什么情況下用人單位可以與員工解除勞動合同?

公司里有(you)很不(bu)上進的員工,想把他(ta)辭了(le),但是簽了(le)勞(lao)動合同,什么情況下用人單位可以與員工解除勞(lao)動合同?

勞動(dong)(dong)(dong)者有下列情(qing)(qing)形之(zhi)(zhi)一(yi)的,用人(ren)(ren)單位可以解除(chu)勞動(dong)(dong)(dong)合(he)同(tong)(tong): (一(yi))在試用期間被(bei)證明不(bu)符(fu)合(he)錄(lu)用條件(jian)的; (二)嚴重(zhong)違反勞動(dong)(dong)(dong)紀律或(huo)者用人(ren)(ren)單位規(gui)章制度(du)的; (三(san))嚴重(zhong)失(shi)職,營私舞弊,對用人(ren)(ren)單位利益造(zao)成重(zhong)大損害的; (四)被(bei)依法追(zhui)究刑事(shi)責任(ren)的。 有下列情(qing)(qing)形之(zhi)(zhi)一(yi)的,用人(ren)(ren)單位可以解除(chu)勞動(dong)(dong)(dong)合(he)同(tong)(tong),但是應當(dang)提前三(san)十日以書面形式通知勞動(dong)(dong)(dong)者本人(ren)(ren): (一(yi))勞動(dong)(dong)(dong)者患病或(huo)者非(fei)因工(gong)(gong)(gong)負(fu)傷(shang),醫療期滿(man)后,不(bu)能(neng)(neng)從事(shi)原工(gong)(gong)(gong)作也不(bu)能(neng)(neng)從事(shi)由(you)用人(ren)(ren)單位另行安排的工(gong)(gong)(gong)作的; (二)勞動(dong)(dong)(dong)者不(bu)能(neng)(neng)勝(sheng)(sheng)任(ren)工(gong)(gong)(gong)作,經過培訓或(huo)者調整工(gong)(gong)(gong)作崗(gang)位,仍不(bu)能(neng)(neng)勝(sheng)(sheng)任(ren)工(gong)(gong)(gong)作的; (三(san))勞動(dong)(dong)(dong)合(he)同(tong)(tong)訂立時(shi)所依據(ju)的客觀情(qing)(qing)況發生重(zhong)大變(bian)化,致使原勞動(dong)(dong)(dong)合(he)同(tong)(tong)無法履行,經當(dang)事(shi)人(ren)(ren)協商不(bu)能(neng)(neng)就變(bian)更勞動(dong)(dong)(dong)合(he)同(tong)(tong)達成協議的。
