勞動關系應如何建立?

答 由于我國就業競爭(zheng)激烈的(de)(de)國情以及《勞(lao)(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)法(fa)》發展歷史,勞(lao)(lao)(lao)(lao)動(dong)關(guan)系(xi)中用人單位與勞(lao)(lao)(lao)(lao)動(dong)者雙方地位的(de)(de)不(bu)平等性(xing),造成了(le)事(shi)實勞(lao)(lao)(lao)(lao)動(dong)關(guan)系(xi)的(de)(de)存(cun)在。勞(lao)(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)是勞(lao)(lao)(lao)(lao)動(dong)關(guan)系(xi)建立(li)(li)、變更和終止的(de)(de)一種法(fa)律形式(shi)。根據《勞(lao)(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)法(fa)》第十條(tiao)的(de)(de)規定,建立(li)(li)勞(lao)(lao)(lao)(lao)動(dong)關(guan)系(xi)的(de)(de),應當(dang)及時(shi)訂立(li)(li)書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)。已經建立(li)(li)勞(lao)(lao)(lao)(lao)動(dong)關(guan)系(xi),但未同(tong)(tong)(tong)時(shi)訂立(li)(li)書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)的(de)(de),應當(dang)自用工之日起一個月(yue)內(nei)訂立(li)(li)書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)。
