答(da) 勞(lao)動(dong)(dong)(dong)者(zhe)有下(xia)列情形之一的(de),用人(ren)單位(wei)(wei)可以解除勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong): (一)在試(shi)用期間被證明不(bu)符合(he)錄用條件(jian)的(de); (二(er))嚴重(zhong)(zhong)違反(fan)勞(lao)動(dong)(dong)(dong)紀律或者(zhe)用人(ren)單位(wei)(wei)規(gui)章制度(du)的(de); (三(san)(san))嚴重(zhong)(zhong)失(shi)職,營私(si)舞弊,對用人(ren)單位(wei)(wei)利益造成(cheng)重(zhong)(zhong)大(da)損害的(de); (四)被依(yi)法(fa)追究刑事(shi)責任的(de)。 有下(xia)列情形之一的(de),用人(ren)單位(wei)(wei)可以解除勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong),但是應當提前三(san)(san)十日以書面形式通(tong)知勞(lao)動(dong)(dong)(dong)者(zhe)本(ben)人(ren): (一)勞(lao)動(dong)(dong)(dong)者(zhe)患病或者(zhe)非因工(gong)負傷,醫療期滿后,不(bu)能(neng)從事(shi)原工(gong)作(zuo)(zuo)也不(bu)能(neng)從事(shi)由用人(ren)單位(wei)(wei)另行安排的(de)工(gong)作(zuo)(zuo)的(de); (二(er))勞(lao)動(dong)(dong)(dong)者(zhe)不(bu)能(neng)勝任工(gong)作(zuo)(zuo),經(jing)過培(pei)訓(xun)或者(zhe)調整工(gong)作(zuo)(zuo)崗位(wei)(wei),仍(reng)不(bu)能(neng)勝任工(gong)作(zuo)(zuo)的(de); (三(san)(san))勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)訂(ding)立(li)時(shi)所依(yi)據的(de)客觀(guan)情況發生重(zhong)(zhong)大(da)變化,致使原勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)無(wu)法(fa)履行,經(jing)當事(shi)人(ren)協(xie)商不(bu)能(neng)就變更(geng)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)達(da)成(cheng)協(xie)議的(de)。
