答 首先(xian)規(gui)(gui)定(ding)(ding)中華人(ren)民共和(he)國境內的企業(ye)、個(ge)體(ti)經(jing)濟組(zu)織、民辦非企業(ye)單(dan)位(wei)(wei)等(deng)組(zu)織與(yu)(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)建(jian)立(li)(li)勞(lao)動(dong)(dong)關(guan)系(xi),訂(ding)立(li)(li)、履行(xing)(xing)、變(bian)(bian)更、解(jie)除或者(zhe)(zhe)終(zhong)(zhong)止(zhi)勞(lao)動(dong)(dong)合(he)同(tong),適用本法。其(qi)(qi)(qi)次規(gui)(gui)定(ding)(ding)事(shi)業(ye)單(dan)位(wei)(wei)與(yu)(yu)實行(xing)(xing)聘用制的工作人(ren)員、解(jie)除或訂(ding)立(li)(li)、履行(xing)(xing)、變(bian)(bian)更終(zhong)(zhong)止(zhi)勞(lao)動(dong)(dong)合(he)同(tong),法律、行(xing)(xing)政法規(gui)(gui)或者(zhe)(zhe)國務院另有規(gui)(gui)定(ding)(ding)的,依照其(qi)(qi)(qi)規(gui)(gui)定(ding)(ding);未作規(gui)(gui)定(ding)(ding)的,依照本法有關(guan)規(gui)(gui)定(ding)(ding)執(zhi)行(xing)(xing)。最后規(gui)(gui)定(ding)(ding)國家機關(guan)、事(shi)業(ye)單(dan)位(wei)(wei)、社會團體(ti)和(he)與(yu)(yu)其(qi)(qi)(qi)建(jian)立(li)(li)勞(lao)動(dong)(dong)關(guan)系(xi)的勞(lao)動(dong)(dong)者(zhe)(zhe),訂(ding)立(li)(li)、履行(xing)(xing)、變(bian)(bian)更、解(jie)除或終(zhong)(zhong)止(zhi)勞(lao)動(dong)(dong)合(he)同(tong),依照本法執(zhi)行(xing)(xing)。
