山東省聊城將推農民工實名制工資卡管理

記者從11日召開的全市構建和諧勞動關系工作會議上了解到,為扎實做好構建和諧勞動關系的各項工作,聊城市將著力解決好當前勞動關系的三項重點工作。為及時處理拖欠農民工工資問題,將在建設領域和欠薪多發行業普遍建立用人單位繳納工作保證金制度,在欠薪多發的部分縣(市、區)建立完善欠薪應急周轉金制度。

市人社局(ju)相關(guan)(guan)負(fu)責(ze)人表示,今后將日(ri)常巡(xun)查和重(zhong)點(dian)檢查相結合(he),及時處理拖(tuo)欠(qian)農民(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti)。積(ji)極開展(zhan)農民(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)支付(fu)、清理整頓(dun)人力資(zi)(zi)源市場、勞(lao)動(dong)用(yong)工(gong)(gong)(gong)與社會(hui)保(bao)險(xian)等專項執法(fa)檢查。進一步擴大勞(lao)動(dong)保(bao)障年檢、日(ri)常巡(xun)查范圍,及時受理勞(lao)動(dong)者投訴舉(ju)報,處理好勞(lao)動(dong)者的(de)利益訴求。妥善(shan)處理拖(tuo)欠(qian)農民(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti),在建設領(ling)域和欠(qian)薪多(duo)發行業普遍建立(li)用(yong)人單位繳納工(gong)(gong)(gong)作保(bao)證金制(zhi)度(du),在欠(qian)薪多(duo)發的(de)部分縣(市、區)建立(li)完善(shan)欠(qian)薪應急(ji)周轉金制(zhi)度(du),全面推(tui)行農民(min)(min)工(gong)(gong)(gong)實名制(zhi)工(gong)(gong)(gong)資(zi)(zi)卡管理,督促(cu)企業落實按月足(zu)額支付(fu)工(gong)(gong)(gong)資(zi)(zi)的(de)有關(guan)(guan)法(fa)律規(gui)定。建立(li)勞(lao)動(dong)保(bao)障監(jian)察執法(fa)和刑事司法(fa)聯(lian)動(dong)機制(zhi),嚴厲(li)打擊惡(e)意欠(qian)薪行為,切實解決(jue)拖(tuo)欠(qian)職工(gong)(gong)(gong)特別是農民(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti)。

其次,將(jiang)抓好(hao)(hao)“兩網化(hua)”建(jian)設工(gong)(gong)(gong)作。強化(hua)措施,通過調度(du)(du)、考評等(deng)方式,確(que)保市(shi)縣兩級實現“兩網化(hua)”100%全覆(fu)蓋(gai)。完善“兩網化(hua)”規范化(hua)建(jian)設,積極做好(hao)(hao)全省聯網統一受理和查處投(tou)訴舉報案件的(de)相關(guan)工(gong)(gong)(gong)作,建(jian)立協管員管理制度(du)(du)、用工(gong)(gong)(gong)信(xin)息采集制度(du)(du)、網格(ge)巡查等(deng)相關(guan)制度(du)(du),明確(que)工(gong)(gong)(gong)作職責(ze),規范工(gong)(gong)(gong)作程(cheng)序,做好(hao)(hao)系統更新維護,為實現全省統一聯網的(de)有效銜接打好(hao)(hao)基(ji)礎。

此(ci)外,將大力推(tui)進同(tong)工(gong)(gong)同(tong)酬分配原則落(luo)實。加大工(gong)(gong)作力度,規范勞(lao)務派遣(qian)經營行為,引導督促用人單位(wei)按(an)照法(fa)律要求調整用工(gong)(gong)比例,依法(fa)及時(shi)繳納(na)社會保(bao)險,對只交一項工(gong)(gong)傷保(bao)險或侵(qin)犯派遣(qian)人員(yuan)權益(yi)的情況要嚴格管控和檢查,維護好(hao)勞(lao)務派遣(qian)職工(gong)(gong)的合法(fa)權益(yi)。嚴格落(luo)實機關(guan)事業單位(wei)未納(na)入正式職工(gong)(gong)管理人員(yuan)的有關(guan)規定,逐步(bu)提高他(ta)們的收(shou)入水平,全面落(luo)實這(zhe)部分人員(yuan)參加社會保(bao)險政策(ce),切實維護其合法(fa)權益(yi)。

全面實行勞動合同制度 健全(quan)勞動關(guan)系協調機制

今后(hou),我市將全(quan)面實(shi)(shi)行勞(lao)動(dong)(dong)合同(tong)(tong)制度(du)。繼(ji)續加(jia)大工(gong)(gong)作(zuo)力度(du),在(zai)用工(gong)(gong)季節性(xing)強、職工(gong)(gong)流動(dong)(dong)性(xing)大的行業(ye)(ye)推廣簡易勞(lao)動(dong)(dong)合同(tong)(tong)示范(fan)文本,規(gui)范(fan)勞(lao)動(dong)(dong)合同(tong)(tong)訂(ding)(ding)立、履行、變更(geng)、解除、終(zhong)止等行為(wei),切實(shi)(shi)提(ti)高勞(lao)動(dong)(dong)合同(tong)(tong)簽(qian)(qian)(qian)訂(ding)(ding)率和履行質量。深入實(shi)(shi)施農(nong)民(min)工(gong)(gong)權益保障3年(nian)行動(dong)(dong)計劃,確(que)保在(zai)城鎮(zhen)穩(wen)定就業(ye)(ye)的農(nong)民(min)工(gong)(gong)勞(lao)動(dong)(dong)合同(tong)(tong)簽(qian)(qian)(qian)訂(ding)(ding)率達到85%以(yi)上,建筑、餐飲、居民(min)服務等流動(dong)(dong)性(xing)較(jiao)強的行業(ye)(ye)農(nong)民(min)工(gong)(gong)勞(lao)動(dong)(dong)合同(tong)(tong)簽(qian)(qian)(qian)訂(ding)(ding)率達到55%以(yi)上。

大力推進集(ji)體(ti)(ti)合(he)(he)同(tong)制度。著(zhu)力提升集(ji)體(ti)(ti)協商質量,增(zeng)強集(ji)體(ti)(ti)合(he)(he)同(tong)實效(xiao),逐(zhu)步形(xing)成規(gui)范(fan)有效(xiao)的集(ji)體(ti)(ti)協商機制,暢通職(zhi)(zhi)工利益(yi)訴求表達渠道。扎實推進集(ji)體(ti)(ti)合(he)(he)同(tong)制度三年行動(dong)攻堅(jian)計(ji)劃,推動(dong)企業與(yu)職(zhi)(zhi)工就工作條件、勞動(dong)定額、女職(zhi)(zhi)工特殊(shu)保護(hu)等開展集(ji)體(ti)(ti)協商,訂立集(ji)體(ti)(ti)合(he)(he)同(tong)。加強對集(ji)體(ti)(ti)協商過程的指導,督促企業和(he)職(zhi)(zhi)工認真履行集(ji)體(ti)(ti)合(he)(he)同(tong)。

此外,將進一步(bu)(bu)健全協(xie)調勞(lao)動(dong)(dong)關(guan)系三(san)方(fang)(fang)(fang)機(ji)制。在完(wan)善市、縣協(xie)調勞(lao)動(dong)(dong)關(guan)系三(san)方(fang)(fang)(fang)機(ji)制基礎上(shang),積極(ji)推(tui)動(dong)(dong)有條件的工(gong)業(ye)園區、鄉鎮(街道)和產業(ye)系統建(jian)立(li)三(san)方(fang)(fang)(fang)機(ji)制。創新三(san)方(fang)(fang)(fang)機(ji)制組織(zhi)建(jian)設,建(jian)立(li)協(xie)調勞(lao)動(dong)(dong)關(guan)系三(san)方(fang)(fang)(fang)委員會(hui),逐步(bu)(bu)做實(shi)三(san)方(fang)(fang)(fang)機(ji)制的辦事(shi)機(ji)構(gou)。完(wan)善三(san)方(fang)(fang)(fang)機(ji)制職(zhi)能,加強工(gong)作制度建(jian)設,充(chong)分發揮(hui)政府、工(gong)會(hui)和企業(ye)代表組織(zhi)共同研(yan)究解決有關(guan)勞(lao)動(dong)(dong)關(guan)系重(zhong)大問題的重(zhong)要(yao)作用(yong)。

完善勞動關系矛盾調處機制

為了更進一步推進構(gou)建和諧(xie)勞動關系工作,我(wo)市(shi)將完善勞動關系矛盾調處(chu)機制。

健全勞動爭(zheng)(zheng)議調(diao)(diao)解(jie)(jie)(jie)仲裁機制。堅持“鼓勵和(he)(he)解(jie)(jie)(jie)、強(qiang)化(hua)調(diao)(diao)解(jie)(jie)(jie)、加(jia)快仲裁、銜接(jie)訴訟(song)”原則,大力(li)(li)加(jia)強(qiang)勞動爭(zheng)(zheng)議調(diao)(diao)解(jie)(jie)(jie)工(gong)(gong)作(zuo)(zuo),健全專業性(xing)調(diao)(diao)解(jie)(jie)(jie)與人民調(diao)(diao)解(jie)(jie)(jie)、行政調(diao)(diao)解(jie)(jie)(jie)、仲裁調(diao)(diao)解(jie)(jie)(jie)、司法(fa)調(diao)(diao)解(jie)(jie)(jie)聯動工(gong)(gong)作(zuo)(zuo)體系(xi)。深入推進(jin)示(shi)范(fan)仲裁院創建(jian)活動和(he)(he)調(diao)(diao)解(jie)(jie)(jie)仲裁效能(neng)建(jian)設督查活動,提(ti)升仲裁工(gong)(gong)作(zuo)(zuo)標準化(hua)、規范(fan)化(hua)、專業化(hua)水平;加(jia)強(qiang)基層調(diao)(diao)解(jie)(jie)(jie)規范(fan)化(hua)建(jian)設,完善區域性(xing)、行業性(xing)調(diao)(diao)解(jie)(jie)(jie)組織和(he)(he)工(gong)(gong)作(zuo)(zuo)機制,提(ti)高企業自主解(jie)(jie)(jie)決爭(zheng)(zheng)議能(neng)力(li)(li);依法(fa)加(jia)大先行裁決、先予執行裁決、終局裁決力(li)(li)度,不斷提(ti)高爭(zheng)(zheng)議處(chu)理效能(neng);加(jia)強(qiang)裁審銜接(jie)與工(gong)(gong)作(zuo)(zuo)協調(diao)(diao),切(qie)實提(ti)高仲裁辦案效率和(he)(he)公信(xin)力(li)(li)。

健(jian)全(quan)勞(lao)(lao)動(dong)(dong)(dong)保障監(jian)察體制(zhi)機制(zhi)。改革勞(lao)(lao)動(dong)(dong)(dong)保障監(jian)察執(zhi)法(fa)體制(zhi),加快推(tui)(tui)進綜合執(zhi)法(fa),理順不同層(ceng)級執(zhi)法(fa)職能,全(quan)力(li)推(tui)(tui)動(dong)(dong)(dong)監(jian)察執(zhi)法(fa)重心下移。強(qiang)化縣以下勞(lao)(lao)動(dong)(dong)(dong)保障執(zhi)法(fa)能力(li)建(jian)設(she),實現監(jian)察執(zhi)法(fa)向主動(dong)(dong)(dong)預防和(he)統籌城鄉(xiang)轉(zhuan)變。加大(da)對非法(fa)用工尤其是大(da)案(an)要案(an)的查處力(li)度(du)(du),嚴厲打擊使用童工、拒不支付勞(lao)(lao)動(dong)(dong)(dong)報酬等違(wei)法(fa)犯罪行(xing)為。完(wan)善企業勞(lao)(lao)動(dong)(dong)(dong)保障誠(cheng)信評(ping)價(jia)制(zhi)度(du)(du),組織好誠(cheng)信企業評(ping)選活動(dong)(dong)(dong),建(jian)立健(jian)全(quan)企業誠(cheng)信檔案(an)。

完善(shan)勞動關(guan)系(xi)群(qun)體(ti)(ti)(ti)性(xing)事(shi)(shi)件預防和(he)(he)應急處(chu)置(zhi)機制(zhi)。依托協調(diao)勞動關(guan)系(xi)三方(fang)機制(zhi),建(jian)立勞動關(guan)系(xi)群(qun)體(ti)(ti)(ti)性(xing)糾紛排查和(he)(he)動態(tai)監測預警制(zhi)度(du),完善(shan)協調(diao)處(chu)理集(ji)體(ti)(ti)(ti)協商爭議辦(ban)法,有(you)效調(diao)處(chu)因簽訂集(ji)體(ti)(ti)(ti)合(he)同發生的(de)爭議事(shi)(shi)件。健全多(duo)部門(men)共同參與的(de)群(qun)體(ti)(ti)(ti)性(xing)事(shi)(shi)件應急聯(lian)動處(chu)置(zhi)機制(zhi),督(du)促指導(dao)企業落(luo)實主體(ti)(ti)(ti)責(ze)任,及(ji)時妥善(shan)處(chu)置(zhi)群(qun)體(ti)(ti)(ti)性(xing)事(shi)(shi)件,維護(hu)社會和(he)(he)諧穩定(ding)。

今年以來解決拖欠工資4410萬元

記者從11日(ri)召(zhao)開的全市(shi)(shi)構建和諧勞(lao)(lao)動(dong)(dong)關(guan)系工作會議上了解(jie)到,近年(nian)來(lai),全市(shi)(shi)勞(lao)(lao)動(dong)(dong)關(guan)系工作逐步由(you)注重治標(biao)向標(biao)本兼治轉變,勞(lao)(lao)動(dong)(dong)關(guan)系保持總(zong)體穩(wen)定。今(jin)年(nian)以(yi)來(lai),全市(shi)(shi)各級勞(lao)(lao)動(dong)(dong)保障(zhang)監察(cha)機(ji)構受(shou)理(li)投訴(su)、舉報295起(qi),督促(cu)用人單位與6397名職(zhi)工簽訂(ding)勞(lao)(lao)動(dong)(dong)合同,解(jie)決拖(tuo)欠工資4410萬(wan)元(yuan),補(bu)繳社會保險費6623.66萬(wan)元(yuan);勞(lao)(lao)動(dong)(dong)人事調解(jie)仲裁機(ji)構處理(li)爭議案件464件,為(wei)勞(lao)(lao)動(dong)(dong)者挽回損(sun)失(shi)1533.97元(yuan),切實維(wei)護了職(zhi)工的合法權益。
