答 。《勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)法(fa)(fa)》第(di)三十六條(tiao)(tiao)規定(ding):“用人單位(wei)與(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)協商(shang)一(yi)致,可(ke)以解(jie)(jie)(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)。”同(tong)(tong)(tong)(tong)時,第(di)四十六條(tiao)(tiao)要求,用人單位(wei)依照本法(fa)(fa)第(di)三十六條(tiao)(tiao)規定(ding)向勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)提出解(jie)(jie)(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)并與(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)協商(shang)一(yi)致解(jie)(jie)(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)的,應當向勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)支付經(jing)(jing)濟(ji)補(bu)償。不(bu)過,單位(wei)提出協商(shang)解(jie)(jie)(jie)除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)(tong),是(shi)(shi)依法(fa)(fa)給予(yu)經(jing)(jing)濟(ji)補(bu)償的充分條(tiao)(tiao)件(jian),而不(bu)是(shi)(shi)必要條(tiao)(tiao)件(jian)。不(bu)能理解(jie)(jie)(jie)為(wei),依法(fa)(fa)給予(yu)了(le)經(jing)(jing)濟(ji)補(bu)償,單位(wei)就一(yi)定(ding)能夠協商(shang)解(jie)(jie)(jie)除(chu)。是(shi)(shi)否能夠成功解(jie)(jie)(jie)除(chu),還要看(kan)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)的意思。如果(guo)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)認為(wei)自己也同(tong)(tong)(tong)(tong)意解(jie)(jie)(jie)除(chu),那雙方(fang)皆大(da)歡喜。但如果(guo)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)不(bu)同(tong)(tong)(tong)(tong)意協商(shang)解(jie)(jie)(jie)除(chu),單位(wei)可(ke)能需要抬高加碼,或者(zhe)(zhe)(zhe)放(fang)棄協商(shang)解(jie)(jie)(jie)除(chu)這(zhe)一(yi)途徑。
