關于單位長時間加班不付加班費問題可不可以告公司?

最近廠(chang)里安排每隔一(yi)天就加(jia)班(ban)一(yi)次,加(jia)到晚上9點,第2天遲點上班(ban)不(bu)付(fu)加(jia)班(ban)工資,如果我(wo)匿名舉報該公(gong)司,是否(fou)(fou)(fou)有(you)法律依據(ju)?相關部(bu)門(men)能否(fou)(fou)(fou)責(ze)令該公(gong)司整改,禁止加(jia)班(ban),否(fou)(fou)(fou)則予以處罰(fa)?

勞(lao)動(dong)法中(zhong)規定用人(ren)(ren)單位需(xu)加(jia)(jia)(jia)班(ban)(ban)的(de)(de)(de)(de)(de),均應(ying)與(yu)工(gong)(gong)(gong)會(hui)和勞(lao)動(dong)者(zhe)協(xie)商后才可(ke)加(jia)(jia)(jia)班(ban)(ban),而且每日(ri)加(jia)(jia)(jia)班(ban)(ban)一(yi)般不(bu)得超(chao)過一(yi)小時(shi)(shi),因(yin)特殊原因(yin)的(de)(de)(de)(de)(de),則(ze)應(ying)在保(bao)(bao)障勞(lao)動(dong)者(zhe)身體健康的(de)(de)(de)(de)(de)條件下延長工(gong)(gong)(gong)作(zuo)時(shi)(shi)間每日(ri)不(bu)得超(chao)過三小時(shi)(shi),每月加(jia)(jia)(jia)班(ban)(ban)累(lei)計不(bu)得超(chao)過三十六小時(shi)(shi)。根據(ju)《中(zhong)華人(ren)(ren)民共和國勞(lao)動(dong)法》第(di)四十四條規定:安(an)排(pai)(pai)(pai)勞(lao)動(dong)者(zhe)在法定標準工(gong)(gong)(gong)作(zuo)時(shi)(shi)間以外加(jia)(jia)(jia)班(ban)(ban)的(de)(de)(de)(de)(de),應(ying)按照(zhao)不(bu)低于勞(lao)動(dong)者(zhe)本(ben)人(ren)(ren)小時(shi)(shi)工(gong)(gong)(gong)資(zi)(zi)的(de)(de)(de)(de)(de)150%支付加(jia)(jia)(jia)班(ban)(ban)工(gong)(gong)(gong)資(zi)(zi);安(an)排(pai)(pai)(pai)勞(lao)動(dong)者(zhe)在休息日(ri)加(jia)(jia)(jia)班(ban)(ban)的(de)(de)(de)(de)(de),應(ying)首先安(an)排(pai)(pai)(pai)其補(bu)休,不(bu)能安(an)排(pai)(pai)(pai)補(bu)休的(de)(de)(de)(de)(de),按照(zhao)不(bu)低于勞(lao)動(dong)者(zhe)本(ben)人(ren)(ren)日(ri)或小時(shi)(shi)工(gong)(gong)(gong)資(zi)(zi)的(de)(de)(de)(de)(de)200%支付加(jia)(jia)(jia)班(ban)(ban)工(gong)(gong)(gong)資(zi)(zi);安(an)排(pai)(pai)(pai)勞(lao)動(dong)者(zhe)在法定休假日(ri)加(jia)(jia)(jia)班(ban)(ban)的(de)(de)(de)(de)(de),應(ying)按照(zhao)不(bu)低于勞(lao)動(dong)者(zhe)本(ben)人(ren)(ren)日(ri)或小時(shi)(shi)工(gong)(gong)(gong)資(zi)(zi)的(de)(de)(de)(de)(de)300%支付加(jia)(jia)(jia)班(ban)(ban)工(gong)(gong)(gong)資(zi)(zi)。你可(ke)以根據(ju)勞(lao)動(dong)法保(bao)(bao)障你的(de)(de)(de)(de)(de)權利不(bu)受害。
