山東青島醫療期管理規定3月起實施 明確病假工資

日前,山東省青(qing)島(dao)市人(ren)社局發布勞(lao)動者患病或者非因(yin)工負傷醫(yi)療(liao)期管(guan)理規(gui)定(ding)(以下簡稱《醫(yi)療(liao)期規(gui)定(ding)》),擴(kuo)大了(le)醫(yi)療(liao)期適用范圍,明確了(le)醫(yi)療(liao)期期限(xian)及累計計算辦法(fa)等問題,進一步規(gui)范青(qing)島(dao)市醫(yi)療(liao)期管(guan)理,維護勞(lao)動者和用人(ren)單(dan)位(wei)合法(fa)權益。據悉,該規(gui)定(ding)將于3月(yue)1日起(qi)正式施行,

擴大了醫療期適用范圍

原(yuan)勞動(dong)部(bu)的(de)(de)醫療期規定僅適(shi)用于(yu)企(qi)(qi)業職工(gong)。2008年勞動(dong)合(he)同法頒(ban)布實施(shi)后,用人單(dan)位(wei)的(de)(de)范圍進一步擴(kuo)大,除企(qi)(qi)業外,一些民辦(ban)非企(qi)(qi)業單(dan)位(wei)、合(he)伙組織(zhi)等(deng),其勞動(dong)者也(ye)應當享(xiang)有醫療期的(de)(de)相(xiang)關權利。

為此,《醫療期規定(ding)》對用(yong)(yong)(yong)人單(dan)位范圍進行了適度擴大,除(chu)企(qi)業外,其他勞(lao)動關系主(zhu)體,如民(min)辦非企(qi)業單(dan)位、會計(ji)師事務所、律師事務所、基金會等組織(zhi)也納入適用(yong)(yong)(yong)范圍,以(yi)更加(jia)契合(he)勞(lao)動合(he)同法及用(yong)(yong)(yong)人單(dan)位的實際需求。

明確醫療期期限及累計計算辦法

《醫療(liao)期規(gui)(gui)(gui)定(ding)(ding)(ding)》延續相關(guan)規(gui)(gui)(gui)定(ding)(ding)(ding),醫療(liao)期根據勞動者(zhe)本人實際工作年(nian)(nian)(nian)(nian)(nian)(nian)限(xian)和(he)在(zai)本單(dan)(dan)位(wei)(wei)工作年(nian)(nian)(nian)(nian)(nian)(nian)限(xian)確定(ding)(ding)(ding),其中,實際工作年(nian)(nian)(nian)(nian)(nian)(nian)限(xian)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)(de),在(zai)本單(dan)(dan)位(wei)(wei)工作年(nian)(nian)(nian)(nian)(nian)(nian)限(xian)五(wu)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)(de)為三個(ge)(ge)月;五(wu)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)(shang)的(de)(de)為六(liu)個(ge)(ge)月;實際工作年(nian)(nian)(nian)(nian)(nian)(nian)限(xian)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)(shang)的(de)(de),在(zai)本單(dan)(dan)位(wei)(wei)工作年(nian)(nian)(nian)(nian)(nian)(nian)限(xian)五(wu)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)(de)為六(liu)個(ge)(ge)月;五(wu)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)(shang)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)(de)為九個(ge)(ge)月;十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)(shang)十(shi)(shi)五(wu)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)(de)為十(shi)(shi)二(er)(er)個(ge)(ge)月;十(shi)(shi)五(wu)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)(shang)二(er)(er)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)的(de)(de)為十(shi)(shi)八個(ge)(ge)月;二(er)(er)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)(shang)的(de)(de)為二(er)(er)十(shi)(shi)四個(ge)(ge)月。《醫療(liao)期規(gui)(gui)(gui)定(ding)(ding)(ding)》還規(gui)(gui)(gui)定(ding)(ding)(ding),集(ji)體合(he)同、勞動合(he)同、用人單(dan)(dan)位(wei)(wei)的(de)(de)規(gui)(gui)(gui)章制度等(deng)約定(ding)(ding)(ding)醫療(liao)期長于規(gui)(gui)(gui)定(ding)(ding)(ding)醫療(liao)期的(de)(de),從其約定(ding)(ding)(ding)。

同時(shi),《醫療(liao)(liao)期規定》對醫療(liao)(liao)期的(de)(de)累(lei)計(ji)(ji)計(ji)(ji)算(suan)(suan)(suan)方(fang)法作(zuo)出(chu)規定,醫療(liao)(liao)期三個(ge)月(yue)的(de)(de)按(an)(an)六(liu)個(ge)月(yue)內累(lei)計(ji)(ji)病(bing)休(xiu)(xiu)(xiu)時(shi)間(jian)(jian)計(ji)(ji)算(suan)(suan)(suan);六(liu)個(ge)月(yue)的(de)(de)按(an)(an)十(shi)(shi)二(er)(er)個(ge)月(yue)內累(lei)計(ji)(ji)病(bing)休(xiu)(xiu)(xiu)時(shi)間(jian)(jian)計(ji)(ji)算(suan)(suan)(suan);九個(ge)月(yue)的(de)(de)按(an)(an)十(shi)(shi)五個(ge)月(yue)內累(lei)計(ji)(ji)病(bing)休(xiu)(xiu)(xiu)時(shi)間(jian)(jian)計(ji)(ji)算(suan)(suan)(suan);十(shi)(shi)二(er)(er)個(ge)月(yue)的(de)(de)按(an)(an)十(shi)(shi)八個(ge)月(yue)內累(lei)計(ji)(ji)病(bing)休(xiu)(xiu)(xiu)時(shi)間(jian)(jian)計(ji)(ji)算(suan)(suan)(suan);十(shi)(shi)八個(ge)月(yue)的(de)(de)按(an)(an)二(er)(er)十(shi)(shi)四個(ge)月(yue)內累(lei)計(ji)(ji)病(bing)休(xiu)(xiu)(xiu)時(shi)間(jian)(jian)計(ji)(ji)算(suan)(suan)(suan);二(er)(er)十(shi)(shi)四個(ge)月(yue)的(de)(de)按(an)(an)三十(shi)(shi)個(ge)月(yue)內累(lei)計(ji)(ji)病(bing)休(xiu)(xiu)(xiu)時(shi)間(jian)(jian)計(ji)(ji)算(suan)(suan)(suan)。醫療(liao)(liao)期的(de)(de)計(ji)(ji)算(suan)(suan)(suan)從勞(lao)(lao)動(dong)者停(ting)工(gong)治療(liao)(liao)第(di)一(yi)天起(qi)累(lei)計(ji)(ji),期間(jian)(jian)公休(xiu)(xiu)(xiu)假日、法定節假日包括在(zai)內。確(que)定勞(lao)(lao)動(dong)者醫療(liao)(liao)期期限、累(lei)計(ji)(ji)病(bing)休(xiu)(xiu)(xiu)時(shi)間(jian)(jian)的(de)(de)工(gong)作(zuo)年限,以其停(ting)工(gong)治療(liao)(liao)前一(yi)日的(de)(de)實際工(gong)作(zuo)年限和(he)在(zai)本(ben)單(dan)位工(gong)作(zuo)年限為(wei)準。

對醫療期內的工資待遇作出規定

《醫療(liao)期(qi)規(gui)定(ding)》規(gui)定(ding),勞動者(zhe)患病(bing)或者(zhe)非因工負傷(shang)停止工作治療(liao)休息,用人單位應當按照以下標準支(zhi)付病(bing)假工資或者(zhe)疾(ji)病(bing)救濟費。

醫(yi)療(liao)期(qi)內,停工(gong)(gong)(gong)(gong)醫(yi)療(liao)累計(ji)不(bu)(bu)超過六(liu)(liu)個(ge)(ge)月(yue)的(de)(de),發給本人(ren)(ren)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)百分之七(qi)十(shi)(shi)的(de)(de)病(bing)(bing)(bing)假(jia)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi);醫(yi)療(liao)期(qi)內,停工(gong)(gong)(gong)(gong)醫(yi)療(liao)累計(ji)超過六(liu)(liu)個(ge)(ge)月(yue)的(de)(de),發給本人(ren)(ren)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)百分之六(liu)(liu)十(shi)(shi)的(de)(de)疾病(bing)(bing)(bing)救濟費。病(bing)(bing)(bing)假(jia)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)和疾病(bing)(bing)(bing)救濟費最(zui)低不(bu)(bu)得低于當(dang)地最(zui)低工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)標準(zhun)的(de)(de)百分之八(ba)十(shi)(shi),最(zui)高不(bu)(bu)超過用(yong)人(ren)(ren)單位上年度勞(lao)動(dong)者月(yue)平(ping)均(jun)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)。本人(ren)(ren)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi),是指勞(lao)動(dong)者本人(ren)(ren)患(huan)病(bing)(bing)(bing)前十(shi)(shi)二個(ge)(ge)月(yue)的(de)(de)月(yue)平(ping)均(jun)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)。勞(lao)動(dong)者工(gong)(gong)(gong)(gong)作不(bu)(bu)滿十(shi)(shi)二個(ge)(ge)月(yue)的(de)(de),按實際工(gong)(gong)(gong)(gong)作月(yue)數的(de)(de)月(yue)平(ping)均(jun)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)計(ji)算。

對醫療期滿勞動關系處理問題作出規定

《醫(yi)療(liao)(liao)期規定》梳理了醫(yi)療(liao)(liao)期滿(man)用(yong)人(ren)單(dan)(dan)位處理勞(lao)動(dong)關系的各(ge)種情形,第(di)一種情形,勞(lao)動(dong)者(zhe)患病(bing)或者(zhe)非因(yin)工負傷,醫(yi)療(liao)(liao)期滿(man)后,用(yong)人(ren)單(dan)(dan)位應(ying)當(dang)根(gen)據勞(lao)動(dong)者(zhe)的身體狀況安(an)排適當(dang)的工作(zuo);因(yin)勞(lao)動(dong)者(zhe)不(bu)能(neng)從(cong)事原工作(zuo)、也(ye)不(bu)能(neng)從(cong)事由用(yong)人(ren)單(dan)(dan)位另行(xing)安(an)排的工作(zuo)的,用(yong)人(ren)單(dan)(dan)位可以依法解(jie)除勞(lao)動(dong)合同。用(yong)人(ren)單(dan)(dan)位解(jie)除勞(lao)動(dong)合同,除依法支付(fu)經濟補償外,還(huan)應(ying)當(dang)向勞(lao)動(dong)者(zhe)支付(fu)不(bu)低于(yu)六個月(yue)工資的醫(yi)療(liao)(liao)補助費。患重(zhong)(zhong)病(bing)和(he)絕癥的還(huan)應(ying)增(zeng)加(jia)(jia)醫(yi)療(liao)(liao)補助費,患重(zhong)(zhong)病(bing)的增(zeng)加(jia)(jia)部分(fen)不(bu)低于(yu)醫(yi)療(liao)(liao)補助費的百分(fen)之五(wu)十,患絕癥的增(zeng)加(jia)(jia)部分(fen)不(bu)低于(yu)醫(yi)療(liao)(liao)補助費的百分(fen)之百。

第(di)(di)二種情形(xing),醫療期滿后,勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)不能(neng)從(cong)事(shi)原工作、也不能(neng)從(cong)事(shi)由用人單位另行安排(pai)的(de)工作,但用人單位與勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)保留勞(lao)(lao)(lao)(lao)動(dong)(dong)關系(xi)的(de),應當(dang)按照(zhao)不低于當(dang)地最(zui)低工資標準的(de)百分之八十向勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)支付疾病救濟費。第(di)(di)三種情形(xing),勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)患病或者(zhe)非因工負傷(shang),經勞(lao)(lao)(lao)(lao)動(dong)(dong)能(neng)力鑒定委員會鑒定為完(wan)全(quan)喪失勞(lao)(lao)(lao)(lao)動(dong)(dong)能(neng)力,且符(fu)合退(tui)(tui)休、退(tui)(tui)職(zhi)條件的(de),應當(dang)辦理退(tui)(tui)休、退(tui)(tui)職(zhi)手(shou)續,享受退(tui)(tui)休、退(tui)(tui)職(zhi)待遇(yu)。
