記者從11日召開的全市構建和諧勞動關系工作會議上了解到,為扎實做好構建和諧勞動關系的各項工作,聊城市將著力解決好當前勞動關系的三項重點工作。為及時處理拖欠農民工工資問題,將在建設領域和欠薪多發行業普遍建立用人單位繳納工作保證金制度,在欠薪多發的部分縣(市、區)建立完善欠薪應急周轉金制度。

市人社局相(xiang)關負責人表示,今后(hou)將日常(chang)巡查(cha)和重點檢(jian)查(cha)相(xiang)結合,及(ji)時處理(li)(li)拖(tuo)欠(qian)(qian)(qian)農(nong)(nong)民(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti)。積(ji)極開展農(nong)(nong)民(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)支付、清理(li)(li)整(zheng)頓人力資(zi)(zi)源市場、勞動(dong)(dong)用工(gong)(gong)(gong)(gong)(gong)與(yu)社會保(bao)險等專(zhuan)項執法(fa)(fa)檢(jian)查(cha)。進一步擴大(da)勞動(dong)(dong)保(bao)障年檢(jian)、日常(chang)巡查(cha)范圍,及(ji)時受理(li)(li)勞動(dong)(dong)者(zhe)投訴(su)舉報,處理(li)(li)好勞動(dong)(dong)者(zhe)的利益訴(su)求。妥善處理(li)(li)拖(tuo)欠(qian)(qian)(qian)農(nong)(nong)民(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti),在建設領域和欠(qian)(qian)(qian)薪(xin)多發行業(ye)普遍建立(li)(li)用人單位繳納(na)工(gong)(gong)(gong)(gong)(gong)作保(bao)證金(jin)制(zhi)(zhi)度,在欠(qian)(qian)(qian)薪(xin)多發的部分縣(市、區(qu))建立(li)(li)完(wan)善欠(qian)(qian)(qian)薪(xin)應急周轉(zhuan)金(jin)制(zhi)(zhi)度,全面推行農(nong)(nong)民(min)工(gong)(gong)(gong)(gong)(gong)實(shi)名制(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)卡管理(li)(li),督促企業(ye)落實(shi)按月足額支付工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)的有關法(fa)(fa)律規定(ding)。建立(li)(li)勞動(dong)(dong)保(bao)障監察(cha)執法(fa)(fa)和刑事司(si)法(fa)(fa)聯動(dong)(dong)機制(zhi)(zhi),嚴厲(li)打擊惡意欠(qian)(qian)(qian)薪(xin)行為,切實(shi)解決拖(tuo)欠(qian)(qian)(qian)職(zhi)工(gong)(gong)(gong)(gong)(gong)特別(bie)是農(nong)(nong)民(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti)。

其次,將抓(zhua)好“兩(liang)網(wang)化(hua)(hua)”建設(she)工(gong)(gong)作(zuo)。強(qiang)化(hua)(hua)措施,通過調度(du)(du)、考評等(deng)方式,確保市(shi)縣兩(liang)級(ji)實(shi)現(xian)“兩(liang)網(wang)化(hua)(hua)”100%全覆蓋。完善(shan)“兩(liang)網(wang)化(hua)(hua)”規范化(hua)(hua)建設(she),積極做好全省(sheng)聯(lian)網(wang)統(tong)一(yi)受(shou)理(li)和(he)查(cha)(cha)處投訴舉(ju)報案(an)件的相(xiang)關(guan)工(gong)(gong)作(zuo),建立協管員(yuan)管理(li)制(zhi)度(du)(du)、用工(gong)(gong)信息采集制(zhi)度(du)(du)、網(wang)格巡(xun)查(cha)(cha)等(deng)相(xiang)關(guan)制(zhi)度(du)(du),明確工(gong)(gong)作(zuo)職責(ze),規范工(gong)(gong)作(zuo)程序,做好系統(tong)更新維護,為實(shi)現(xian)全省(sheng)統(tong)一(yi)聯(lian)網(wang)的有效銜接打好基礎。

此外,將大力推進(jin)同工(gong)同酬分(fen)(fen)配(pei)原則落(luo)實(shi)(shi)。加(jia)大工(gong)作力度,規范勞務派遣經營行為,引導(dao)督(du)促用人(ren)單(dan)位按照法(fa)律要求調整用工(gong)比例,依法(fa)及(ji)時繳納社會保(bao)(bao)險,對只交一項工(gong)傷保(bao)(bao)險或侵(qin)犯派遣人(ren)員權益(yi)的(de)情(qing)況要嚴格管控(kong)和(he)檢查,維護(hu)好(hao)勞務派遣職(zhi)(zhi)工(gong)的(de)合法(fa)權益(yi)。嚴格落(luo)實(shi)(shi)機關(guan)(guan)事業(ye)單(dan)位未(wei)納入正式職(zhi)(zhi)工(gong)管理人(ren)員的(de)有關(guan)(guan)規定,逐步提高他們的(de)收入水平,全面落(luo)實(shi)(shi)這部(bu)分(fen)(fen)人(ren)員參加(jia)社會保(bao)(bao)險政策,切(qie)實(shi)(shi)維護(hu)其合法(fa)權益(yi)。

全面實行勞動合同制度 健(jian)全(quan)勞動(dong)關系協調機制

今后,我市將全面實(shi)行(xing)勞(lao)動(dong)(dong)合同制(zhi)度(du)。繼續加大工(gong)(gong)(gong)作(zuo)力度(du),在用工(gong)(gong)(gong)季節性強、職(zhi)工(gong)(gong)(gong)流動(dong)(dong)性大的行(xing)業(ye)推廣簡易勞(lao)動(dong)(dong)合同示范文本,規范勞(lao)動(dong)(dong)合同訂(ding)立、履行(xing)、變(bian)更、解(jie)除、終(zhong)止等(deng)行(xing)為(wei),切實(shi)提(ti)高勞(lao)動(dong)(dong)合同簽(qian)訂(ding)率和履行(xing)質量。深(shen)入實(shi)施農民(min)(min)工(gong)(gong)(gong)權益保障3年行(xing)動(dong)(dong)計劃,確保在城鎮穩定就(jiu)業(ye)的農民(min)(min)工(gong)(gong)(gong)勞(lao)動(dong)(dong)合同簽(qian)訂(ding)率達到85%以(yi)上,建筑、餐飲、居民(min)(min)服務等(deng)流動(dong)(dong)性較(jiao)強的行(xing)業(ye)農民(min)(min)工(gong)(gong)(gong)勞(lao)動(dong)(dong)合同簽(qian)訂(ding)率達到55%以(yi)上。

大力(li)推進集(ji)體(ti)合同(tong)(tong)制度。著(zhu)力(li)提升(sheng)集(ji)體(ti)協(xie)商質量,增強(qiang)集(ji)體(ti)合同(tong)(tong)實(shi)效,逐步形成規(gui)范有效的(de)集(ji)體(ti)協(xie)商機制,暢通職工(gong)(gong)利益(yi)訴求表達渠道。扎(zha)實(shi)推進集(ji)體(ti)合同(tong)(tong)制度三年行動攻堅(jian)計劃(hua),推動企(qi)業與職工(gong)(gong)就工(gong)(gong)作條件、勞動定額、女職工(gong)(gong)特殊(shu)保護等開展(zhan)集(ji)體(ti)協(xie)商,訂立集(ji)體(ti)合同(tong)(tong)。加強(qiang)對集(ji)體(ti)協(xie)商過程的(de)指導,督促企(qi)業和職工(gong)(gong)認真履行集(ji)體(ti)合同(tong)(tong)。

此(ci)外,將進一步(bu)健(jian)全協調(diao)勞動(dong)(dong)關系(xi)三(san)(san)(san)方機(ji)(ji)制(zhi)。在完善市、縣協調(diao)勞動(dong)(dong)關系(xi)三(san)(san)(san)方機(ji)(ji)制(zhi)基礎上,積極推動(dong)(dong)有條件的工(gong)業(ye)園區(qu)、鄉鎮(街道)和產(chan)業(ye)系(xi)統(tong)建(jian)(jian)(jian)立(li)三(san)(san)(san)方機(ji)(ji)制(zhi)。創新三(san)(san)(san)方機(ji)(ji)制(zhi)組織(zhi)建(jian)(jian)(jian)設,建(jian)(jian)(jian)立(li)協調(diao)勞動(dong)(dong)關系(xi)三(san)(san)(san)方委員會,逐步(bu)做實三(san)(san)(san)方機(ji)(ji)制(zhi)的辦事機(ji)(ji)構(gou)。完善三(san)(san)(san)方機(ji)(ji)制(zhi)職能(neng),加(jia)強工(gong)作制(zhi)度建(jian)(jian)(jian)設,充(chong)分發揮政府、工(gong)會和企(qi)業(ye)代表組織(zhi)共同研究解(jie)決有關勞動(dong)(dong)關系(xi)重大問題的重要作用(yong)。

完善勞動關系矛盾調處機制

為了更進(jin)一(yi)步推進(jin)構(gou)建和諧勞動(dong)關系(xi)工作,我(wo)市將完善勞動(dong)關系(xi)矛盾調處機制。

健全(quan)勞動(dong)爭(zheng)(zheng)議(yi)調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)仲(zhong)(zhong)裁(cai)(cai)機制。堅持(chi)“鼓勵和(he)解(jie)(jie)(jie)、強化(hua)(hua)調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)、加快(kuai)仲(zhong)(zhong)裁(cai)(cai)、銜接訴(su)訟”原則,大(da)力(li)加強勞動(dong)爭(zheng)(zheng)議(yi)調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)工(gong)作(zuo)(zuo),健全(quan)專業性調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)與(yu)人民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)、行政調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)、仲(zhong)(zhong)裁(cai)(cai)調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)、司法調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)聯動(dong)工(gong)作(zuo)(zuo)體系。深入(ru)推進(jin)示范仲(zhong)(zhong)裁(cai)(cai)院創建(jian)活(huo)動(dong)和(he)調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)仲(zhong)(zhong)裁(cai)(cai)效(xiao)能建(jian)設(she)督查活(huo)動(dong),提升仲(zhong)(zhong)裁(cai)(cai)工(gong)作(zuo)(zuo)標準化(hua)(hua)、規范化(hua)(hua)、專業化(hua)(hua)水平;加強基層調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)規范化(hua)(hua)建(jian)設(she),完(wan)善(shan)區域性、行業性調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)組織和(he)工(gong)作(zuo)(zuo)機制,提高企業自主解(jie)(jie)(jie)決(jue)爭(zheng)(zheng)議(yi)能力(li);依法加大(da)先(xian)行裁(cai)(cai)決(jue)、先(xian)予執行裁(cai)(cai)決(jue)、終局裁(cai)(cai)決(jue)力(li)度(du),不斷提高爭(zheng)(zheng)議(yi)處理效(xiao)能;加強裁(cai)(cai)審銜接與(yu)工(gong)作(zuo)(zuo)協調(diao)(diao)(diao)(diao),切實(shi)提高仲(zhong)(zhong)裁(cai)(cai)辦(ban)案效(xiao)率和(he)公(gong)信(xin)力(li)。

健全勞(lao)動(dong)保(bao)障(zhang)(zhang)監察(cha)(cha)體制(zhi)(zhi)機制(zhi)(zhi)。改革(ge)勞(lao)動(dong)保(bao)障(zhang)(zhang)監察(cha)(cha)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)體制(zhi)(zhi),加(jia)快推進綜合(he)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa),理順不(bu)同(tong)層級執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)職能,全力(li)推動(dong)監察(cha)(cha)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)重(zhong)心下移。強(qiang)化縣以下勞(lao)動(dong)保(bao)障(zhang)(zhang)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)能力(li)建設,實現監察(cha)(cha)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)向主動(dong)預防和統籌(chou)城鄉(xiang)轉變。加(jia)大對(dui)非(fei)法(fa)(fa)(fa)用工尤其是(shi)大案(an)要案(an)的查(cha)處力(li)度,嚴厲打(da)擊使用童(tong)工、拒不(bu)支(zhi)付勞(lao)動(dong)報酬等違法(fa)(fa)(fa)犯罪行為(wei)。完善企業勞(lao)動(dong)保(bao)障(zhang)(zhang)誠(cheng)信評(ping)價制(zhi)(zhi)度,組織好誠(cheng)信企業評(ping)選活動(dong),建立健全企業誠(cheng)信檔案(an)。

完(wan)善(shan)勞動關(guan)系群體性事件(jian)(jian)預防和(he)應(ying)急處置機(ji)(ji)制(zhi)。依托協(xie)(xie)調勞動關(guan)系三方(fang)機(ji)(ji)制(zhi),建(jian)立勞動關(guan)系群體性糾紛(fen)排查和(he)動態監(jian)測(ce)預警制(zhi)度(du),完(wan)善(shan)協(xie)(xie)調處理集(ji)體協(xie)(xie)商爭議辦法(fa),有效調處因簽訂集(ji)體合同(tong)發生的爭議事件(jian)(jian)。健全多部門共(gong)同(tong)參與的群體性事件(jian)(jian)應(ying)急聯動處置機(ji)(ji)制(zhi),督(du)促指導企業落實主體責(ze)任,及時妥善(shan)處置群體性事件(jian)(jian),維護(hu)社會(hui)和(he)諧穩定。

今年以來解決拖欠工資4410萬元

記者(zhe)從11日召開的全(quan)市(shi)構建(jian)和(he)諧勞(lao)(lao)動關(guan)系工(gong)作會議(yi)上了(le)(le)解(jie)到,近年來(lai),全(quan)市(shi)勞(lao)(lao)動關(guan)系工(gong)作逐步由注(zhu)重治標向標本(ben)兼治轉變(bian),勞(lao)(lao)動關(guan)系保(bao)(bao)持總體穩定(ding)。今年以來(lai),全(quan)市(shi)各級勞(lao)(lao)動保(bao)(bao)障監察機構受理投訴、舉(ju)報295起,督(du)促用人單位與6397名(ming)職工(gong)簽訂勞(lao)(lao)動合同,解(jie)決拖欠工(gong)資4410萬(wan)(wan)元,補繳社會保(bao)(bao)險費6623.66萬(wan)(wan)元;勞(lao)(lao)動人事調解(jie)仲裁機構處理爭議(yi)案件464件,為勞(lao)(lao)動者(zhe)挽回損失1533.97元,切實維護了(le)(le)職工(gong)的合法權益。
