能辭退不簽勞動合同的員工嗎?
問(wen) 在實際生活中,有的勞(lao)動(dong)者由(you)于個人原因不(bu)愿(yuan)意簽訂勞(lao)動(dong)合同,請問像這樣情況能辭退不(bu)簽勞(lao)動(dong)合同的員工嗎?
答 《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法》第十條(tiao)規定(ding):“建立(li)(li)勞(lao)(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi),應(ying)當(dang)訂(ding)立(li)(li)書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)。已建立(li)(li)勞(lao)(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi),未同(tong)(tong)時訂(ding)立(li)(li)書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)的,應(ying)當(dang)自用工(gong)之(zhi)日起一個(ge)月(yue)內(nei)訂(ding)立(li)(li)書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)。”《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)法實施條(tiao)例》第五(wu)條(tiao)規定(ding):“自用工(gong)之(zhi)日起一個(ge)月(yue)內(nei),經用人(ren)單位(wei)書(shu)面(mian)通知(zhi)后,勞(lao)(lao)(lao)動(dong)(dong)者(zhe)不與(yu)用人(ren)單位(wei)訂(ding)立(li)(li)書(shu)面(mian)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)(tong)的,用人(ren)單位(wei)應(ying)當(dang)書(shu)面(mian)通知(zhi)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)終止勞(lao)(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi),無(wu)需向(xiang)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)支付(fu)經濟補償,但(dan)是應(ying)當(dang)依(yi)法向(xiang)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)支付(fu)其實際工(gong)作時間(jian)的勞(lao)(lao)(lao)動(dong)(dong)報酬。”
