答(da) 病假(jia)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)(de)基數按(an)照(zhao)以下三(san)個(ge)原則確定(ding)(ding)(ding)(ding): (1)勞(lao)(lao)動合(he)同有約(yue)定(ding)(ding)(ding)(ding)的(de)(de),按(an)不(bu)低(di)于勞(lao)(lao)動合(he)同約(yue)定(ding)(ding)(ding)(ding)的(de)(de)勞(lao)(lao)動者(zhe)本人所在崗位(wei)(職(zhi)位(wei))相對應(ying)(ying)的(de)(de)工(gong)(gong)(gong)資(zi)(zi)(zi)標(biao)準確定(ding)(ding)(ding)(ding)。集(ji)體(ti)合(he)同(工(gong)(gong)(gong)資(zi)(zi)(zi)集(ji)體(ti)協議)確定(ding)(ding)(ding)(ding)的(de)(de)標(biao)準高于勞(lao)(lao)動合(he)同約(yue)定(ding)(ding)(ding)(ding)標(biao)準的(de)(de),按(an)集(ji)體(ti)合(he)同(工(gong)(gong)(gong)資(zi)(zi)(zi)集(ji)體(ti)協議)標(biao)準確定(ding)(ding)(ding)(ding)。(2)勞(lao)(lao)動合(he)同、集(ji)體(ti)合(he)同均未約(yue)定(ding)(ding)(ding)(ding)的(de)(de),可由用人單位(wei)與職(zhi)工(gong)(gong)(gong)代表通(tong)過(guo)工(gong)(gong)(gong)資(zi)(zi)(zi)集(ji)體(ti)協商(shang)確定(ding)(ding)(ding)(ding),協商(shang)結(jie)果應(ying)(ying)簽訂工(gong)(gong)(gong)資(zi)(zi)(zi)集(ji)體(ti)協議。(3)用人單位(wei)與勞(lao)(lao)動者(zhe)無任(ren)何約(yue)定(ding)(ding)(ding)(ding)的(de)(de),假(jia)期(qi)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)(de)計(ji)算(suan)(suan)基數統一按(an)勞(lao)(lao)動者(zhe)本人所在崗位(wei)(職(zhi)位(wei))正(zheng)常(chang)出(chu)勤的(de)(de)月工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)(de)70%確定(ding)(ding)(ding)(ding)。此外,按(an)以上三(san)個(ge)原則計(ji)算(suan)(suan)的(de)(de)假(jia)期(qi)工(gong)(gong)(gong)資(zi)(zi)(zi)基數均不(bu)得低(di)于本市規定(ding)(ding)(ding)(ding)的(de)(de)最低(di)工(gong)(gong)(gong)資(zi)(zi)(zi)標(biao)準。
