主要由以下幾(ji)種情況(1)用人單位故意拖延不(bu)訂(ding)(ding)立(li)勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong),即招(zhao)用后(hou)故意不(bu)按規定(ding)(ding)訂(ding)(ding)立(li)勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)以及勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)到期后(hou)故意不(bu)及時續(xu)訂(ding)(ding)勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的;(2)由于用人單位的原因訂(ding)(ding)立(li)無(wu)效(xiao)勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong),或(huo)訂(ding)(ding)立(li)部分無(wu)效(xiao)勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的;(3)用人單位違反(fan)規定(ding)(ding)或(huo)勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的約(yue)定(ding)(ding)侵害女職工或(huo)未成年工合(he)法權(quan)益的;(4)用人單位違反(fan)規定(ding)(ding)或(huo)勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的約(yue)定(ding)(ding)解除勞(lao)(lao)動(dong)合(he)同(tong)(tong)(tong)的。
