da)伙兒的一個共同特(te)點(dian)就是(shi)“非正(zheng)式工”。以(yi)前(qian),“非正(zheng)式工”的工資(zi)比正(zheng)式員工低不少,更別提醫療、養老(lao)等(deng)方面的保障(zhang)了。
變(bian)化始于(yu)3年前。老孔告訴記(ji)者,2012年起,他和工(gong)友們陸續接到單位(wei)辦理五險(xian)一(yi)金(jin)的通(tong)知,“剛開始咱(zan)根本(ben)弄(nong)不(bu)清這五險(xian)一(yi)金(jin)有啥好處(chu),后來明白了,這可(ke)是咱(zan)后半輩子(zi)的保障。”老孔笑(xiao)著說,除了五險(xian)一(yi)金(jin),每年的冬季取暖(nuan)費、夏季高溫(wen)補助(zhu)、過節慰(wei)問品、每月5斤雞蛋等福利(li)一(yi)樣(yang)不(bu)少,而且不(bu)分正(zheng)(zheng)式工(gong)和“非正(zheng)(zheng)式工(gong)”,每個環衛(wei)工(gong)都有。
據歷下區(qu)(qu)城市(shi)管理局(ju)相關負責人(ren)介紹,目前,歷下區(qu)(qu)城管局(ju)有(you)16個環(huan)衛(wei)(wei)所,每個所有(you)一(yi)百多名員(yuan)工(gong)(gong)(gong)(gong),絕(jue)大(da)多數(shu)都是(shi)勞務派遣人(ren)員(yuan),光是(shi)一(yi)線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)加起來就將近2000人(ren)。2012年(nian)(nian)3月,區(qu)(qu)里開始為(wei)(wei)一(yi)線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)辦理五險(xian)一(yi)金,并(bing)對(dui)超齡人(ren)員(yuan)設(she)置專(zhuan)人(ren)專(zhuan)項(xiang)賬戶,向(xiang)不(bu)符合入保條件的一(yi)線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)發(fa)放補貼(tie);為(wei)(wei)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)建立工(gong)(gong)(gong)(gong)資(zi)(zi)待(dai)遇自然增長機制,每年(nian)(nian)為(wei)(wei)一(yi)線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)每人(ren)每月增長工(gong)(gong)(gong)(gong)資(zi)(zi)100元;提(ti)供免費的環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)公寓(yu),并(bing)對(dui)暫無住(zhu)房的外(wai)來環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)提(ti)供住(zhu)房補貼(tie)等。經過3年(nian)(nian)多的不(bu)懈(xie)努力,如(ru)今,歷下區(qu)(qu)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)平均月工(gong)(gong)(gong)(gong)資(zi)(zi)達到2000余元,高于最(zui)低工(gong)(gong)(gong)(gong)資(zi)(zi)標(biao)準25%,此外(wai),每人(ren)每年(nian)(nian)可領到2600元左右的各(ge)項(xiang)福(fu)利補貼(tie)。吃(chi)飯住(zhu)房不(bu)用發(fa)愁,工(gong)(gong)(gong)(gong)資(zi)(zi)福(fu)利年(nian)(nian)年(nian)(nian)上漲,生病退(tui)休(xiu)有(you)了保障,全區(qu)(qu)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)再也不(bu)用為(wei)(wei)了“非(fei)正式工(gong)(gong)(gong)(gong)”的身份發(fa)愁,幸福(fu)指數(shu)直線上升。
督促企業落實(shi)同工(gong)同酬,中行2960名派遣(qian)員工(gong)完(wan)成身(shen)份轉換。
勞(lao)務派遣(qian)用(yong)(yong)(yong)工(gong)(gong)(gong)是企業(ye)(ye)合同(tong)(tong)制(zhi)用(yong)(yong)(yong)工(gong)(gong)(gong)的(de)補(bu)充形式,目(mu)的(de)是解決(jue)企業(ye)(ye)臨時(shi)性用(yong)(yong)(yong)工(gong)(gong)(gong)和(he)勞(lao)動者短期就業(ye)(ye)的(de)問題。但在(zai)實(shi)踐中,這一(yi)補(bu)充性用(yong)(yong)(yong)工(gong)(gong)(gong)制(zhi)度(du)被一(yi)些單(dan)位(wei)(wei)濫用(yong)(yong)(yong):一(yi)些用(yong)(yong)(yong)工(gong)(gong)(gong)單(dan)位(wei)(wei)在(zai)同(tong)(tong)一(yi)工(gong)(gong)(gong)作崗位(wei)(wei)混崗使用(yong)(yong)(yong)派遣(qian)制(zhi)員工(gong)(gong)(gong)和(he)本(ben)單(dan)位(wei)(wei)職工(gong)(gong)(gong),實(shi)行(xing)不同(tong)(tong)的(de)勞(lao)動報(bao)酬分(fen)配制(zhi)度(du)和(he)辦法,派遣(qian)制(zhi)員工(gong)(gong)(gong)相(xiang)(xiang)對于用(yong)(yong)(yong)工(gong)(gong)(gong)單(dan)位(wei)(wei)職工(gong)(gong)(gong)勞(lao)動報(bao)酬明顯偏低,有的(de)只相(xiang)(xiang)當(dang)于用(yong)(yong)(yong)工(gong)(gong)(gong)單(dan)位(wei)(wei)合同(tong)(tong)制(zhi)職工(gong)(gong)(gong)的(de)50%左右,直接影(ying)響了(le)勞(lao)務派遣(qian)職工(gong)(gong)(gong)的(de)工(gong)(gong)(gong)作熱情和(he)歸屬感。以(yi)規范勞(lao)務派遣(qian)用(yong)(yong)(yong)工(gong)(gong)(gong)為重(zhong)點,督促企業(ye)(ye)落實(shi)同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬,成為我(wo)省(sheng)推進相(xiang)(xiang)關改(gai)革的(de)又一(yi)重(zhong)要(yao)舉措。
以(yi)中國銀(yin)行(xing)(xing)山東(dong)省分(fen)行(xing)(xing)為例(li),到2013年末,該行(xing)(xing)仍有(you)近(jin)3000名派(pai)遣(qian)員(yuan)(yuan)(yuan)工(gong)(gong),占全行(xing)(xing)員(yuan)(yuan)(yuan)工(gong)(gong)總數的(de)17.09%。在(zai)這(zhe)些派(pai)遣(qian)員(yuan)(yuan)(yuan)工(gong)(gong)中,有(you)90%左右都在(zai)各個(ge)營業網點工(gong)(gong)作,是(shi)銀(yin)行(xing)(xing)基層(ceng)隊伍(wu)的(de)重要組成部分(fen),可由于受到“勞務(wu)(wu)派(pai)遣(qian)”的(de)身份(fen)限制(zhi),他們在(zai)工(gong)(gong)資待遇方(fang)面與正(zheng)式員(yuan)(yuan)(yuan)工(gong)(gong)仍有(you)一定(ding)差距。不過,這(zhe)一現(xian)象在(zai)近(jin)兩年得到了有(you)效(xiao)改善(shan),通過制(zhi)定(ding)《中國銀(yin)行(xing)(xing)山東(dong)省分(fen)行(xing)(xing)調整(zheng)勞務(wu)(wu)派(pai)遣(qian)用(yong)工(gong)(gong)管理(li)政(zheng)策工(gong)(gong)作方(fang)案(an)》,中行(xing)(xing)山東(dong)省分(fen)行(xing)(xing)明(ming)(ming)確了以(yi)勞動合(he)同用(yong)工(gong)(gong)作為基本用(yong)工(gong)(gong)形式,2014年以(yi)來,全轄2960名派(pai)遣(qian)員(yuan)(yuan)(yuan)工(gong)(gong)已全部轉(zhuan)換為合(he)同制(zhi)員(yuan)(yuan)(yuan)工(gong)(gong),整(zheng)個(ge)轉(zhuan)換過程(cheng)公開透明(ming)(ming),有(you)效(xiao)保障了員(yuan)(yuan)(yuan)工(gong)(gong)利益。
記者從省人社廳了(le)解到(dao),為(wei)促進勞(lao)動者短期就業(ye)(ye),從源頭上解決(jue)和減少同工同酬(chou)問題,山東在完善(shan)用工機制、規范勞(lao)務(wu)派(pai)遣(qian)方面(mian)采取了(le)一(yi)系列(lie)措施。一(yi)方面(mian)嚴格(ge)執行(xing)人力(li)資源社會(hui)保障部《勞(lao)務(wu)派(pai)遣(qian)行(xing)政許(xu)可(ke)實(shi)施辦法》,自(zi)2013年7月1日起,對新設立的勞(lao)務(wu)派(pai)遣(qian)單(dan)(dan)位(wei)經營(ying)(ying)勞(lao)務(wu)派(pai)遣(qian)業(ye)(ye)務(wu)實(shi)行(xing)行(xing)政許(xu)可(ke);對已經經營(ying)(ying)勞(lao)務(wu)派(pai)遣(qian)業(ye)(ye)務(wu)的勞(lao)務(wu)派(pai)遣(qian)單(dan)(dan)位(wei),要求(qiu)其在一(yi)年內取得經營(ying)(ying)勞(lao)務(wu)派(pai)遣(qian)業(ye)(ye)務(wu)的行(xing)政許(xu)可(ke);自(zi)2014年7月1日起,未取得行(xing)政許(xu)可(ke)的,任何單(dan)(dan)位(wei)和個人不得經營(ying)(ying)勞(lao)務(wu)派(pai)遣(qian)業(ye)(ye)務(wu)。截至目前,全省已對1067戶派(pai)遣(qian)單(dan)(dan)位(wei)實(shi)施許(xu)可(ke)。
另一方(fang)面則是(shi)從(cong)嚴(yan)控(kong)制(zhi)用工企(qi)(qi)業(ye)(ye)使(shi)用派(pai)(pai)遣制(zhi)員(yuan)工的比(bi)(bi)例(li)。以獨立法(fa)人單位(wei)的所有職工為基數進(jin)行核算,從(cong)使(shi)用勞務派(pai)(pai)遣工的比(bi)(bi)例(li)上(shang)進(jin)行限制(zhi)。對超(chao)過規定比(bi)(bi)例(li)使(shi)用勞務派(pai)(pai)遣工的用工單位(wei),依照法(fa)律(lv)規定每(mei)超(chao)過1人處以5000元以上(shang)20000元以下的罰(fa)款。對個別國有企(qi)(qi)業(ye)(ye)的特殊情況,采取企(qi)(qi)業(ye)(ye)申請(qing)、報(bao)人力資源社會(hui)保障行政(zheng)部(bu)門備案的辦法(fa),在規定時間內實現(xian)過渡(du)。
省(sheng)委省(sheng)政府(fu)帶頭落實同工同酬,編外人員月工資提高400元(yuan)。
近年來,隨(sui)著社(she)會公共服務(wu)需求的(de)(de)(de)不(bu)斷擴(kuo)大(da),一(yi)些機(ji)關(guan)(guan)事(shi)業單(dan)位(wei)(wei)(wei)使(shi)用了大(da)量的(de)(de)(de)編(bian)外人(ren)員。據省人(ren)社(she)廳勞(lao)動關(guan)(guan)系處相關(guan)(guan)負責人(ren)介紹,機(ji)關(guan)(guan)事(shi)業單(dan)位(wei)(wei)(wei)未(wei)納入正式(shi)職工管理(li)人(ren)員主要有三(san)種(zhong)形(xing)式(shi):單(dan)位(wei)(wei)(wei)直接簽訂勞(lao)動合同人(ren)員、單(dan)位(wei)(wei)(wei)使(shi)用的(de)(de)(de)勞(lao)務(wu)派遣人(ren)員、單(dan)位(wei)(wei)(wei)按照機(ji)關(guan)(guan)事(shi)業單(dan)位(wei)(wei)(wei)人(ren)員管理(li)方式(shi)聘用的(de)(de)(de)人(ren)員。他們(men)中的(de)(de)(de)不(bu)少人(ren)做著跟“編(bian)制內”人(ren)員差不(bu)多(duo)的(de)(de)(de)工作,可獲得的(de)(de)(de)報酬卻(que)有不(bu)小差距。
如今,編(bian)制內外(wai)看似“鐵(tie)板一塊”的(de)待遇差距正在(zai)逐步縮小。全國(guo)人(ren)大關于修改勞動合(he)同法(fa)的(de)決定公(gong)布后(hou),山東加強對(dui)用工(gong)(gong)(gong)單位(wei)(wei)的(de)執(zhi)法(fa)檢(jian)查,召開了(le)機(ji)(ji)(ji)關事(shi)業(ye)(ye)單位(wei)(wei)推進同工(gong)(gong)(gong)同酬(chou)工(gong)(gong)(gong)作(zuo)座談會,結合(he)全省機(ji)(ji)(ji)關事(shi)業(ye)(ye)單位(wei)(wei)“吃空餉(xiang)”專項整治(zhi)工(gong)(gong)(gong)作(zuo),妥善處理機(ji)(ji)(ji)關事(shi)業(ye)(ye)單位(wei)(wei)歷史形(xing)成的(de)編(bian)制外(wai)人(ren)員問題,積(ji)極推進機(ji)(ji)(ji)關事(shi)業(ye)(ye)單位(wei)(wei)同工(gong)(gong)(gong)同酬(chou)。據(ju)了(le)解(jie),2014年12月1日(ri)起,省委(wei)、省人(ren)大、省政府、省政協(xie)辦公(gong)廳將編(bian)外(wai)人(ren)員中的(de)汽車司(si)機(ji)(ji)(ji)、廚師、水電維修工(gong)(gong)(gong)等技(ji)能崗位(wei)(wei)和(he)(he)其他(ta)崗位(wei)(wei)人(ren)員的(de)月工(gong)(gong)(gong)資(zi)(zi)(zi)提高達2100元(yuan)和(he)(he)2000元(yuan),較(jiao)之(zhi)前分別提高400元(yuan)和(he)(he)300元(yuan),工(gong)(gong)(gong)資(zi)(zi)(zi)水平超過了(le)濟(ji)南市(shi)同類(lei)職(zhi)業(ye)(ye)人(ren)員工(gong)(gong)(gong)資(zi)(zi)(zi)指導價位(wei)(wei)低(di)位(wei)(wei)數。
記(ji)者從省人(ren)(ren)(ren)社(she)廳了解到,截(jie)至2014年(nian)底,全省多數(shu)省直機(ji)關(guan)事業單位(wei)已經按(an)照要(yao)求對編外(wai)人(ren)(ren)(ren)員管理進行了規(gui)范(fan),一部分單位(wei)將“臨時人(ren)(ren)(ren)員”改為規(gui)范(fan)的勞(lao)務派遣(qian)用(yong)工(gong),一部分單位(wei)改為直接簽訂勞(lao)動合同(tong),按(an)照社(she)會保險法規(gui)定參(can)加社(she)會保險,工(gong)資水平也有了一定程度(du)提高,部分編外(wai)人(ren)(ren)(ren)員的工(gong)資收入(ru)已經達(da)到或接近同(tong)崗位(wei)、同(tong)等(deng)資歷(li)人(ren)(ren)(ren)員的收入(ru)水平。
2015年3月,山(shan)東省在深(shen)入調(diao)研基礎(chu)上(shang),以保障(zhang)勞動(dong)者合法權(quan)益為切入點,出臺了《關(guan)于維(wei)護(hu)機(ji)關(guan)事(shi)業(ye)單(dan)(dan)位(wei)未(wei)納入正(zheng)(zheng)(zheng)式(shi)(shi)職(zhi)(zhi)工(gong)(gong)管(guan)(guan)理人(ren)員(yuan)(yuan)勞動(dong)保障(zhang)權(quan)益的(de)(de)通(tong)知》:明(ming)確了機(ji)關(guan)事(shi)業(ye)單(dan)(dan)位(wei)未(wei)納入正(zheng)(zheng)(zheng)式(shi)(shi)職(zhi)(zhi)工(gong)(gong)管(guan)(guan)理的(de)(de)人(ren)員(yuan)(yuan)的(de)(de)管(guan)(guan)理方式(shi)(shi);規定了機(ji)關(guan)事(shi)業(ye)單(dan)(dan)位(wei)使用未(wei)納入正(zheng)(zheng)(zheng)式(shi)(shi)職(zhi)(zhi)工(gong)(gong)管(guan)(guan)理的(de)(de)人(ren)員(yuan)(yuan),應(ying)當為其繳納相應(ying)的(de)(de)“五險(xian)一金”;明(ming)確要求機(ji)關(guan)事(shi)業(ye)單(dan)(dan)位(wei)要制定符合同工(gong)(gong)同酬分配(pei)原則的(de)(de)勞動(dong)報(bao)酬分配(pei)辦法……對(dui)于多(duo)數身(shen)在機(ji)關(guan)事(shi)業(ye)單(dan)(dan)位(wei)的(de)(de)編外人(ren)員(yuan)(yuan)來(lai)說,這無(wu)疑將(jiang)帶(dai)來(lai)真正(zheng)(zheng)(zheng)的(de)(de)福音。

同(tong)(tong)(tong)工(gong)(gong)同(tong)(tong)(tong)酬是指同(tong)(tong)(tong)一個單位內同(tong)(tong)(tong)類崗位的(de)勞動者實行相(xiang)同(tong)(tong)(tong)的(de)勞動報酬分配(pei)辦法(fa),通過各種制度、措施(shi)逐步減少收入差距,是現階段落實同(tong)(tong)(tong)工(gong)(gong)同(tong)(tong)(tong)酬的(de)工(gong)(gong)作(zuo)(zuo)方向。2012年12月28日全國人大常委會決定(ding)(ding)修改(gai)《勞動合(he)同(tong)(tong)(tong)法(fa)》后,山東(dong)省(sheng)加快了《山東(dong)省(sheng)勞動合(he)同(tong)(tong)(tong)條例》的(de)修訂工(gong)(gong)作(zuo)(zuo),針對(dui)勞務派(pai)遣(qian)、同(tong)(tong)(tong)工(gong)(gong)同(tong)(tong)(tong)酬問題開(kai)展(zhan)專題調研(yan),進(jin)一步完善勞務派(pai)遣(qian)的(de)法(fa)律規定(ding)(ding)。
為便于各地準確掌握同(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)的(de)(de)(de)內(nei)涵,便于實(shi)際(ji)操作,省(sheng)人社廳召開不(bu)同(tong)(tong)(tong)(tong)類型(xing)、不(bu)同(tong)(tong)(tong)(tong)層次(ci)的(de)(de)(de)研討(tao)會,反復征求(qiu)地方(fang)主管部(bu)門、用人單(dan)(dan)(dan)位(wei)(wei)意(yi)見,并商人力資(zi)源社會保障(zhang)部(bu)同(tong)(tong)(tong)(tong)意(yi)后,形成了對同(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)進行界(jie)定的(de)(de)(de)初步意(yi)見:一是(shi)用工(gong)單(dan)(dan)(dan)位(wei)(wei)使用勞(lao)(lao)(lao)務(wu)派(pai)遣(qian)工(gong)應(ying)嚴(yan)格(ge)限定在臨(lin)時性、輔助性或者替代性工(gong)作崗(gang)(gang)位(wei)(wei)的(de)(de)(de)范圍之內(nei),不(bu)得(de)超(chao)過國(guo)家(jia)規定的(de)(de)(de)比(bi)例。二是(shi)用工(gong)單(dan)(dan)(dan)位(wei)(wei)在2012年12月28日(ri)前與勞(lao)(lao)(lao)務(wu)派(pai)遣(qian)單(dan)(dan)(dan)位(wei)(wei)簽(qian)訂的(de)(de)(de)勞(lao)(lao)(lao)務(wu)派(pai)遣(qian)協議、勞(lao)(lao)(lao)務(wu)派(pai)遣(qian)單(dan)(dan)(dan)位(wei)(wei)簽(qian)訂的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)(tong),除違背同(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)原則的(de)(de)(de)內(nei)容外,應(ying)當(dang)繼(ji)續履行至期(qi)限屆滿。三是(shi)用工(gong)單(dan)(dan)(dan)位(wei)(wei)應(ying)當(dang)按照同(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)原則,對被(bei)派(pai)遣(qian)勞(lao)(lao)(lao)動(dong)(dong)者與本單(dan)(dan)(dan)位(wei)(wei)同(tong)(tong)(tong)(tong)類崗(gang)(gang)位(wei)(wei)的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)者實(shi)行相同(tong)(tong)(tong)(tong)的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)報酬(chou)(chou)(chou)分配辦法。用工(gong)單(dan)(dan)(dan)位(wei)(wei)無同(tong)(tong)(tong)(tong)類崗(gang)(gang)位(wei)(wei)勞(lao)(lao)(lao)動(dong)(dong)者的(de)(de)(de),應(ying)當(dang)參照當(dang)地人力資(zi)源市場工(gong)資(zi)指導價位(wei)(wei),做(zuo)到(dao)同(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)。
2013年8月(yue)1日(ri)修訂的(de)《山(shan)東(dong)省勞(lao)動(dong)合同(tong)條(tiao)(tiao)例》第四十八條(tiao)(tiao)規定,細化勞(lao)務派遣關(guan)于(yu)“臨時性(xing)、輔(fu)助性(xing)、替代(dai)(dai)性(xing)”崗位(wei)的(de)規定,明(ming)確(que)“替代(dai)(dai)性(xing)工(gong)(gong)作崗位(wei)是指用工(gong)(gong)單位(wei)的(de)勞(lao)動(dong)者因(yin)脫產學(xue)習、休假等原因(yin)無法工(gong)(gong)作,一(yi)(yi)年之內可以由其他(ta)勞(lao)動(dong)者替代(dai)(dai)工(gong)(gong)作的(de)崗位(wei)”,進一(yi)(yi)步明(ming)確(que)了“替代(dai)(dai)性(xing)工(gong)(gong)作崗位(wei)”的(de)適(shi)用范圍,有效壓縮了企(qi)業大(da)規模使用勞(lao)務派遣工(gong)(gong)的(de)空間。《條(tiao)(tiao)例》還明(ming)確(que)了同(tong)工(gong)(gong)同(tong)酬的(de)實(shi)質,第五十條(tiao)(tiao)明(ming)確(que)要求,“用工(gong)(gong)單位(wei)應當保障被派遣勞(lao)動(dong)者與本單位(wei)職工(gong)(gong)享有同(tong)工(gong)(gong)同(tong)酬的(de)權利(li),實(shi)行相同(tong)的(de)勞(lao)動(dong)報(bao)酬分配辦法。”
