我是一名(ming)職場新人,最近公司老加班,想知道有(you)哪種情形(xing)用人單位需要支付加班費(fei)?

根據《勞(lao)動(dong)(dong)法》規定(ding)有下列情形(xing)之一(yi)的(de),用人單位應當按照下列標準支(zhi)(zhi)付(fu)高于(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)正常工(gong)(gong)(gong)作(zuo)時(shi)間(jian)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)工(gong)(gong)(gong)資(zi)(zi)(zi)報酬(chou):1.勞(lao)動(dong)(dong)者(zhe)(zhe)延(yan)長(chang)工(gong)(gong)(gong)作(zuo)時(shi)間(jian)的(de),支(zhi)(zhi)付(fu)不(bu)低于(yu)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)百分(fen)之一(yi)百五十的(de)工(gong)(gong)(gong)資(zi)(zi)(zi)報酬(chou);2.日(ri)安排(pai)(pai)勞(lao)動(dong)(dong)者(zhe)(zhe)工(gong)(gong)(gong)作(zuo)又不(bu)能安排(pai)(pai)補休(xiu)(xiu)的(de),支(zhi)(zhi)付(fu)不(bu)低于(yu)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)百分(fen)之二百的(de)工(gong)(gong)(gong)資(zi)(zi)(zi)報酬(chou);3.休(xiu)(xiu)假日(ri)安排(pai)(pai)勞(lao)動(dong)(dong)者(zhe)(zhe)工(gong)(gong)(gong)作(zuo)的(de),支(zhi)(zhi)付(fu)不(bu)低于(yu)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)百分(fen)之三百的(de)工(gong)(gong)(gong)資(zi)(zi)(zi)報酬(chou)。但法定(ding)休(xiu)(xiu)假日(ri)工(gong)(gong)(gong)作(zuo)不(bu)能以(yi)調休(xiu)(xiu)替代。
