能辭退不簽勞動合同的員工嗎?
問 在實際生活中,有的勞(lao)動(dong)(dong)者由于個(ge)人原因不(bu)愿(yuan)意簽訂勞(lao)動(dong)(dong)合(he)同,請問像這樣情(qing)況能辭退(tui)不(bu)簽勞(lao)動(dong)(dong)合(he)同的員工嗎?
答(da) 《勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)法(fa)》第(di)(di)十條規定(ding):“建(jian)立勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系,應(ying)(ying)(ying)當訂(ding)(ding)立書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)。已建(jian)立勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系,未同(tong)時訂(ding)(ding)立書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的,應(ying)(ying)(ying)當自用(yong)(yong)工(gong)之日起(qi)一個(ge)月(yue)內訂(ding)(ding)立書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)。”《勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)法(fa)實施條例》第(di)(di)五條規定(ding):“自用(yong)(yong)工(gong)之日起(qi)一個(ge)月(yue)內,經用(yong)(yong)人單(dan)位書(shu)(shu)面(mian)通(tong)知后,勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者不與用(yong)(yong)人單(dan)位訂(ding)(ding)立書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的,用(yong)(yong)人單(dan)位應(ying)(ying)(ying)當書(shu)(shu)面(mian)通(tong)知勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者終止勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系,無需(xu)向勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者支(zhi)付經濟補償,但是應(ying)(ying)(ying)當依法(fa)向勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者支(zhi)付其實際(ji)工(gong)作(zuo)時間的勞(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬。”
