1月20日上(shang)午,在濟(ji)南市歷下(xia)區歷山路上(shang),環衛(wei)工人張(zhang)(zhang)大(da)姐正(zheng)在埋頭清掃馬(ma)路。張(zhang)(zhang)大(da)姐告訴(su)記者,她和老公從事環衛(wei)工作已經10年了,近幾年感覺待(dai)遇比以(yi)前好(hao)了很多(duo),她和企事業(ye)單位(wei)職工一樣,享(xiang)受老有所養、病有所醫的(de)實惠。
1月20日上午,氣溫零下6℃,歷(li)下區城(cheng)管局(ju)解(jie)放路環(huan)衛所的工作(zuo)人(ren)員為一(yi)線環(huan)衛工人(ren)劉大叔送來姜茶。“冬天太冷,容易感冒,環(huan)衛所每天給我們(men)送一(yi)杯姜茶,喝(he)了暖(nuan)和,防感冒。”從事9年環(huan)衛工作(zuo)的劉大叔笑著說。
臨時工、勞務派遣(qian)人(ren)(ren)(ren)(ren)(ren)員、編外人(ren)(ren)(ren)(ren)(ren)員……提起這些群(qun)體,人(ren)(ren)(ren)(ren)(ren)們最先想到的(de)常常是工資(zi)低(di)、福利差、工作崗位(wei)“朝不(bu)保夕”等(deng)字眼。現實生(sheng)活中,確實有這么一群(qun)人(ren)(ren)(ren)(ren)(ren),他們或是從(cong)事體力勞動養家(jia)糊口(kou),辛(xin)苦勞作一年,收入卻十分微薄;或是擠進了(le)那些令(ling)人(ren)(ren)(ren)(ren)(ren)羨慕的(de)機關事業單位(wei),可在單位(wei)內部卻始(shi)終無法享受到與“編制內”人(ren)(ren)(ren)(ren)(ren)員同等(deng)的(de)待遇。
不過,在濟南市歷(li)下(xia)區,所有“非正式”一(yi)線環衛(wei)工人不僅(jin)有單位(wei)辦(ban)理的(de)五險一(yi)金(jin),能(neng)享受(shou)月工資每(mei)年上漲100元的(de)工資待遇自(zi)然增長(chang)機制,每(mei)年還(huan)能(neng)領到過節費、取(qu)暖費、高溫(wen)補助等(deng)總計(ji)2600元左右(you)的(de)福(fu)利。用歷(li)下(xia)區環衛(wei)工老孔(kong)的(de)話來說,“待遇越(yue)來越(yue)好,跟正式工之間的(de)差距也越(yue)來越(yue)小啦。”
勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)(chou)權(quan)是勞(lao)(lao)動(dong)(dong)(dong)者的基(ji)本勞(lao)(lao)動(dong)(dong)(dong)權(quan)利(li)。《勞(lao)(lao)動(dong)(dong)(dong)法(fa)》第46條明確規定(ding)(ding):“工(gong)資分配應(ying)當遵循按(an)勞(lao)(lao)分配原(yuan)則(ze),實(shi)行同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)。”想(xiang)要真正(zheng)(zheng)將同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)落(luo)到實(shi)處,不僅要有(you)法(fa)律保(bao)(bao)障,更需要各省制定(ding)(ding)符合(he)自身情況的好政(zheng)策。近(jin)年來(lai),在(zai)作(zuo)為人(ren)(ren)口大(da)省和(he)用(yong)(yong)工(gong)大(da)省的山(shan)東(dong)(dong),“同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)不同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)”現象正(zheng)(zheng)伴(ban)隨著人(ren)(ren)社部(bu)門的改革步伐而逐漸改善。2012年以來(lai),山(shan)東(dong)(dong)大(da)力推(tui)進規范(fan)勞(lao)(lao)務派(pai)遣(qian)和(he)同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)工(gong)作(zuo),省人(ren)(ren)社廳聯合(he)有(you)關(guan)部(bu)門連續推(tui)出(chu)相關(guan)政(zheng)策文件,針對(dui)不同(tong)(tong)(tong)(tong)(tong)(tong)的用(yong)(yong)人(ren)(ren)單位和(he)不同(tong)(tong)(tong)(tong)(tong)(tong)的勞(lao)(lao)動(dong)(dong)(dong)者,分類施(shi)策,從規范(fan)企業勞(lao)(lao)務派(pai)遣(qian)用(yong)(yong)工(gong)行為、保(bao)(bao)護機(ji)關(guan)事(shi)業單位編(bian)外人(ren)(ren)員(yuan)合(he)法(fa)權(quan)益、保(bao)(bao)障農民(min)工(gong)工(gong)資支付等多(duo)個(ge)側(ce)面和(he)角(jiao)度來(lai)推(tui)進同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)落(luo)實(shi)。目前,全(quan)省企業已(yi)(yi)經基(ji)本落(luo)實(shi)同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)(chou),機(ji)關(guan)事(shi)業單位同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)工(gong)作(zuo)正(zheng)(zheng)式起步并在(zai)全(quan)國領(ling)先(xian),對(dui)于勞(lao)(lao)務派(pai)遣(qian)人(ren)(ren)員(yuan)、臨時工(gong)、編(bian)外人(ren)(ren)員(yuan)來(lai)說,同(tong)(tong)(tong)(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)已(yi)(yi)不再是個(ge)夢。
五險一金全(quan)覆(fu)蓋,濟南歷下區環衛工幸(xing)福指數直線上升。
“干了16年環衛(wei)(wei)工(gong)(gong)(gong)(gong),最(zui)近這幾年明顯感覺到待(dai)遇比以前好(hao)多(duo)啦。”50歲的(de)(de)(de)老(lao)孔(kong)是(shi)濟南市(shi)歷下(xia)區城管局解放路(lu)環衛(wei)(wei)所的(de)(de)(de)一名環衛(wei)(wei)工(gong)(gong)(gong)(gong),常年負責(ze)歷山路(lu)沿線(xian)約500米的(de)(de)(de)一段(duan)路(lu)面衛(wei)(wei)生工(gong)(gong)(gong)(gong)作(zuo)。老(lao)孔(kong)說,他所在的(de)(de)(de)環衛(wei)(wei)所有一百多(duo)人,絕大多(duo)數是(shi)在一線(xian)工(gong)(gong)(gong)(gong)作(zuo)的(de)(de)(de)環衛(wei)(wei)工(gong)(gong)(gong)(gong)人,大伙兒(er)的(de)(de)(de)一個共同特點就(jiu)是(shi)“非(fei)正式工(gong)(gong)(gong)(gong)”。以前,“非(fei)正式工(gong)(gong)(gong)(gong)”的(de)(de)(de)工(gong)(gong)(gong)(gong)資比正式員工(gong)(gong)(gong)(gong)低不少,更別(bie)提醫療、養老(lao)等方面的(de)(de)(de)保(bao)障了。
變(bian)化始(shi)于(yu)3年前。老孔告訴(su)記(ji)者,2012年起,他和(he)工(gong)(gong)友們陸(lu)續接到單位辦理五險(xian)一金(jin)的通知,“剛開始(shi)咱根本弄(nong)不清這五險(xian)一金(jin)有啥(sha)好(hao)處,后來明白了,這可是咱后半輩子的保障。”老孔笑著(zhu)說,除了五險(xian)一金(jin),每(mei)年的冬季(ji)取暖費、夏季(ji)高溫補(bu)助(zhu)、過節(jie)慰問(wen)品、每(mei)月(yue)5斤雞蛋等福利(li)一樣不少,而且不分(fen)正式(shi)工(gong)(gong)和(he)“非正式(shi)工(gong)(gong)”,每(mei)個(ge)環衛(wei)工(gong)(gong)都有。
據歷(li)下(xia)(xia)區(qu)城(cheng)市管理局相關負責人(ren)(ren)(ren)(ren)(ren)介紹,目前,歷(li)下(xia)(xia)區(qu)城(cheng)管局有16個(ge)環衛(wei)(wei)(wei)所(suo),每(mei)(mei)個(ge)所(suo)有一(yi)(yi)百多名員工(gong)(gong),絕大(da)多數(shu)都(dou)是(shi)勞(lao)務(wu)派遣人(ren)(ren)(ren)(ren)(ren)員,光是(shi)一(yi)(yi)線環衛(wei)(wei)(wei)工(gong)(gong)加起(qi)來就(jiu)將近2000人(ren)(ren)(ren)(ren)(ren)。2012年(nian)3月,區(qu)里開始為(wei)一(yi)(yi)線環衛(wei)(wei)(wei)工(gong)(gong)人(ren)(ren)(ren)(ren)(ren)辦理五(wu)險一(yi)(yi)金,并對超(chao)齡人(ren)(ren)(ren)(ren)(ren)員設置(zhi)專人(ren)(ren)(ren)(ren)(ren)專項(xiang)賬戶,向不符合(he)入保條件(jian)的一(yi)(yi)線環衛(wei)(wei)(wei)工(gong)(gong)人(ren)(ren)(ren)(ren)(ren)發放(fang)補貼(tie);為(wei)環衛(wei)(wei)(wei)工(gong)(gong)人(ren)(ren)(ren)(ren)(ren)建立工(gong)(gong)資待遇自然增長機制,每(mei)(mei)年(nian)為(wei)一(yi)(yi)線環衛(wei)(wei)(wei)工(gong)(gong)人(ren)(ren)(ren)(ren)(ren)每(mei)(mei)人(ren)(ren)(ren)(ren)(ren)每(mei)(mei)月增長工(gong)(gong)資100元(yuan);提(ti)供免(mian)費的環衛(wei)(wei)(wei)工(gong)(gong)公寓,并對暫無住房(fang)(fang)的外(wai)來環衛(wei)(wei)(wei)工(gong)(gong)人(ren)(ren)(ren)(ren)(ren)提(ti)供住房(fang)(fang)補貼(tie)等。經過3年(nian)多的不懈努(nu)力,如今,歷(li)下(xia)(xia)區(qu)環衛(wei)(wei)(wei)工(gong)(gong)人(ren)(ren)(ren)(ren)(ren)平均(jun)月工(gong)(gong)資達到2000余元(yuan),高于最低工(gong)(gong)資標準25%,此外(wai),每(mei)(mei)人(ren)(ren)(ren)(ren)(ren)每(mei)(mei)年(nian)可領到2600元(yuan)左右(you)的各項(xiang)福利(li)補貼(tie)。吃飯住房(fang)(fang)不用發愁,工(gong)(gong)資福利(li)年(nian)年(nian)上(shang)漲,生病退(tui)休有了(le)保障,全區(qu)環衛(wei)(wei)(wei)工(gong)(gong)人(ren)(ren)(ren)(ren)(ren)再也不用為(wei)了(le)“非(fei)正式工(gong)(gong)”的身(shen)份發愁,幸福指數(shu)直線上(shang)升(sheng)。
督促企業落(luo)實同工(gong)同酬,中行(xing)2960名(ming)派遣員工(gong)完成身份轉換。
勞務派(pai)遣(qian)用(yong)(yong)(yong)工(gong)是企(qi)業合同(tong)制用(yong)(yong)(yong)工(gong)的(de)補(bu)充(chong)形式(shi),目的(de)是解決企(qi)業臨時(shi)性用(yong)(yong)(yong)工(gong)和(he)勞動者短期就(jiu)業的(de)問題。但在實(shi)踐中(zhong),這一補(bu)充(chong)性用(yong)(yong)(yong)工(gong)制度被一些(xie)單(dan)位(wei)(wei)濫用(yong)(yong)(yong):一些(xie)用(yong)(yong)(yong)工(gong)單(dan)位(wei)(wei)在同(tong)一工(gong)作(zuo)(zuo)崗(gang)位(wei)(wei)混崗(gang)使用(yong)(yong)(yong)派(pai)遣(qian)制員工(gong)和(he)本單(dan)位(wei)(wei)職(zhi)工(gong),實(shi)行不同(tong)的(de)勞動報(bao)酬(chou)(chou)分配制度和(he)辦法,派(pai)遣(qian)制員工(gong)相(xiang)(xiang)對于用(yong)(yong)(yong)工(gong)單(dan)位(wei)(wei)職(zhi)工(gong)勞動報(bao)酬(chou)(chou)明(ming)顯偏(pian)低,有的(de)只相(xiang)(xiang)當于用(yong)(yong)(yong)工(gong)單(dan)位(wei)(wei)合同(tong)制職(zhi)工(gong)的(de)50%左右,直接影響了勞務派(pai)遣(qian)職(zhi)工(gong)的(de)工(gong)作(zuo)(zuo)熱情和(he)歸屬感(gan)。以(yi)規范(fan)勞務派(pai)遣(qian)用(yong)(yong)(yong)工(gong)為(wei)重點,督促企(qi)業落實(shi)同(tong)工(gong)同(tong)酬(chou)(chou),成(cheng)為(wei)我省(sheng)推進相(xiang)(xiang)關改革的(de)又一重要舉措。
以(yi)中(zhong)(zhong)國(guo)(guo)銀(yin)行(xing)(xing)山東(dong)省分行(xing)(xing)為(wei)(wei)例,到2013年(nian)末,該行(xing)(xing)仍(reng)有(you)近(jin)3000名(ming)派(pai)(pai)(pai)遣員(yuan)工(gong),占全行(xing)(xing)員(yuan)工(gong)總數的17.09%。在(zai)這(zhe)些(xie)派(pai)(pai)(pai)遣員(yuan)工(gong)中(zhong)(zhong),有(you)90%左右都在(zai)各個營業(ye)網點工(gong)作(zuo),是銀(yin)行(xing)(xing)基層(ceng)隊伍的重要(yao)組成部(bu)分,可由于受到“勞務派(pai)(pai)(pai)遣”的身份限制,他們在(zai)工(gong)資(zi)待(dai)遇方面與正式員(yuan)工(gong)仍(reng)有(you)一定(ding)差距。不過(guo)(guo)(guo),這(zhe)一現象在(zai)近(jin)兩年(nian)得到了有(you)效(xiao)改善,通過(guo)(guo)(guo)制定(ding)《中(zhong)(zhong)國(guo)(guo)銀(yin)行(xing)(xing)山東(dong)省分行(xing)(xing)調(diao)整(zheng)勞務派(pai)(pai)(pai)遣用工(gong)管理政策工(gong)作(zuo)方案》,中(zhong)(zhong)行(xing)(xing)山東(dong)省分行(xing)(xing)明確(que)了以(yi)勞動合同(tong)用工(gong)作(zuo)為(wei)(wei)基本(ben)用工(gong)形式,2014年(nian)以(yi)來,全轄2960名(ming)派(pai)(pai)(pai)遣員(yuan)工(gong)已全部(bu)轉換(huan)為(wei)(wei)合同(tong)制員(yuan)工(gong),整(zheng)個轉換(huan)過(guo)(guo)(guo)程(cheng)公開透明,有(you)效(xiao)保障了員(yuan)工(gong)利益。
記者從(cong)(cong)省(sheng)(sheng)人(ren)(ren)社廳了(le)解到,為促進勞(lao)(lao)(lao)(lao)動者短(duan)期就(jiu)業(ye)(ye),從(cong)(cong)源頭上解決(jue)和(he)減少(shao)同工(gong)同酬問題(ti),山(shan)東(dong)在完善用工(gong)機(ji)制(zhi)、規(gui)范勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)方面(mian)采取了(le)一系列(lie)措施(shi)。一方面(mian)嚴(yan)格(ge)執行(xing)人(ren)(ren)力(li)資(zi)源社會保障部(bu)《勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)行(xing)政(zheng)許可實(shi)(shi)施(shi)辦法》,自(zi)2013年7月(yue)(yue)1日(ri)起(qi),對(dui)新設(she)立的(de)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)單位(wei)經營(ying)(ying)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)業(ye)(ye)務(wu)(wu)(wu)(wu)實(shi)(shi)行(xing)行(xing)政(zheng)許可;對(dui)已經經營(ying)(ying)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)業(ye)(ye)務(wu)(wu)(wu)(wu)的(de)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)單位(wei),要求(qiu)其在一年內取得(de)經營(ying)(ying)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)業(ye)(ye)務(wu)(wu)(wu)(wu)的(de)行(xing)政(zheng)許可;自(zi)2014年7月(yue)(yue)1日(ri)起(qi),未取得(de)行(xing)政(zheng)許可的(de),任何單位(wei)和(he)個人(ren)(ren)不得(de)經營(ying)(ying)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)(wu)派(pai)(pai)遣(qian)業(ye)(ye)務(wu)(wu)(wu)(wu)。截至目(mu)前,全省(sheng)(sheng)已對(dui)1067戶派(pai)(pai)遣(qian)單位(wei)實(shi)(shi)施(shi)許可。
另一(yi)方面則是(shi)從嚴控制用(yong)(yong)工(gong)(gong)企(qi)業(ye)(ye)使用(yong)(yong)派遣制員(yuan)工(gong)(gong)的(de)比(bi)例(li)。以(yi)獨(du)立法人單(dan)位(wei)的(de)所有(you)職工(gong)(gong)為基數進行(xing)核(he)算,從使用(yong)(yong)勞務(wu)派遣工(gong)(gong)的(de)比(bi)例(li)上(shang)進行(xing)限制。對超過(guo)規(gui)定(ding)比(bi)例(li)使用(yong)(yong)勞務(wu)派遣工(gong)(gong)的(de)用(yong)(yong)工(gong)(gong)單(dan)位(wei),依照法律規(gui)定(ding)每(mei)超過(guo)1人處以(yi)5000元以(yi)上(shang)20000元以(yi)下的(de)罰款。對個(ge)別國有(you)企(qi)業(ye)(ye)的(de)特(te)殊情況,采(cai)取企(qi)業(ye)(ye)申請、報人力資源社(she)會保障行(xing)政部門備案的(de)辦法,在(zai)規(gui)定(ding)時間內實(shi)現過(guo)渡。
省(sheng)委省(sheng)政(zheng)府帶頭落實同工同酬,編外人員月工資提高400元(yuan)。
近年來,隨著社會公(gong)共服務需求的不斷(duan)擴大(da),一些機(ji)關事(shi)業(ye)單位(wei)(wei)使用了大(da)量的編外人員(yuan)。據省人社廳(ting)勞(lao)動關系處(chu)相關負(fu)責人介紹,機(ji)關事(shi)業(ye)單位(wei)(wei)未納(na)入(ru)正式職(zhi)工(gong)管理人員(yuan)主要有三(san)種形式:單位(wei)(wei)直接簽訂勞(lao)動合同(tong)人員(yuan)、單位(wei)(wei)使用的勞(lao)務派遣人員(yuan)、單位(wei)(wei)按照機(ji)關事(shi)業(ye)單位(wei)(wei)人員(yuan)管理方式聘用的人員(yuan)。他們中(zhong)的不少人做著跟“編制(zhi)內”人員(yuan)差(cha)不多的工(gong)作,可獲得的報酬卻有不小差(cha)距。
如今,編(bian)制內外看似“鐵(tie)板(ban)一塊”的(de)(de)待遇差距正(zheng)在(zai)逐步(bu)縮小(xiao)。全國人(ren)大關(guan)于修(xiu)改勞動合同法(fa)的(de)(de)決定公布(bu)后,山東加強對用工(gong)單位(wei)(wei)的(de)(de)執法(fa)檢查,召開了機(ji)關(guan)事業(ye)單位(wei)(wei)推(tui)進同工(gong)同酬(chou)工(gong)作座談會,結合全省(sheng)機(ji)關(guan)事業(ye)單位(wei)(wei)“吃空(kong)餉”專項(xiang)整治工(gong)作,妥善處理機(ji)關(guan)事業(ye)單位(wei)(wei)歷史(shi)形成的(de)(de)編(bian)制外人(ren)員(yuan)(yuan)(yuan)問題,積極推(tui)進機(ji)關(guan)事業(ye)單位(wei)(wei)同工(gong)同酬(chou)。據了解,2014年(nian)12月(yue)1日(ri)起,省(sheng)委、省(sheng)人(ren)大、省(sheng)政府、省(sheng)政協辦公廳將編(bian)外人(ren)員(yuan)(yuan)(yuan)中的(de)(de)汽(qi)車司機(ji)、廚師、水(shui)電維(wei)修(xiu)工(gong)等技能(neng)崗位(wei)(wei)和(he)其(qi)他崗位(wei)(wei)人(ren)員(yuan)(yuan)(yuan)的(de)(de)月(yue)工(gong)資提高達2100元(yuan)和(he)2000元(yuan),較(jiao)之前分別(bie)提高400元(yuan)和(he)300元(yuan),工(gong)資水(shui)平超過了濟(ji)南市同類職業(ye)人(ren)員(yuan)(yuan)(yuan)工(gong)資指(zhi)導價位(wei)(wei)低位(wei)(wei)數(shu)。
記者(zhe)從省人(ren)社(she)廳了解(jie)到,截至2014年底,全省多數省直機關事業單(dan)位(wei)已經按照(zhao)要求對編外(wai)人(ren)員(yuan)管理進行(xing)了規(gui)(gui)范(fan),一(yi)部分單(dan)位(wei)將“臨時人(ren)員(yuan)”改為規(gui)(gui)范(fan)的勞務派遣用工(gong),一(yi)部分單(dan)位(wei)改為直接(jie)簽訂勞動合同,按照(zhao)社(she)會(hui)保(bao)險法規(gui)(gui)定參加(jia)社(she)會(hui)保(bao)險,工(gong)資水平也有(you)了一(yi)定程(cheng)度提高(gao),部分編外(wai)人(ren)員(yuan)的工(gong)資收入已經達到或接(jie)近同崗位(wei)、同等(deng)資歷人(ren)員(yuan)的收入水平。
2015年3月(yue),山東省在(zai)深入(ru)調研基(ji)礎上,以保障勞動(dong)者合法權(quan)益為(wei)切入(ru)點,出臺了(le)《關(guan)于(yu)維護機(ji)(ji)關(guan)事(shi)業(ye)單位未納(na)入(ru)正(zheng)式職工管(guan)理(li)人員勞動(dong)保障權(quan)益的(de)通知》:明確(que)(que)了(le)機(ji)(ji)關(guan)事(shi)業(ye)單位未納(na)入(ru)正(zheng)式職工管(guan)理(li)的(de)人員的(de)管(guan)理(li)方式;規(gui)定(ding)了(le)機(ji)(ji)關(guan)事(shi)業(ye)單位使用未納(na)入(ru)正(zheng)式職工管(guan)理(li)的(de)人員,應(ying)當為(wei)其繳納(na)相應(ying)的(de)“五險(xian)一金”;明確(que)(que)要(yao)求機(ji)(ji)關(guan)事(shi)業(ye)單位要(yao)制定(ding)符合同工同酬分配原則的(de)勞動(dong)報(bao)酬分配辦(ban)法……對(dui)于(yu)多數身(shen)在(zai)機(ji)(ji)關(guan)事(shi)業(ye)單位的(de)編外人員來說,這無疑將(jiang)帶(dai)來真正(zheng)的(de)福音。

同(tong)(tong)工(gong)同(tong)(tong)酬是指同(tong)(tong)一個單位(wei)內同(tong)(tong)類崗位(wei)的(de)勞(lao)動者實(shi)行(xing)相同(tong)(tong)的(de)勞(lao)動報酬分配辦(ban)法,通過各種制度、措施逐(zhu)步減少收(shou)入(ru)差距,是現階段落實(shi)同(tong)(tong)工(gong)同(tong)(tong)酬的(de)工(gong)作(zuo)方向。2012年12月28日全國人(ren)大常委會決定(ding)修(xiu)改《勞(lao)動合同(tong)(tong)法》后,山東省加(jia)快了《山東省勞(lao)動合同(tong)(tong)條例》的(de)修(xiu)訂工(gong)作(zuo),針對(dui)勞(lao)務派遣、同(tong)(tong)工(gong)同(tong)(tong)酬問題開展專題調研,進一步完(wan)善勞(lao)務派遣的(de)法律規定(ding)。
為便(bian)于(yu)各(ge)地(di)準(zhun)確掌握同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)的(de)(de)(de)內涵,便(bian)于(yu)實際操作,省人社廳召開不同(tong)(tong)(tong)類型(xing)、不同(tong)(tong)(tong)層次的(de)(de)(de)研討會,反復征求地(di)方(fang)主管部門(men)、用(yong)(yong)(yong)人單(dan)位(wei)(wei)(wei)意(yi)見,并商人力(li)資源社會保障部同(tong)(tong)(tong)意(yi)后,形成了對同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)進行(xing)(xing)界定(ding)的(de)(de)(de)初步(bu)意(yi)見:一是(shi)用(yong)(yong)(yong)工(gong)單(dan)位(wei)(wei)(wei)使用(yong)(yong)(yong)勞(lao)(lao)務(wu)派遣工(gong)應(ying)嚴格(ge)限(xian)定(ding)在臨(lin)時性、輔助性或(huo)者(zhe)替(ti)代性工(gong)作崗位(wei)(wei)(wei)的(de)(de)(de)范圍之內,不得超過國家規定(ding)的(de)(de)(de)比例。二是(shi)用(yong)(yong)(yong)工(gong)單(dan)位(wei)(wei)(wei)在2012年12月28日前(qian)與勞(lao)(lao)務(wu)派遣單(dan)位(wei)(wei)(wei)簽(qian)(qian)訂的(de)(de)(de)勞(lao)(lao)務(wu)派遣協議、勞(lao)(lao)務(wu)派遣單(dan)位(wei)(wei)(wei)簽(qian)(qian)訂的(de)(de)(de)勞(lao)(lao)動(dong)合同(tong)(tong)(tong),除違背同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)原(yuan)則的(de)(de)(de)內容外,應(ying)當繼(ji)續(xu)履行(xing)(xing)至期限(xian)屆(jie)滿。三是(shi)用(yong)(yong)(yong)工(gong)單(dan)位(wei)(wei)(wei)應(ying)當按照同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)原(yuan)則,對被派遣勞(lao)(lao)動(dong)者(zhe)與本單(dan)位(wei)(wei)(wei)同(tong)(tong)(tong)類崗位(wei)(wei)(wei)的(de)(de)(de)勞(lao)(lao)動(dong)者(zhe)實行(xing)(xing)相同(tong)(tong)(tong)的(de)(de)(de)勞(lao)(lao)動(dong)報酬(chou)(chou)分配辦法。用(yong)(yong)(yong)工(gong)單(dan)位(wei)(wei)(wei)無同(tong)(tong)(tong)類崗位(wei)(wei)(wei)勞(lao)(lao)動(dong)者(zhe)的(de)(de)(de),應(ying)當參照當地(di)人力(li)資源市場工(gong)資指導(dao)價(jia)位(wei)(wei)(wei),做(zuo)到同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)(chou)。
2013年(nian)8月1日修訂的(de)(de)《山(shan)東省勞(lao)動合同條(tiao)例(li)》第四十(shi)八(ba)條(tiao)規定,細化勞(lao)務派遣(qian)關(guan)于“臨(lin)時(shi)性(xing)、輔助性(xing)、替代性(xing)”崗(gang)位(wei)的(de)(de)規定,明確“替代性(xing)工(gong)(gong)作(zuo)崗(gang)位(wei)是(shi)指用(yong)工(gong)(gong)單位(wei)的(de)(de)勞(lao)動者(zhe)因脫產學習(xi)、休假等原因無法(fa)工(gong)(gong)作(zuo),一(yi)(yi)年(nian)之內可以由其(qi)他勞(lao)動者(zhe)替代工(gong)(gong)作(zuo)的(de)(de)崗(gang)位(wei)”,進一(yi)(yi)步(bu)明確了“替代性(xing)工(gong)(gong)作(zuo)崗(gang)位(wei)”的(de)(de)適(shi)用(yong)范圍,有(you)效壓(ya)縮(suo)了企業大規模使(shi)用(yong)勞(lao)務派遣(qian)工(gong)(gong)的(de)(de)空(kong)間。《條(tiao)例(li)》還明確了同工(gong)(gong)同酬(chou)(chou)的(de)(de)實質,第五十(shi)條(tiao)明確要求,“用(yong)工(gong)(gong)單位(wei)應當保障被派遣(qian)勞(lao)動者(zhe)與本單位(wei)職工(gong)(gong)享有(you)同工(gong)(gong)同酬(chou)(chou)的(de)(de)權利,實行相同的(de)(de)勞(lao)動報(bao)酬(chou)(chou)分配辦(ban)法(fa)。”
