山東青島醫療期管理規定3月起實施 明確病假工資

日前,山東省(sheng)青島市人社局發(fa)布勞(lao)動者(zhe)患病或者(zhe)非因工負傷醫療(liao)期(qi)管理規(gui)定(以下簡(jian)稱《醫療(liao)期(qi)規(gui)定》),擴大了醫療(liao)期(qi)適用范(fan)圍,明確了醫療(liao)期(qi)期(qi)限及累(lei)計計算辦法等問題(ti),進(jin)一步(bu)規(gui)范(fan)青島市醫療(liao)期(qi)管理,維護勞(lao)動者(zhe)和用人單位合法權益。據悉,該(gai)規(gui)定將于3月1日起正式施行,

擴大了醫療期適用范圍

原勞(lao)動部的醫療期規定僅適用于企(qi)業職工(gong)。2008年(nian)勞(lao)動合(he)同法(fa)頒(ban)布(bu)實(shi)施(shi)后,用人單(dan)位(wei)的范圍進(jin)一步擴大,除企(qi)業外,一些民辦非企(qi)業單(dan)位(wei)、合(he)伙組(zu)織等,其勞(lao)動者也應(ying)當享有醫療期的相關權(quan)利。

為此,《醫療(liao)期規定》對用人(ren)單(dan)(dan)位(wei)范(fan)圍進行了適度(du)擴(kuo)大(da),除企業外,其他(ta)勞動關系主體,如民辦非企業單(dan)(dan)位(wei)、會計師事務所、律師事務所、基金(jin)會等組(zu)織也納(na)入適用范(fan)圍,以更加契(qi)合勞動合同法及用人(ren)單(dan)(dan)位(wei)的(de)實際(ji)需求。

明確醫療期期限及累計計算辦法

《醫療(liao)期規定》延續相關規定,醫療(liao)期根據勞動者本(ben)(ben)人(ren)實際工(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)(xian)和(he)在本(ben)(ben)單位(wei)工(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)(xian)確(que)定,其中(zhong),實際工(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)(xian)十(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de),在本(ben)(ben)單位(wei)工(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)(xian)五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)為三個(ge)月(yue);五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de)為六個(ge)月(yue);實際工(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)(xian)十(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de),在本(ben)(ben)單位(wei)工(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)(xian)五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)為六個(ge)月(yue);五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)十(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)為九個(ge)月(yue);十(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)十(shi)(shi)五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)為十(shi)(shi)二個(ge)月(yue);十(shi)(shi)五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)二十(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)為十(shi)(shi)八個(ge)月(yue);二十(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de)為二十(shi)(shi)四個(ge)月(yue)。《醫療(liao)期規定》還規定,集體(ti)合(he)同(tong)(tong)、勞動合(he)同(tong)(tong)、用人(ren)單位(wei)的(de)(de)規章制(zhi)度等約定醫療(liao)期長于規定醫療(liao)期的(de)(de),從其約定。

同時(shi),《醫(yi)療(liao)(liao)(liao)期(qi)規(gui)定》對醫(yi)療(liao)(liao)(liao)期(qi)的(de)(de)累計(ji)(ji)計(ji)(ji)算(suan)(suan)方法作出規(gui)定,醫(yi)療(liao)(liao)(liao)期(qi)三(san)個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按六個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)(nei)累計(ji)(ji)病(bing)(bing)休時(shi)間(jian)(jian)(jian)計(ji)(ji)算(suan)(suan);六個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按十(shi)(shi)(shi)二個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)(nei)累計(ji)(ji)病(bing)(bing)休時(shi)間(jian)(jian)(jian)計(ji)(ji)算(suan)(suan);九(jiu)個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按十(shi)(shi)(shi)五個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)(nei)累計(ji)(ji)病(bing)(bing)休時(shi)間(jian)(jian)(jian)計(ji)(ji)算(suan)(suan);十(shi)(shi)(shi)二個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按十(shi)(shi)(shi)八個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)(nei)累計(ji)(ji)病(bing)(bing)休時(shi)間(jian)(jian)(jian)計(ji)(ji)算(suan)(suan);十(shi)(shi)(shi)八個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按二十(shi)(shi)(shi)四(si)個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)(nei)累計(ji)(ji)病(bing)(bing)休時(shi)間(jian)(jian)(jian)計(ji)(ji)算(suan)(suan);二十(shi)(shi)(shi)四(si)個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按三(san)十(shi)(shi)(shi)個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)(nei)累計(ji)(ji)病(bing)(bing)休時(shi)間(jian)(jian)(jian)計(ji)(ji)算(suan)(suan)。醫(yi)療(liao)(liao)(liao)期(qi)的(de)(de)計(ji)(ji)算(suan)(suan)從(cong)勞動者停工(gong)治(zhi)療(liao)(liao)(liao)第(di)一天起累計(ji)(ji),期(qi)間(jian)(jian)(jian)公休假日(ri)(ri)、法定節假日(ri)(ri)包括在(zai)內(nei)(nei)。確定勞動者醫(yi)療(liao)(liao)(liao)期(qi)期(qi)限(xian)、累計(ji)(ji)病(bing)(bing)休時(shi)間(jian)(jian)(jian)的(de)(de)工(gong)作年(nian)限(xian),以(yi)其停工(gong)治(zhi)療(liao)(liao)(liao)前一日(ri)(ri)的(de)(de)實際工(gong)作年(nian)限(xian)和在(zai)本單(dan)位(wei)工(gong)作年(nian)限(xian)為準。

對醫療期內的工資待遇作出規定

《醫療期(qi)規定》規定,勞動者(zhe)患(huan)病(bing)(bing)或者(zhe)非(fei)因(yin)工負傷停止工作治療休息,用人(ren)單位應當(dang)按照以(yi)下(xia)標(biao)準支付(fu)病(bing)(bing)假工資或者(zhe)疾病(bing)(bing)救(jiu)濟費。

醫療(liao)期內,停工(gong)(gong)(gong)醫療(liao)累(lei)計不超過(guo)六(liu)個(ge)月(yue)(yue)的(de),發(fa)給本人(ren)(ren)(ren)工(gong)(gong)(gong)資(zi)百(bai)分(fen)(fen)(fen)之(zhi)七十的(de)病(bing)假工(gong)(gong)(gong)資(zi);醫療(liao)期內,停工(gong)(gong)(gong)醫療(liao)累(lei)計超過(guo)六(liu)個(ge)月(yue)(yue)的(de),發(fa)給本人(ren)(ren)(ren)工(gong)(gong)(gong)資(zi)百(bai)分(fen)(fen)(fen)之(zhi)六(liu)十的(de)疾病(bing)救濟(ji)費。病(bing)假工(gong)(gong)(gong)資(zi)和疾病(bing)救濟(ji)費最(zui)低不得(de)低于當地最(zui)低工(gong)(gong)(gong)資(zi)標(biao)準的(de)百(bai)分(fen)(fen)(fen)之(zhi)八(ba)十,最(zui)高不超過(guo)用人(ren)(ren)(ren)單位上年度勞(lao)動者(zhe)月(yue)(yue)平均工(gong)(gong)(gong)資(zi)。本人(ren)(ren)(ren)工(gong)(gong)(gong)資(zi),是(shi)指勞(lao)動者(zhe)本人(ren)(ren)(ren)患病(bing)前(qian)十二個(ge)月(yue)(yue)的(de)月(yue)(yue)平均工(gong)(gong)(gong)資(zi)。勞(lao)動者(zhe)工(gong)(gong)(gong)作不滿(man)十二個(ge)月(yue)(yue)的(de),按(an)實際工(gong)(gong)(gong)作月(yue)(yue)數的(de)月(yue)(yue)平均工(gong)(gong)(gong)資(zi)計算。

對醫療期滿勞動關系處理問題作出規定

《醫療(liao)(liao)(liao)期(qi)規定》梳(shu)理(li)(li)了醫療(liao)(liao)(liao)期(qi)滿(man)用人(ren)(ren)單(dan)(dan)位(wei)處理(li)(li)勞(lao)動(dong)關系的(de)(de)(de)(de)各種情形,第一(yi)種情形,勞(lao)動(dong)者(zhe)患(huan)病或者(zhe)非因(yin)工(gong)負傷(shang),醫療(liao)(liao)(liao)期(qi)滿(man)后,用人(ren)(ren)單(dan)(dan)位(wei)應(ying)當根據勞(lao)動(dong)者(zhe)的(de)(de)(de)(de)身體狀況(kuang)安(an)排適(shi)當的(de)(de)(de)(de)工(gong)作(zuo)(zuo);因(yin)勞(lao)動(dong)者(zhe)不能從(cong)事(shi)原工(gong)作(zuo)(zuo)、也不能從(cong)事(shi)由(you)用人(ren)(ren)單(dan)(dan)位(wei)另行安(an)排的(de)(de)(de)(de)工(gong)作(zuo)(zuo)的(de)(de)(de)(de),用人(ren)(ren)單(dan)(dan)位(wei)可以依法解除勞(lao)動(dong)合同(tong)。用人(ren)(ren)單(dan)(dan)位(wei)解除勞(lao)動(dong)合同(tong),除依法支(zhi)付經濟補償外,還應(ying)當向勞(lao)動(dong)者(zhe)支(zhi)付不低于六個月工(gong)資的(de)(de)(de)(de)醫療(liao)(liao)(liao)補助(zhu)費(fei)(fei)(fei)。患(huan)重病和絕癥(zheng)的(de)(de)(de)(de)還應(ying)增加(jia)(jia)(jia)醫療(liao)(liao)(liao)補助(zhu)費(fei)(fei)(fei),患(huan)重病的(de)(de)(de)(de)增加(jia)(jia)(jia)部分(fen)不低于醫療(liao)(liao)(liao)補助(zhu)費(fei)(fei)(fei)的(de)(de)(de)(de)百分(fen)之(zhi)五(wu)十(shi),患(huan)絕癥(zheng)的(de)(de)(de)(de)增加(jia)(jia)(jia)部分(fen)不低于醫療(liao)(liao)(liao)補助(zhu)費(fei)(fei)(fei)的(de)(de)(de)(de)百分(fen)之(zhi)百。

第二種情(qing)形,醫(yi)療(liao)期滿后,勞(lao)動(dong)(dong)(dong)者不能(neng)從事原工作、也不能(neng)從事由用人單(dan)位另(ling)行安(an)排的(de)工作,但用人單(dan)位與勞(lao)動(dong)(dong)(dong)者保留(liu)勞(lao)動(dong)(dong)(dong)關系(xi)的(de),應(ying)當(dang)按照不低(di)于當(dang)地(di)最低(di)工資(zi)標準的(de)百分之八十向(xiang)勞(lao)動(dong)(dong)(dong)者支付疾病救濟費。第三種情(qing)形,勞(lao)動(dong)(dong)(dong)者患病或者非因(yin)工負傷,經勞(lao)動(dong)(dong)(dong)能(neng)力鑒定委員會(hui)鑒定為完(wan)全喪失勞(lao)動(dong)(dong)(dong)能(neng)力,且符合退(tui)休、退(tui)職(zhi)條件的(de),應(ying)當(dang)辦理退(tui)休、退(tui)職(zhi)手續(xu),享受退(tui)休、退(tui)職(zhi)待遇。
