答 “末位(wei)(wei)(wei)淘汰(tai)”作(zuo)為(wei)一(yi)(yi)(yi)項企(qi)事業(ye)單(dan)位(wei)(wei)(wei)內部(bu)的(de)考(kao)核(he)辦法,作(zuo)為(wei)一(yi)(yi)(yi)種激勵機制,并(bing)不與法相悖(bei)。但如(ru)果把“末位(wei)(wei)(wei)淘汰(tai)”制度用到聘用關(guan)系(xi)上,凡是(shi)“末位(wei)(wei)(wei)”,不分青紅(hong)皂白就(jiu)予(yu)以淘汰(tai)的(de)做法是(shi)值得質疑的(de)。 這里通常有(you)兩種情況: 一(yi)(yi)(yi)是(shi)雙方(fang)(fang)在(zai)勞(lao)動(dong)合(he)同(tong)中約(yue)定(ding)(ding),單(dan)位(wei)(wei)(wei)可以以“末位(wei)(wei)(wei)淘汰(tai)”來解(jie)(jie)(jie)聘職工(gong)(gong),當出現“末位(wei)(wei)(wei)”情形時,按約(yue)解(jie)(jie)(jie)除合(he)同(tong)關(guan)系(xi),不存(cun)在(zai)什么問題。 二雙方(fang)(fang)并(bing)沒有(you)在(zai)勞(lao)動(dong)合(he)同(tong)中約(yue)定(ding)(ding)這一(yi)(yi)(yi)條,單(dan)位(wei)(wei)(wei)單(dan)方(fang)(fang)面以“末位(wei)(wei)(wei)淘汰(tai)”為(wei)由(you)解(jie)(jie)(jie)除合(he)同(tong)關(guan)系(xi),就(jiu)于法不符。 根據(ju)《勞(lao)動(dong)合(he)同(tong)法》規(gui)定(ding)(ding),勞(lao)動(dong)者不能(neng)勝任工(gong)(gong)作(zuo),單(dan)位(wei)(wei)(wei)首先要(yao)給予(yu)培訓或者調整(zheng)工(gong)(gong)作(zuo)崗位(wei)(wei)(wei),勞(lao)動(dong)者仍(reng)不能(neng)勝任工(gong)(gong)作(zuo)的(de),單(dan)位(wei)(wei)(wei)才可以解(jie)(jie)(jie)除勞(lao)動(dong)合(he)同(tong),還要(yao)給予(yu)經濟補償(chang)。這一(yi)(yi)(yi)規(gui)定(ding)(ding)就(jiu)給予(yu)了職工(gong)(gong)一(yi)(yi)(yi)個(ge)培訓和調整(zheng)工(gong)(gong)作(zuo)崗位(wei)(wei)(wei)的(de)過程。
