試用期間,用人單位能隨便辭退員工嗎?

勞動合同中,對(dui)試用(yong)期解約的規定有限制(zhi)嗎(ma)?能否隨便辭退試用(yong)期員工?

勞動(dong)(dong)(dong)(dong)合同(tong)中,對試用(yong)(yong)期解約的(de)(de)規定有限制,企業(ye)對勞動(dong)(dong)(dong)(dong)者不(bu)(bu)能(neng)(neng)說辭就辭。勞動(dong)(dong)(dong)(dong)法(fa)規定,試用(yong)(yong)期用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei)(wei)可(ke)解除勞動(dong)(dong)(dong)(dong)合同(tong)的(de)(de)情形只有以下(xia)幾種: 1、在試用(yong)(yong)期間(jian)被證明不(bu)(bu)符合錄用(yong)(yong)條件的(de)(de); 2、嚴(yan)(yan)重(zhong)(zhong)(zhong)違反用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)規章制度的(de)(de);嚴(yan)(yan)重(zhong)(zhong)(zhong)失職,營私舞(wu)弊,給用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei)(wei)造成(cheng)重(zhong)(zhong)(zhong)大損害的(de)(de); 3、勞動(dong)(dong)(dong)(dong)者同(tong)時與其他用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei)(wei)建立勞動(dong)(dong)(dong)(dong)關系(xi),對完成(cheng)本單(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)工作任(ren)(ren)(ren)務造成(cheng)嚴(yan)(yan)重(zhong)(zhong)(zhong)影(ying)響,或者經用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei)(wei)提(ti)出,拒(ju)不(bu)(bu)改正的(de)(de); 4、因(yin)《勞動(dong)(dong)(dong)(dong)合同(tong)法(fa)》第(di)(di)二(er)十六條第(di)(di)一(yi)款第(di)(di)一(yi)項規定的(de)(de)情形致使勞動(dong)(dong)(dong)(dong)合同(tong)無效(xiao)的(de)(de);被依法(fa)追究刑事責任(ren)(ren)(ren)的(de)(de); 5、勞動(dong)(dong)(dong)(dong)者患(huan)病(bing)或者非(fei)因(yin)工負傷(shang),在規定的(de)(de)醫療期滿后不(bu)(bu)能(neng)(neng)從事原工作,也(ye)不(bu)(bu)能(neng)(neng)從事由用(yong)(yong)人單(dan)(dan)位(wei)(wei)(wei)(wei)另(ling)行安排(pai)的(de)(de)工作的(de)(de);勞動(dong)(dong)(dong)(dong)者不(bu)(bu)能(neng)(neng)勝(sheng)任(ren)(ren)(ren)工作,經過培訓或者調整工作崗位(wei)(wei)(wei)(wei),仍不(bu)(bu)能(neng)(neng)勝(sheng)任(ren)(ren)(ren)工作的(de)(de)。
