日(ri)(ri)前,山東(dong)省青島市人社(she)局發布勞動(dong)者(zhe)患(huan)病或者(zhe)非因(yin)工(gong)負(fu)傷(shang)醫(yi)療(liao)期(qi)管理規(gui)定(以下簡稱《醫(yi)療(liao)期(qi)規(gui)定》),擴大了醫(yi)療(liao)期(qi)適用(yong)(yong)范圍,明(ming)確了醫(yi)療(liao)期(qi)期(qi)限(xian)及(ji)累計(ji)計(ji)算辦法等問題,進一步規(gui)范青島市醫(yi)療(liao)期(qi)管理,維護勞動(dong)者(zhe)和用(yong)(yong)人單位合法權益。據悉,該規(gui)定將于3月1日(ri)(ri)起正式施行,
擴大了醫療期適用范圍
原勞(lao)動部的醫療期規定僅適用于企(qi)業職工(gong)。2008年勞(lao)動合同法頒布實施后,用人單(dan)位的范(fan)圍進一(yi)步(bu)擴大,除企(qi)業外,一(yi)些民辦(ban)非企(qi)業單(dan)位、合伙組織等,其勞(lao)動者也應當享(xiang)有醫療期的相(xiang)關權利。
為此,《醫療期(qi)規(gui)定》對用(yong)人(ren)單(dan)(dan)位(wei)范圍進行了適度擴大,除企業外,其他勞動關(guan)系主體,如(ru)民辦非企業單(dan)(dan)位(wei)、會計師事(shi)(shi)務所、律(lv)師事(shi)(shi)務所、基(ji)金會等組織也(ye)納入(ru)適用(yong)范圍,以更加契(qi)合勞動合同法(fa)及用(yong)人(ren)單(dan)(dan)位(wei)的實際需求。
明確醫療期期限及累計計算辦法
《醫療期規(gui)定(ding)(ding)》延(yan)續相關規(gui)定(ding)(ding),醫療期根據勞(lao)動(dong)(dong)者本(ben)(ben)人(ren)實(shi)際(ji)(ji)工作(zuo)年(nian)(nian)(nian)(nian)限和在本(ben)(ben)單位(wei)工作(zuo)年(nian)(nian)(nian)(nian)限確定(ding)(ding),其中,實(shi)際(ji)(ji)工作(zuo)年(nian)(nian)(nian)(nian)限十(shi)(shi)(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de),在本(ben)(ben)單位(wei)工作(zuo)年(nian)(nian)(nian)(nian)限五(wu)(wu)(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)為(wei)(wei)三個月;五(wu)(wu)(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上的(de)為(wei)(wei)六個月;實(shi)際(ji)(ji)工作(zuo)年(nian)(nian)(nian)(nian)限十(shi)(shi)(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上的(de),在本(ben)(ben)單位(wei)工作(zuo)年(nian)(nian)(nian)(nian)限五(wu)(wu)(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)為(wei)(wei)六個月;五(wu)(wu)(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上十(shi)(shi)(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)為(wei)(wei)九個月;十(shi)(shi)(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上十(shi)(shi)(shi)(shi)五(wu)(wu)(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)為(wei)(wei)十(shi)(shi)(shi)(shi)二個月;十(shi)(shi)(shi)(shi)五(wu)(wu)(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上二十(shi)(shi)(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)為(wei)(wei)十(shi)(shi)(shi)(shi)八個月;二十(shi)(shi)(shi)(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上的(de)為(wei)(wei)二十(shi)(shi)(shi)(shi)四個月。《醫療期規(gui)定(ding)(ding)》還規(gui)定(ding)(ding),集體(ti)合(he)同(tong)、勞(lao)動(dong)(dong)合(he)同(tong)、用人(ren)單位(wei)的(de)規(gui)章制(zhi)度等約定(ding)(ding)醫療期長(chang)于規(gui)定(ding)(ding)醫療期的(de),從其約定(ding)(ding)。
同時(shi)(shi)(shi),《醫(yi)療(liao)期(qi)(qi)規定(ding)》對醫(yi)療(liao)期(qi)(qi)的(de)(de)累(lei)(lei)計(ji)(ji)(ji)(ji)計(ji)(ji)(ji)(ji)算(suan)方法作出規定(ding),醫(yi)療(liao)期(qi)(qi)三個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按(an)(an)(an)六(liu)(liu)個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)累(lei)(lei)計(ji)(ji)(ji)(ji)病(bing)休時(shi)(shi)(shi)間(jian)(jian)計(ji)(ji)(ji)(ji)算(suan);六(liu)(liu)個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按(an)(an)(an)十(shi)二(er)(er)個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)累(lei)(lei)計(ji)(ji)(ji)(ji)病(bing)休時(shi)(shi)(shi)間(jian)(jian)計(ji)(ji)(ji)(ji)算(suan);九個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按(an)(an)(an)十(shi)五(wu)個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)累(lei)(lei)計(ji)(ji)(ji)(ji)病(bing)休時(shi)(shi)(shi)間(jian)(jian)計(ji)(ji)(ji)(ji)算(suan);十(shi)二(er)(er)個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按(an)(an)(an)十(shi)八(ba)個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)累(lei)(lei)計(ji)(ji)(ji)(ji)病(bing)休時(shi)(shi)(shi)間(jian)(jian)計(ji)(ji)(ji)(ji)算(suan);十(shi)八(ba)個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按(an)(an)(an)二(er)(er)十(shi)四個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)累(lei)(lei)計(ji)(ji)(ji)(ji)病(bing)休時(shi)(shi)(shi)間(jian)(jian)計(ji)(ji)(ji)(ji)算(suan);二(er)(er)十(shi)四個(ge)(ge)月(yue)(yue)(yue)(yue)的(de)(de)按(an)(an)(an)三十(shi)個(ge)(ge)月(yue)(yue)(yue)(yue)內(nei)累(lei)(lei)計(ji)(ji)(ji)(ji)病(bing)休時(shi)(shi)(shi)間(jian)(jian)計(ji)(ji)(ji)(ji)算(suan)。醫(yi)療(liao)期(qi)(qi)的(de)(de)計(ji)(ji)(ji)(ji)算(suan)從勞動(dong)者(zhe)停(ting)工治(zhi)療(liao)第一(yi)天起累(lei)(lei)計(ji)(ji)(ji)(ji),期(qi)(qi)間(jian)(jian)公休假(jia)日(ri)、法定(ding)節假(jia)日(ri)包(bao)括在內(nei)。確定(ding)勞動(dong)者(zhe)醫(yi)療(liao)期(qi)(qi)期(qi)(qi)限、累(lei)(lei)計(ji)(ji)(ji)(ji)病(bing)休時(shi)(shi)(shi)間(jian)(jian)的(de)(de)工作年(nian)限,以其停(ting)工治(zhi)療(liao)前一(yi)日(ri)的(de)(de)實際工作年(nian)限和在本單位(wei)工作年(nian)限為(wei)準。
對醫療期內的工資待遇作出規定
《醫(yi)療期規定(ding)(ding)》規定(ding)(ding),勞動者患病或者非因工負傷停止工作治療休息,用人(ren)單位應當(dang)按照以下(xia)標準(zhun)支付病假工資(zi)或者疾(ji)病救濟費。
醫(yi)(yi)(yi)療期內,停工(gong)醫(yi)(yi)(yi)療累計不超(chao)(chao)過六(liu)(liu)個月(yue)(yue)(yue)的,發(fa)給本人工(gong)資(zi)(zi)(zi)百(bai)(bai)分(fen)之七十(shi)的病(bing)假工(gong)資(zi)(zi)(zi);醫(yi)(yi)(yi)療期內,停工(gong)醫(yi)(yi)(yi)療累計超(chao)(chao)過六(liu)(liu)個月(yue)(yue)(yue)的,發(fa)給本人工(gong)資(zi)(zi)(zi)百(bai)(bai)分(fen)之六(liu)(liu)十(shi)的疾病(bing)救濟(ji)費。病(bing)假工(gong)資(zi)(zi)(zi)和疾病(bing)救濟(ji)費最(zui)(zui)低(di)不得低(di)于(yu)當地最(zui)(zui)低(di)工(gong)資(zi)(zi)(zi)標準(zhun)的百(bai)(bai)分(fen)之八十(shi),最(zui)(zui)高不超(chao)(chao)過用(yong)人單位上(shang)年度勞(lao)(lao)動者(zhe)月(yue)(yue)(yue)平(ping)均(jun)工(gong)資(zi)(zi)(zi)。本人工(gong)資(zi)(zi)(zi),是(shi)指(zhi)勞(lao)(lao)動者(zhe)本人患病(bing)前十(shi)二個月(yue)(yue)(yue)的月(yue)(yue)(yue)平(ping)均(jun)工(gong)資(zi)(zi)(zi)。勞(lao)(lao)動者(zhe)工(gong)作(zuo)不滿十(shi)二個月(yue)(yue)(yue)的,按(an)實際(ji)工(gong)作(zuo)月(yue)(yue)(yue)數的月(yue)(yue)(yue)平(ping)均(jun)工(gong)資(zi)(zi)(zi)計算。
對醫療期滿勞動關系處理問題作出規定
《醫(yi)(yi)(yi)(yi)(yi)療(liao)期規定》梳理了醫(yi)(yi)(yi)(yi)(yi)療(liao)期滿用(yong)人(ren)(ren)單位(wei)處理勞動(dong)(dong)關系的(de)(de)各種(zhong)(zhong)情(qing)形(xing),第一種(zhong)(zhong)情(qing)形(xing),勞動(dong)(dong)者患病或(huo)者非因工(gong)負傷(shang),醫(yi)(yi)(yi)(yi)(yi)療(liao)期滿后,用(yong)人(ren)(ren)單位(wei)應(ying)(ying)當(dang)根據勞動(dong)(dong)者的(de)(de)身體狀(zhuang)況安排適當(dang)的(de)(de)工(gong)作;因勞動(dong)(dong)者不能(neng)從(cong)事原(yuan)工(gong)作、也不能(neng)從(cong)事由用(yong)人(ren)(ren)單位(wei)另行安排的(de)(de)工(gong)作的(de)(de),用(yong)人(ren)(ren)單位(wei)可(ke)以依法解除(chu)(chu)勞動(dong)(dong)合(he)同。用(yong)人(ren)(ren)單位(wei)解除(chu)(chu)勞動(dong)(dong)合(he)同,除(chu)(chu)依法支付經濟補(bu)償(chang)外(wai),還(huan)應(ying)(ying)當(dang)向勞動(dong)(dong)者支付不低(di)于六個月(yue)工(gong)資(zi)的(de)(de)醫(yi)(yi)(yi)(yi)(yi)療(liao)補(bu)助費(fei)。患重(zhong)病和絕癥的(de)(de)還(huan)應(ying)(ying)增加醫(yi)(yi)(yi)(yi)(yi)療(liao)補(bu)助費(fei),患重(zhong)病的(de)(de)增加部分(fen)不低(di)于醫(yi)(yi)(yi)(yi)(yi)療(liao)補(bu)助費(fei)的(de)(de)百(bai)分(fen)之五十,患絕癥的(de)(de)增加部分(fen)不低(di)于醫(yi)(yi)(yi)(yi)(yi)療(liao)補(bu)助費(fei)的(de)(de)百(bai)分(fen)之百(bai)。
第(di)(di)二種情形,醫療期滿后,勞(lao)(lao)動者不(bu)能(neng)從(cong)(cong)事原工(gong)作、也不(bu)能(neng)從(cong)(cong)事由(you)用人(ren)單(dan)位(wei)(wei)另行安排的(de)(de)(de)工(gong)作,但用人(ren)單(dan)位(wei)(wei)與勞(lao)(lao)動者保留(liu)勞(lao)(lao)動關系的(de)(de)(de),應當按照不(bu)低于當地最低工(gong)資標準(zhun)的(de)(de)(de)百分之八十向勞(lao)(lao)動者支付疾病救濟費。第(di)(di)三種情形,勞(lao)(lao)動者患(huan)病或(huo)者非因工(gong)負傷,經勞(lao)(lao)動能(neng)力鑒定委(wei)員會鑒定為完全喪失勞(lao)(lao)動能(neng)力,且符合退(tui)(tui)休、退(tui)(tui)職條件的(de)(de)(de),應當辦(ban)理退(tui)(tui)休、退(tui)(tui)職手(shou)續,享受退(tui)(tui)休、退(tui)(tui)職待遇。
