答 病假工(gong)(gong)資(zi)(zi)的(de)(de)(de)(de)基數按(an)照以下三(san)個原則確(que)定(ding)(ding)(ding): (1)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同有約(yue)定(ding)(ding)(ding)的(de)(de)(de)(de),按(an)不低于勞(lao)(lao)(lao)(lao)動(dong)(dong)合同約(yue)定(ding)(ding)(ding)的(de)(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)者本(ben)人(ren)所在崗(gang)位(職位)相對(dui)應(ying)的(de)(de)(de)(de)工(gong)(gong)資(zi)(zi)標(biao)(biao)準(zhun)確(que)定(ding)(ding)(ding)。集(ji)體(ti)合同(工(gong)(gong)資(zi)(zi)集(ji)體(ti)協(xie)議(yi))確(que)定(ding)(ding)(ding)的(de)(de)(de)(de)標(biao)(biao)準(zhun)高于勞(lao)(lao)(lao)(lao)動(dong)(dong)合同約(yue)定(ding)(ding)(ding)標(biao)(biao)準(zhun)的(de)(de)(de)(de),按(an)集(ji)體(ti)合同(工(gong)(gong)資(zi)(zi)集(ji)體(ti)協(xie)議(yi))標(biao)(biao)準(zhun)確(que)定(ding)(ding)(ding)。(2)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同、集(ji)體(ti)合同均(jun)未約(yue)定(ding)(ding)(ding)的(de)(de)(de)(de),可由(you)用(yong)人(ren)單位與職工(gong)(gong)代表通(tong)過工(gong)(gong)資(zi)(zi)集(ji)體(ti)協(xie)商確(que)定(ding)(ding)(ding),協(xie)商結果(guo)應(ying)簽訂工(gong)(gong)資(zi)(zi)集(ji)體(ti)協(xie)議(yi)。(3)用(yong)人(ren)單位與勞(lao)(lao)(lao)(lao)動(dong)(dong)者無任何約(yue)定(ding)(ding)(ding)的(de)(de)(de)(de),假期(qi)工(gong)(gong)資(zi)(zi)的(de)(de)(de)(de)計算基數統(tong)一(yi)按(an)勞(lao)(lao)(lao)(lao)動(dong)(dong)者本(ben)人(ren)所在崗(gang)位(職位)正常出勤的(de)(de)(de)(de)月工(gong)(gong)資(zi)(zi)的(de)(de)(de)(de)70%確(que)定(ding)(ding)(ding)。此外(wai),按(an)以上三(san)個原則計算的(de)(de)(de)(de)假期(qi)工(gong)(gong)資(zi)(zi)基數均(jun)不得低于本(ben)市規定(ding)(ding)(ding)的(de)(de)(de)(de)最(zui)低工(gong)(gong)資(zi)(zi)標(biao)(biao)準(zhun)。
