“末位淘汰”制度合法嗎?

我是一(yi)名銷售(shou)員,現在(zai)正在(zai)濟南(nan)一(yi)家(jia)藥械銷售(shou)公司工作,“末位淘汰(tai)”制度合法嗎?

“末位(wei)(wei)(wei)淘汰(tai)”作為一項(xiang)企事業單(dan)位(wei)(wei)(wei)內部的(de)考核辦法(fa)(fa),作為一種(zhong)激勵機(ji)制,并(bing)不(bu)與法(fa)(fa)相悖。但如(ru)果把“末位(wei)(wei)(wei)淘汰(tai)”制度(du)用到聘(pin)用關(guan)系(xi)(xi)上,凡是(shi)(shi)“末位(wei)(wei)(wei)”,不(bu)分青紅(hong)皂白就予(yu)(yu)以(yi)淘汰(tai)的(de)做法(fa)(fa)是(shi)(shi)值得質疑的(de)。 這里通(tong)常有兩種(zhong)情況(kuang): 一是(shi)(shi)雙方在勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)中約(yue)定,單(dan)位(wei)(wei)(wei)可以(yi)以(yi)“末位(wei)(wei)(wei)淘汰(tai)”來解(jie)聘(pin)職工(gong),當出現“末位(wei)(wei)(wei)”情形時(shi),按約(yue)解(jie)除(chu)合(he)同(tong)(tong)關(guan)系(xi)(xi),不(bu)存在什么問題。 二雙方并(bing)沒(mei)有在勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)中約(yue)定這一條,單(dan)位(wei)(wei)(wei)單(dan)方面以(yi)“末位(wei)(wei)(wei)淘汰(tai)”為由(you)解(jie)除(chu)合(he)同(tong)(tong)關(guan)系(xi)(xi),就于法(fa)(fa)不(bu)符。 根據《勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)(fa)》規(gui)定,勞(lao)動(dong)(dong)(dong)者(zhe)不(bu)能(neng)勝(sheng)任(ren)工(gong)作,單(dan)位(wei)(wei)(wei)首先要給予(yu)(yu)培(pei)訓(xun)或者(zhe)調(diao)整工(gong)作崗位(wei)(wei)(wei),勞(lao)動(dong)(dong)(dong)者(zhe)仍不(bu)能(neng)勝(sheng)任(ren)工(gong)作的(de),單(dan)位(wei)(wei)(wei)才可以(yi)解(jie)除(chu)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong),還要給予(yu)(yu)經濟補償(chang)。這一規(gui)定就給予(yu)(yu)了職工(gong)一個培(pei)訓(xun)和(he)調(diao)整工(gong)作崗位(wei)(wei)(wei)的(de)過程。
