根據(ju)《勞動法》規(gui)定(ding)有下列(lie)情形(xing)之(zhi)一的(de),用人單位(wei)應(ying)當按照下列(lie)標準支(zhi)付高(gao)于(yu)勞動者(zhe)正常(chang)工(gong)(gong)(gong)作(zuo)時(shi)間(jian)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)工(gong)(gong)(gong)資(zi)(zi)(zi)報酬:1.勞動者(zhe)延長工(gong)(gong)(gong)作(zuo)時(shi)間(jian)的(de),支(zhi)付不(bu)(bu)(bu)低于(yu)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)百分之(zhi)一百五十的(de)工(gong)(gong)(gong)資(zi)(zi)(zi)報酬;2.日安排勞動者(zhe)工(gong)(gong)(gong)作(zuo)又(you)不(bu)(bu)(bu)能安排補休的(de),支(zhi)付不(bu)(bu)(bu)低于(yu)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)百分之(zhi)二百的(de)工(gong)(gong)(gong)資(zi)(zi)(zi)報酬;3.休假(jia)日安排勞動者(zhe)工(gong)(gong)(gong)作(zuo)的(de),支(zhi)付不(bu)(bu)(bu)低于(yu)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)百分之(zhi)三百的(de)工(gong)(gong)(gong)資(zi)(zi)(zi)報酬。但法定(ding)休假(jia)日工(gong)(gong)(gong)作(zuo)不(bu)(bu)(bu)能以調休替代。
