答 根據《勞(lao)(lao)(lao)(lao)動(dong)合同法》第(di)4條(tiao)規(gui)定(ding),用人單位(wei)在制(zhi)定(ding)、修改或者(zhe)決定(ding)有(you)關勞(lao)(lao)(lao)(lao)動(dong)報酬、工(gong)(gong)作時(shi)(shi)間、休息(xi)休假(jia)、勞(lao)(lao)(lao)(lao)動(dong)安全衛生、保險福利、職工(gong)(gong)培(pei)訓(xun)、勞(lao)(lao)(lao)(lao)動(dong)紀律(lv)以(yi)(yi)及(ji)勞(lao)(lao)(lao)(lao)動(dong)定(ding)額管理(li)等直(zhi)接涉及(ji)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)切身利益的(de)規(gui)章制(zhi)度(du)或者(zhe)重大(da)事(shi)項(xiang)時(shi)(shi),應(ying)當經(jing)職工(gong)(gong)代(dai)表大(da)會(hui)或者(zhe)全體職工(gong)(gong)討論,提(ti)(ti)出(chu)方案和(he)意見,與工(gong)(gong)會(hui)或者(zhe)職工(gong)(gong)代(dai)表平等協商(shang)確定(ding)。在規(gui)章制(zhi)度(du)和(he)重大(da)事(shi)項(xiang)決定(ding)實施過程中,工(gong)(gong)會(hui)或者(zhe)職工(gong)(gong)認為(wei)不(bu)適當的(de),有(you)權(quan)向用人單位(wei)提(ti)(ti)出(chu),通(tong)過協商(shang)予以(yi)(yi)修改完(wan)善。通(tong)過以(yi)(yi)上條(tiao)款可以(yi)(yi)看出(chu),該法特別規(gui)定(ding)了(le)職工(gong)(gong)或者(zhe)工(gong)(gong)會(hui)對(dui)用人單位(wei)規(gui)章制(zhi)度(du)提(ti)(ti)出(chu)異議的(de)權(quan)利。較之《勞(lao)(lao)(lao)(lao)動(dong)法》的(de)規(gui)定(ding)相(xiang)比(bi),不(bu)僅進一(yi)步明確和(he)擴大(da)了(le)規(gui)章制(zhi)度(du)的(de)范(fan)圍(wei),而且對(dui)規(gui)章制(zhi)度(du)的(de)制(zhi)定(ding)、修改、實施都作出(chu)了(le)明確的(de)規(gui)定(ding)。
