答 根據《勞(lao)(lao)動(dong)(dong)合同法(fa)》第4條規(gui)(gui)定,用人單位在(zai)制(zhi)(zhi)定、修(xiu)改或者(zhe)決定有(you)關(guan)勞(lao)(lao)動(dong)(dong)報酬、工(gong)(gong)(gong)作時間、休息休假、勞(lao)(lao)動(dong)(dong)安全衛(wei)生(sheng)、保險(xian)福利(li)、職工(gong)(gong)(gong)培訓、勞(lao)(lao)動(dong)(dong)紀律以(yi)及(ji)勞(lao)(lao)動(dong)(dong)定額管理等(deng)直接涉及(ji)勞(lao)(lao)動(dong)(dong)者(zhe)切(qie)身利(li)益(yi)的(de)規(gui)(gui)章(zhang)(zhang)制(zhi)(zhi)度(du)或者(zhe)重(zhong)大(da)事(shi)項(xiang)時,應當經職工(gong)(gong)(gong)代(dai)表(biao)大(da)會(hui)或者(zhe)全體職工(gong)(gong)(gong)討(tao)論,提出(chu)方(fang)案和意見(jian),與工(gong)(gong)(gong)會(hui)或者(zhe)職工(gong)(gong)(gong)代(dai)表(biao)平(ping)等(deng)協(xie)商(shang)確定。在(zai)規(gui)(gui)章(zhang)(zhang)制(zhi)(zhi)度(du)和重(zhong)大(da)事(shi)項(xiang)決定實施過(guo)程中,工(gong)(gong)(gong)會(hui)或者(zhe)職工(gong)(gong)(gong)認為不適當的(de),有(you)權向用人單位提出(chu),通(tong)(tong)過(guo)協(xie)商(shang)予以(yi)修(xiu)改完善。通(tong)(tong)過(guo)以(yi)上條款可以(yi)看(kan)出(chu),該法(fa)特別規(gui)(gui)定了(le)職工(gong)(gong)(gong)或者(zhe)工(gong)(gong)(gong)會(hui)對(dui)用人單位規(gui)(gui)章(zhang)(zhang)制(zhi)(zhi)度(du)提出(chu)異議的(de)權利(li)。較之《勞(lao)(lao)動(dong)(dong)法(fa)》的(de)規(gui)(gui)定相比,不僅(jin)進一步明(ming)確和擴(kuo)大(da)了(le)規(gui)(gui)章(zhang)(zhang)制(zhi)(zhi)度(du)的(de)范(fan)圍,而且對(dui)規(gui)(gui)章(zhang)(zhang)制(zhi)(zhi)度(du)的(de)制(zhi)(zhi)定、修(xiu)改、實施都作出(chu)了(le)明(ming)確的(de)規(gui)(gui)定。
