答 《勞動(dong)(dong)合(he)同(tong)法(fa)實(shi)施條例》第十條確定:勞動(dong)(dong)者非因本人原(yuan)(yuan)因從原(yuan)(yuan)用人單位(wei)(wei)被安(an)排到新用人單位(wei)(wei)工(gong)(gong)作(zuo)的,勞動(dong)(dong)者在原(yuan)(yuan)用人單位(wei)(wei)的工(gong)(gong)作(zuo)年限合(he)并計算為新用人單位(wei)(wei)的工(gong)(gong)作(zuo)年限。原(yuan)(yuan)先工(gong)(gong)作(zuo)年限不帶入新公司的,原(yuan)(yuan)公司有義務按照勞動(dong)(dong)合(he)同(tong)到期給(gei)予經濟補償金(jin)。
