答(da) 首先(xian)用(yong)人單位(wei)在(zai)(zai)試(shi)用(yong)期解除(chu)勞(lao)動(dong)(dong)合(he)同(tong)(tong)的,應當向勞(lao)動(dong)(dong)者說明理由(you)。其次(ci)用(yong)人單位(wei)在(zai)(zai)試(shi)用(yong)期內解除(chu)勞(lao)動(dong)(dong)合(he)同(tong)(tong),也應當事先(xian)將理由(you)通知(zhi)工(gong)會。最后用(yong)人單位(wei)需(xu)制作《解除(chu)勞(lao)動(dong)(dong)合(he)同(tong)(tong)通知(zhi)書》送達給勞(lao)動(dong)(dong)者,同(tong)(tong)時向勞(lao)動(dong)(dong)者出具具解除(chu)或者終(zhong)止勞(lao)動(dong)(dong)合(he)同(tong)(tong)的證明,并(bing)在(zai)(zai)十五日內為勞(lao)動(dong)(dong)者辦理檔(dang)案和社會保險關系轉移手續。
