答 根(gen)據《勞(lao)動(dong)合同法(fa)》第(di)4條(tiao)規(gui)(gui)定(ding)(ding),用人單(dan)位在(zai)制(zhi)(zhi)定(ding)(ding)、修(xiu)改或(huo)者(zhe)決定(ding)(ding)有關勞(lao)動(dong)報酬、工(gong)作時間(jian)、休息休假(jia)、勞(lao)動(dong)安(an)全(quan)衛生、保險福利、職(zhi)(zhi)(zhi)工(gong)培(pei)訓、勞(lao)動(dong)紀律以(yi)及勞(lao)動(dong)定(ding)(ding)額管理等直接涉及勞(lao)動(dong)者(zhe)切身利益的(de)(de)規(gui)(gui)章制(zhi)(zhi)度(du)或(huo)者(zhe)重大(da)事項時,應當經職(zhi)(zhi)(zhi)工(gong)代(dai)表(biao)(biao)大(da)會(hui)或(huo)者(zhe)全(quan)體職(zhi)(zhi)(zhi)工(gong)討論,提(ti)(ti)出(chu)(chu)(chu)方案(an)和意見,與工(gong)會(hui)或(huo)者(zhe)職(zhi)(zhi)(zhi)工(gong)代(dai)表(biao)(biao)平等協(xie)商(shang)確定(ding)(ding)。在(zai)規(gui)(gui)章制(zhi)(zhi)度(du)和重大(da)事項決定(ding)(ding)實(shi)施過程中,工(gong)會(hui)或(huo)者(zhe)職(zhi)(zhi)(zhi)工(gong)認為不適(shi)當的(de)(de),有權向用人單(dan)位提(ti)(ti)出(chu)(chu)(chu),通過協(xie)商(shang)予以(yi)修(xiu)改完善(shan)。通過以(yi)上條(tiao)款可以(yi)看出(chu)(chu)(chu),該法(fa)特別規(gui)(gui)定(ding)(ding)了職(zhi)(zhi)(zhi)工(gong)或(huo)者(zhe)工(gong)會(hui)對用人單(dan)位規(gui)(gui)章制(zhi)(zhi)度(du)提(ti)(ti)出(chu)(chu)(chu)異議的(de)(de)權利。較之《勞(lao)動(dong)法(fa)》的(de)(de)規(gui)(gui)定(ding)(ding)相比,不僅(jin)進一步明確和擴(kuo)大(da)了規(gui)(gui)章制(zhi)(zhi)度(du)的(de)(de)范圍,而且對規(gui)(gui)章制(zhi)(zhi)度(du)的(de)(de)制(zhi)(zhi)定(ding)(ding)、修(xiu)改、實(shi)施都作出(chu)(chu)(chu)了明確的(de)(de)規(gui)(gui)定(ding)(ding)。
