2個建筑企業(ye)(ye)被清(qing)出(chu)(chu)章(zhang)丘(qiu)市場(chang),3個被限期6個月整(zheng)改,10個記入不(bu)良記錄,2位非(fei)法(fa)勞務(wu)承包隊伍負(fu)責人被清(qing)出(chu)(chu)章(zhang)丘(qiu)市場(chang)……在3月7日召開的山東章(zhang)丘(qiu)建筑業(ye)(ye)2013年工(gong)(gong)(gong)(gong)作(zuo)總(zong)結表彰暨2014年春季建筑市場(chang)執法(fa)大檢查啟動會上,20余家單位因拖欠(qian)農民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資被曝(pu)光(guang)并受嚴(yan)懲。該(gai)市針對“討(tao)薪難(nan)”這一頑疾,創新工(gong)(gong)(gong)(gong)作(zuo)方法(fa),建立農民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資結算(suan)月公示制度,變(bian)清(qing)欠(qian)為防欠(qian),力保(bao)農民工(gong)(gong)(gong)(gong)合法(fa)權(quan)益。
防欠追責 用工實名 從源頭堵住欠薪的“跑冒滴漏”
每到歲末年(nian)(nian)(nian)尾,農(nong)民工討薪成(cheng)為一個(ge)敏感(gan)話題。年(nian)(nian)(nian)年(nian)(nian)(nian)都幫農(nong)民工討薪,但(dan)是欠薪問題仍然是“春風吹又生”,如何才(cai)能(neng)從根(gen)源解決,經過調研總結前期的(de)(de)經驗教訓,章丘初步(bu)探(tan)索出了一條(tiao)切實(shi)可行(xing)的(de)(de)路(lu)徑。
責任主體(ti)明確,“誰承(cheng)(cheng)包(bao)、誰負(fu)責”,總(zong)承(cheng)(cheng)包(bao)企業對所承(cheng)(cheng)包(bao)工(gong)(gong)(gong)(gong)程的(de)(de)農(nong)(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)支付管理(li)工(gong)(gong)(gong)(gong)作(zuo)負(fu)總(zong)責,項目(mu)經理(li)為項目(mu)第一(yi)責任人,具(ju)體(ti)負(fu)責工(gong)(gong)(gong)(gong)資(zi)(zi)支付管理(li),因各種原因致拖(tuo)欠農(nong)(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)的(de)(de),由工(gong)(gong)(gong)(gong)程總(zong)承(cheng)(cheng)包(bao)企業承(cheng)(cheng)擔清欠責任。嚴(yan)格落(luo)實(shi)建筑施(shi)工(gong)(gong)(gong)(gong)企業工(gong)(gong)(gong)(gong)資(zi)(zi)保證金(jin)、勞保金(jin)的(de)(de)繳(jiao)存,對工(gong)(gong)(gong)(gong)資(zi)(zi)實(shi)行“兜底”。實(shi)行進場(chang)施(shi)工(gong)(gong)(gong)(gong)實(shi)名制(zhi)管理(li),實(shi)現(xian)施(shi)工(gong)(gong)(gong)(gong)現(xian)場(chang)勞動用工(gong)(gong)(gong)(gong)底數(shu)清、基本(ben)情(qing)況清、出(chu)勤記(ji)錄(lu)清、工(gong)(gong)(gong)(gong)資(zi)(zi)發(fa)放記(ji)錄(lu)清、進出(chu)項目(mu)時間清等“五清”目(mu)標的(de)(de)管理(li)制(zhi)度。推行農(nong)(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)結(jie)算(suan)月(yue)公(gong)示制(zhi)度。每月(yue)月(yue)底前根據出(chu)勤及(ji)完成(cheng)的(de)(de)實(shi)物(wu)量情(qing)況,計算(suan)農(nong)(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)應得月(yue)工(gong)(gong)(gong)(gong)資(zi)(zi)額,由總(zong)承(cheng)(cheng)包(bao)企業、分包(bao)單位和農(nong)(nong)(nong)(nong)民工(gong)(gong)(gong)(gong)簽字認可后在(zai)施(shi)工(gong)(gong)(gong)(gong)現(xian)場(chang)公(gong)示。
嚴把入口關,對入章(zhang)施(shi)工企(qi)業,必須持有合法有效(xiao)的外地(di)(di)企(qi)業進濟備案證、資質(zhi)注冊地(di)(di)建設行政主管部門出具的無拖(tuo)(tuo)欠農(nong)民(min)工工資不良行為證明材(cai)料。同時在(zai)領取中(zhong)標通知書時,必須提供加蓋(gai)總承包(bao)單位公(gong)章(zhang)且有單位法人及項目經理簽名的承諾不拖(tuo)(tuo)欠農(nong)民(min)工工資保證書。
建立5支巡查小組 全面督導落實 實現清欠的常態化
“先(xian)防欠(qian),再清欠(qian),由(you)清欠(qian)辦牽(qian)頭,從(cong)機關各(ge)科室、后勤(qin)部門(men)抽調工(gong)(gong)(gong)作(zuo)人(ren)員成(cheng)立5個巡(xun)視小組,對全市(shi)581個建(jian)筑項目工(gong)(gong)(gong)地進行定(ding)期走(zou)訪,監督每月農民工(gong)(gong)(gong)工(gong)(gong)(gong)資支付及公(gong)示情(qing)況(kuang)情(qing)況(kuang),將農民工(gong)(gong)(gong)工(gong)(gong)(gong)資清欠(qian)工(gong)(gong)(gong)作(zuo)常態化,制度化。”章丘住(zhu)建(jian)委相(xiang)關負責(ze)(ze)人(ren)表示。若發現相(xiang)關總承包企(qi)業不按規定(ding)報送農民工(gong)(gong)(gong)工(gong)(gong)(gong)資發放表、考勤(qin)表,不按規定(ding)按月支付農民工(gong)(gong)(gong)工(gong)(gong)(gong)資及未公(gong)示工(gong)(gong)(gong)資表的(de)工(gong)(gong)(gong)程項目,一律停工(gong)(gong)(gong)整(zheng)改,經住(zhu)建(jian)委清欠(qian)辦復(fu)(fu)核合(he)格后方可恢復(fu)(fu)施工(gong)(gong)(gong),情(qing)節嚴重的(de),將對責(ze)(ze)任(ren)單位及責(ze)(ze)任(ren)人(ren),按相(xiang)關規定(ding)予以處罰。
進一(yi)步切實履行“屬地管(guan)理(li)”職責。各(ge)鎮、街(jie)道辦對本(ben)轄區(qu)的(de)新型(xing)農(nong)村(cun)社區(qu)建設、舊村(cun)改造工(gong)程加強(qiang)監督(du)檢查,做好(hao)農(nong)民(min)工(gong)工(gong)資(zi)拖欠問題日(ri)常排查,及早發(fa)現和處置勞資(zi)糾紛(fen)。經濟開發(fa)區(qu)、工(gong)業(ye)園區(qu),要進一(yi)步強(qiang)化(hua)對引進引辦企業(ye)的(de)監督(du)管(guan)理(li),督(du)促(cu)各(ge)企業(ye)按照基本(ben)建設程序(xu)完(wan)善(shan)相關建設手續,同時做好(hao)農(nong)民(min)工(gong)工(gong)資(zi)支付(fu)管(guan)理(li)工(gong)作。
把農民工當親人 發揮建筑業主體能動性
2014年,章丘市立足教育(yu)實(shi)踐活(huo)動,做實(shi)事(shi)、轉(zhuan)作風、求實(shi)效。在全市建(jian)筑(zhu)行業(ye),力求突破農(nong)(nong)民工(gong)(gong)工(gong)(gong)資(zi)清欠(qian)(qian)難題,做服務、轉(zhuan)思想、促(cu)創新。多措并(bing)舉,讓農(nong)(nong)民工(gong)(gong)真正體會到變化,做農(nong)(nong)民工(gong)(gong)“娘家人”,創新清欠(qian)(qian)工(gong)(gong)作機制(zhi),月月公示(shi)農(nong)(nong)民工(gong)(gong)工(gong)(gong)資(zi),天(tian)天(tian)監(jian)督工(gong)(gong)資(zi)發(fa)放,時時預防(fang)農(nong)(nong)民工(gong)(gong)工(gong)(gong)資(zi)拖欠(qian)(qian),把(ba)清欠(qian)(qian)工(gong)(gong)作常態化,保障農(nong)(nong)民工(gong)(gong)權益。
