山東省聊城將推農民工實名制工資卡管理

記者從11日召開的全市構建和諧勞動關系工作會議上了解到,為扎實做好構建和諧勞動關系的各項工作,聊城市將著力解決好當前勞動關系的三項重點工作。為及時處理拖欠農民工工資問題,將在建設領域和欠薪多發行業普遍建立用人單位繳納工作保證金制度,在欠薪多發的部分縣(市、區)建立完善欠薪應急周轉金制度。

市(shi)人社局相關負(fu)責(ze)人表示,今后將日常巡(xun)查(cha)和(he)重點檢查(cha)相結合(he),及(ji)時處理拖欠(qian)(qian)農(nong)民工(gong)工(gong)資問題。積極(ji)開(kai)展農(nong)民工(gong)工(gong)資支(zhi)(zhi)付(fu)、清理整頓人力資源市(shi)場(chang)、勞(lao)(lao)動(dong)用(yong)工(gong)與(yu)社會(hui)保險等(deng)專項執(zhi)(zhi)法(fa)檢查(cha)。進(jin)一步擴大勞(lao)(lao)動(dong)保障年檢、日常巡(xun)查(cha)范圍,及(ji)時受理勞(lao)(lao)動(dong)者投訴舉報,處理好勞(lao)(lao)動(dong)者的利益訴求。妥善處理拖欠(qian)(qian)農(nong)民工(gong)工(gong)資問題,在建(jian)設領(ling)域和(he)欠(qian)(qian)薪多發行(xing)業普遍(bian)建(jian)立用(yong)人單(dan)位(wei)繳納工(gong)作保證金(jin)制(zhi)(zhi)度,在欠(qian)(qian)薪多發的部分縣(市(shi)、區(qu))建(jian)立完善欠(qian)(qian)薪應急周(zhou)轉金(jin)制(zhi)(zhi)度,全面推行(xing)農(nong)民工(gong)實名制(zhi)(zhi)工(gong)資卡(ka)管(guan)理,督促企業落實按月足額支(zhi)(zhi)付(fu)工(gong)資的有關法(fa)律規定。建(jian)立勞(lao)(lao)動(dong)保障監察(cha)執(zhi)(zhi)法(fa)和(he)刑(xing)事司法(fa)聯動(dong)機制(zhi)(zhi),嚴厲打擊惡意欠(qian)(qian)薪行(xing)為,切實解決拖欠(qian)(qian)職(zhi)工(gong)特別(bie)是農(nong)民工(gong)工(gong)資問題。

其(qi)次,將抓好“兩(liang)網(wang)化(hua)”建設工(gong)(gong)(gong)(gong)作(zuo)。強化(hua)措施,通過調度(du)、考評等(deng)方式,確保市縣兩(liang)級實現(xian)“兩(liang)網(wang)化(hua)”100%全(quan)(quan)覆蓋。完(wan)善“兩(liang)網(wang)化(hua)”規(gui)范化(hua)建設,積極做好全(quan)(quan)省聯網(wang)統一受理和查(cha)處投訴舉報案件的相關(guan)工(gong)(gong)(gong)(gong)作(zuo),建立協管員管理制度(du)、用工(gong)(gong)(gong)(gong)信息采集(ji)制度(du)、網(wang)格(ge)巡查(cha)等(deng)相關(guan)制度(du),明(ming)確工(gong)(gong)(gong)(gong)作(zuo)職責,規(gui)范工(gong)(gong)(gong)(gong)作(zuo)程序,做好系統更(geng)新維(wei)護,為實現(xian)全(quan)(quan)省統一聯網(wang)的有效銜(xian)接打好基礎。

此外,將大力推進同(tong)工(gong)(gong)(gong)(gong)同(tong)酬分配(pei)原(yuan)則(ze)落實。加大工(gong)(gong)(gong)(gong)作力度,規范勞(lao)務(wu)(wu)派遣(qian)經(jing)營行(xing)為,引(yin)導督促用(yong)人(ren)(ren)單(dan)位(wei)按照法(fa)(fa)律(lv)要(yao)求調整用(yong)工(gong)(gong)(gong)(gong)比例,依法(fa)(fa)及時繳納社會保(bao)(bao)險(xian),對只交一項工(gong)(gong)(gong)(gong)傷保(bao)(bao)險(xian)或侵犯(fan)派遣(qian)人(ren)(ren)員(yuan)權益(yi)的情(qing)況要(yao)嚴(yan)格管控和檢查,維(wei)護好(hao)勞(lao)務(wu)(wu)派遣(qian)職(zhi)工(gong)(gong)(gong)(gong)的合法(fa)(fa)權益(yi)。嚴(yan)格落實機關事業單(dan)位(wei)未(wei)納入正式(shi)職(zhi)工(gong)(gong)(gong)(gong)管理(li)人(ren)(ren)員(yuan)的有關規定,逐步提(ti)高他(ta)們的收入水平,全面(mian)落實這部分人(ren)(ren)員(yuan)參(can)加社會保(bao)(bao)險(xian)政(zheng)策(ce),切(qie)實維(wei)護其合法(fa)(fa)權益(yi)。

全面實行勞動合同制度 健全勞(lao)動(dong)關系協調機制(zhi)

今后,我(wo)市將全面實行(xing)勞動(dong)(dong)合同(tong)制度(du)。繼續加大工作(zuo)力度(du),在用工季節性(xing)強、職工流動(dong)(dong)性(xing)大的行(xing)業(ye)推(tui)廣(guang)簡易勞動(dong)(dong)合同(tong)示范文本(ben),規范勞動(dong)(dong)合同(tong)訂立(li)、履行(xing)、變更(geng)、解除、終止等行(xing)為,切(qie)實提(ti)高勞動(dong)(dong)合同(tong)簽訂率和(he)履行(xing)質量。深入實施農(nong)民工權益(yi)保障3年行(xing)動(dong)(dong)計(ji)劃,確保在城鎮穩(wen)定就業(ye)的農(nong)民工勞動(dong)(dong)合同(tong)簽訂率達(da)到(dao)85%以上(shang),建筑、餐飲、居民服(fu)務(wu)等流動(dong)(dong)性(xing)較強的行(xing)業(ye)農(nong)民工勞動(dong)(dong)合同(tong)簽訂率達(da)到(dao)55%以上(shang)。

大力推(tui)進集體(ti)合(he)同(tong)(tong)(tong)制(zhi)度(du)。著力提升集體(ti)協(xie)(xie)商質量,增強(qiang)集體(ti)合(he)同(tong)(tong)(tong)實效,逐步(bu)形成(cheng)規(gui)范有(you)效的集體(ti)協(xie)(xie)商機制(zhi),暢通職(zhi)工利益訴求表達渠道。扎實推(tui)進集體(ti)合(he)同(tong)(tong)(tong)制(zhi)度(du)三年行動(dong)攻(gong)堅計劃,推(tui)動(dong)企業(ye)與職(zhi)工就工作條(tiao)件、勞動(dong)定額(e)、女職(zhi)工特殊保護(hu)等開展集體(ti)協(xie)(xie)商,訂立集體(ti)合(he)同(tong)(tong)(tong)。加強(qiang)對集體(ti)協(xie)(xie)商過(guo)程的指(zhi)導,督促企業(ye)和職(zhi)工認真(zhen)履行集體(ti)合(he)同(tong)(tong)(tong)。

此外,將進一步健全(quan)協(xie)調(diao)勞動(dong)關系三(san)方(fang)機(ji)(ji)(ji)制。在完善市、縣協(xie)調(diao)勞動(dong)關系三(san)方(fang)機(ji)(ji)(ji)制基礎上(shang),積極推動(dong)有條件的(de)工業(ye)園(yuan)區、鄉(xiang)鎮(街道)和產(chan)業(ye)系統建立三(san)方(fang)機(ji)(ji)(ji)制。創新三(san)方(fang)機(ji)(ji)(ji)制組織(zhi)建設,建立協(xie)調(diao)勞動(dong)關系三(san)方(fang)委(wei)員會,逐步做(zuo)實三(san)方(fang)機(ji)(ji)(ji)制的(de)辦事機(ji)(ji)(ji)構。完善三(san)方(fang)機(ji)(ji)(ji)制職能,加強工作(zuo)制度建設,充分發揮政府、工會和企業(ye)代表組織(zhi)共同研究解決有關勞動(dong)關系重(zhong)大問題的(de)重(zhong)要作(zuo)用。

完善勞動關系矛盾調處機制

為了(le)更進一步(bu)推進構建和諧勞(lao)動關系工作,我市將完善勞(lao)動關系矛盾調處(chu)機制。

健(jian)(jian)全勞動(dong)(dong)爭議(yi)調(diao)(diao)(diao)解(jie)(jie)(jie)仲(zhong)裁(cai)(cai)(cai)(cai)(cai)機制。堅持“鼓勵(li)和解(jie)(jie)(jie)、強(qiang)(qiang)化調(diao)(diao)(diao)解(jie)(jie)(jie)、加(jia)快仲(zhong)裁(cai)(cai)(cai)(cai)(cai)、銜接訴訟”原則(ze),大力(li)(li)加(jia)強(qiang)(qiang)勞動(dong)(dong)爭議(yi)調(diao)(diao)(diao)解(jie)(jie)(jie)工作(zuo),健(jian)(jian)全專(zhuan)業性調(diao)(diao)(diao)解(jie)(jie)(jie)與(yu)(yu)人民調(diao)(diao)(diao)解(jie)(jie)(jie)、行政調(diao)(diao)(diao)解(jie)(jie)(jie)、仲(zhong)裁(cai)(cai)(cai)(cai)(cai)調(diao)(diao)(diao)解(jie)(jie)(jie)、司法(fa)調(diao)(diao)(diao)解(jie)(jie)(jie)聯(lian)動(dong)(dong)工作(zuo)體(ti)系(xi)。深入推進示范(fan)仲(zhong)裁(cai)(cai)(cai)(cai)(cai)院創建活動(dong)(dong)和調(diao)(diao)(diao)解(jie)(jie)(jie)仲(zhong)裁(cai)(cai)(cai)(cai)(cai)效(xiao)(xiao)能(neng)建設督查活動(dong)(dong),提升仲(zhong)裁(cai)(cai)(cai)(cai)(cai)工作(zuo)標(biao)準化、規范(fan)化、專(zhuan)業化水(shui)平(ping);加(jia)強(qiang)(qiang)基層調(diao)(diao)(diao)解(jie)(jie)(jie)規范(fan)化建設,完善(shan)區域性、行業性調(diao)(diao)(diao)解(jie)(jie)(jie)組織和工作(zuo)機制,提高(gao)企業自主解(jie)(jie)(jie)決(jue)爭議(yi)能(neng)力(li)(li);依法(fa)加(jia)大先行裁(cai)(cai)(cai)(cai)(cai)決(jue)、先予執行裁(cai)(cai)(cai)(cai)(cai)決(jue)、終局裁(cai)(cai)(cai)(cai)(cai)決(jue)力(li)(li)度,不斷提高(gao)爭議(yi)處(chu)理效(xiao)(xiao)能(neng);加(jia)強(qiang)(qiang)裁(cai)(cai)(cai)(cai)(cai)審銜接與(yu)(yu)工作(zuo)協調(diao)(diao)(diao),切實提高(gao)仲(zhong)裁(cai)(cai)(cai)(cai)(cai)辦案效(xiao)(xiao)率和公信力(li)(li)。

健(jian)全勞(lao)(lao)動(dong)(dong)(dong)保(bao)障(zhang)監(jian)察(cha)體制機制。改(gai)革勞(lao)(lao)動(dong)(dong)(dong)保(bao)障(zhang)監(jian)察(cha)執(zhi)法(fa)(fa)(fa)體制,加快推(tui)進(jin)綜合(he)執(zhi)法(fa)(fa)(fa),理(li)順(shun)不(bu)同層級(ji)執(zhi)法(fa)(fa)(fa)職能,全力推(tui)動(dong)(dong)(dong)監(jian)察(cha)執(zhi)法(fa)(fa)(fa)重心(xin)下移(yi)。強化縣(xian)以下勞(lao)(lao)動(dong)(dong)(dong)保(bao)障(zhang)執(zhi)法(fa)(fa)(fa)能力建(jian)設,實現監(jian)察(cha)執(zhi)法(fa)(fa)(fa)向(xiang)主動(dong)(dong)(dong)預防和統籌城鄉轉變。加大(da)對非法(fa)(fa)(fa)用工尤其是大(da)案(an)(an)要案(an)(an)的查處力度,嚴厲打(da)擊使用童(tong)工、拒不(bu)支付勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)等(deng)違法(fa)(fa)(fa)犯罪行為。完善企業(ye)勞(lao)(lao)動(dong)(dong)(dong)保(bao)障(zhang)誠信(xin)(xin)評價制度,組織(zhi)好誠信(xin)(xin)企業(ye)評選(xuan)活(huo)動(dong)(dong)(dong),建(jian)立(li)健(jian)全企業(ye)誠信(xin)(xin)檔案(an)(an)。

完(wan)善勞動關(guan)系(xi)群(qun)(qun)體(ti)性事(shi)件(jian)(jian)預(yu)防(fang)和應急處置(zhi)機制(zhi)。依托協調(diao)勞動關(guan)系(xi)三方(fang)機制(zhi),建立勞動關(guan)系(xi)群(qun)(qun)體(ti)性糾紛排(pai)查和動態監(jian)測預(yu)警制(zhi)度,完(wan)善協調(diao)處理集體(ti)協商爭議(yi)辦法,有效調(diao)處因簽訂(ding)集體(ti)合同發生的爭議(yi)事(shi)件(jian)(jian)。健全多部門(men)共同參與的群(qun)(qun)體(ti)性事(shi)件(jian)(jian)應急聯動處置(zhi)機制(zhi),督(du)促指導企業落實主(zhu)體(ti)責任,及時妥善處置(zhi)群(qun)(qun)體(ti)性事(shi)件(jian)(jian),維護社會和諧穩定。

今年以來解決拖欠工資4410萬元

記者(zhe)從11日召(zhao)開的全市構建和諧勞(lao)(lao)動(dong)(dong)關(guan)(guan)系(xi)工作會議上了解(jie)(jie)到,近年(nian)來(lai),全市勞(lao)(lao)動(dong)(dong)關(guan)(guan)系(xi)工作逐步由注重治標(biao)向標(biao)本兼治轉變,勞(lao)(lao)動(dong)(dong)關(guan)(guan)系(xi)保(bao)持(chi)總(zong)體穩定(ding)。今(jin)年(nian)以來(lai),全市各級勞(lao)(lao)動(dong)(dong)保(bao)障監察機(ji)構受理投訴(su)、舉報295起,督(du)促用人(ren)單位與(yu)6397名職(zhi)工簽訂勞(lao)(lao)動(dong)(dong)合(he)同,解(jie)(jie)決拖欠工資4410萬元(yuan),補繳社(she)會保(bao)險費6623.66萬元(yuan);勞(lao)(lao)動(dong)(dong)人(ren)事(shi)調(diao)解(jie)(jie)仲裁機(ji)構處理爭(zheng)議案(an)件(jian)464件(jian),為勞(lao)(lao)動(dong)(dong)者(zhe)挽回損失1533.97元(yuan),切(qie)實維護了職(zhi)工的合(he)法權益。
