試用期間,用人單位能隨便辭退員工嗎?

答 勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)中,對試(shi)用(yong)期解約的(de)(de)(de)規(gui)定(ding)(ding)有限制,企業對勞(lao)(lao)動(dong)(dong)者(zhe)不(bu)(bu)能(neng)說辭(ci)就辭(ci)。勞(lao)(lao)動(dong)(dong)法(fa)規(gui)定(ding)(ding),試(shi)用(yong)期用(yong)人(ren)單位(wei)(wei)可解除勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)的(de)(de)(de)情形只有以下幾種: 1、在(zai)試(shi)用(yong)期間(jian)被證明不(bu)(bu)符(fu)合(he)錄用(yong)條件的(de)(de)(de); 2、嚴(yan)(yan)重(zhong)違反用(yong)人(ren)單位(wei)(wei)的(de)(de)(de)規(gui)章制度(du)的(de)(de)(de);嚴(yan)(yan)重(zhong)失職,營私(si)舞弊(bi),給用(yong)人(ren)單位(wei)(wei)造成重(zhong)大損害的(de)(de)(de); 3、勞(lao)(lao)動(dong)(dong)者(zhe)同(tong)(tong)時(shi)與(yu)其他(ta)用(yong)人(ren)單位(wei)(wei)建立勞(lao)(lao)動(dong)(dong)關系,對完(wan)成本(ben)單位(wei)(wei)的(de)(de)(de)工(gong)作任(ren)務造成嚴(yan)(yan)重(zhong)影響,或者(zhe)經(jing)用(yong)人(ren)單位(wei)(wei)提出,拒不(bu)(bu)改正的(de)(de)(de); 4、因《勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)法(fa)》第二十六條第一(yi)款第一(yi)項規(gui)定(ding)(ding)的(de)(de)(de)情形致使(shi)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)無效的(de)(de)(de);被依法(fa)追究刑(xing)事(shi)責任(ren)的(de)(de)(de); 5、勞(lao)(lao)動(dong)(dong)者(zhe)患病或者(zhe)非因工(gong)負傷,在(zai)規(gui)定(ding)(ding)的(de)(de)(de)醫療期滿(man)后不(bu)(bu)能(neng)從(cong)事(shi)原工(gong)作,也不(bu)(bu)能(neng)從(cong)事(shi)由用(yong)人(ren)單位(wei)(wei)另(ling)行(xing)安排的(de)(de)(de)工(gong)作的(de)(de)(de);勞(lao)(lao)動(dong)(dong)者(zhe)不(bu)(bu)能(neng)勝任(ren)工(gong)作,經(jing)過培訓或者(zhe)調整(zheng)工(gong)作崗(gang)位(wei)(wei),仍不(bu)(bu)能(neng)勝任(ren)工(gong)作的(de)(de)(de)。
