企業裁員還需要給員工支付經濟補償嗎?

答(da) 企(qi)業(ye)依照《企(qi)業(ye)破產法》規定進(jin)行(xing)重整(zheng),需(xu)要裁(cai)(cai)減(jian)(jian)(jian)人(ren)(ren)(ren)員(yuan)(yuan)20人(ren)(ren)(ren)以(yi)上(shang)或者裁(cai)(cai)減(jian)(jian)(jian)不足20人(ren)(ren)(ren)但占企(qi)業(ye)職(zhi)工(gong)總數百(bai)分之十以(yi)上(shang)的(de),用(yong)人(ren)(ren)(ren)單位應提前30日向(xiang)工(gong)會或者全(quan)體職(zhi)工(gong)說明情(qing)況,聽取(qu)工(gong)會或者職(zhi)工(gong)的(de)意見后,裁(cai)(cai)減(jian)(jian)(jian)人(ren)(ren)(ren)員(yuan)(yuan)方(fang)案經向(xiang)勞動行(xing)政部門報告,可以(yi)裁(cai)(cai)減(jian)(jian)(jian)人(ren)(ren)(ren)員(yuan)(yuan)。 在(zai)這(zhe)種情(qing)況下(xia)裁(cai)(cai)減(jian)(jian)(jian)人(ren)(ren)(ren)員(yuan)(yuan),用(yong)人(ren)(ren)(ren)單位應當(dang)向(xiang)勞動者支(zhi)付經濟補償。
