防欠追責 用工實名 從源頭堵住欠薪的“跑冒滴漏”

每到(dao)歲末年(nian)尾,農民(min)工(gong)討(tao)薪(xin)成為一個敏感(gan)話題(ti)。年(nian)年(nian)都幫農民(min)工(gong)討(tao)薪(xin),但是欠薪(xin)問題(ti)仍然是“春風吹又生”,如何才能從根源解決,經(jing)過(guo)調研總(zong)結(jie)前(qian)期(qi)的經(jing)驗教訓,章丘初(chu)步探(tan)索出了一條(tiao)切實可行的路徑。

責(ze)任(ren)主體明確,“誰承(cheng)包(bao)(bao)、誰負責(ze)”,總(zong)(zong)承(cheng)包(bao)(bao)企(qi)業(ye)對(dui)所承(cheng)包(bao)(bao)工(gong)(gong)(gong)程的農(nong)(nong)(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)支付管(guan)理(li)工(gong)(gong)(gong)作(zuo)負總(zong)(zong)責(ze),項目(mu)(mu)(mu)經(jing)理(li)為項目(mu)(mu)(mu)第一責(ze)任(ren)人(ren),具體負責(ze)工(gong)(gong)(gong)資(zi)支付管(guan)理(li),因各種原(yuan)因致(zhi)拖欠農(nong)(nong)(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)的,由(you)工(gong)(gong)(gong)程總(zong)(zong)承(cheng)包(bao)(bao)企(qi)業(ye)承(cheng)擔(dan)清(qing)(qing)(qing)欠責(ze)任(ren)。嚴格落實(shi)(shi)建筑施(shi)工(gong)(gong)(gong)企(qi)業(ye)工(gong)(gong)(gong)資(zi)保證(zheng)金(jin)、勞(lao)保金(jin)的繳存(cun),對(dui)工(gong)(gong)(gong)資(zi)實(shi)(shi)行(xing)“兜底”。實(shi)(shi)行(xing)進場(chang)施(shi)工(gong)(gong)(gong)實(shi)(shi)名(ming)制(zhi)管(guan)理(li),實(shi)(shi)現(xian)施(shi)工(gong)(gong)(gong)現(xian)場(chang)勞(lao)動(dong)用工(gong)(gong)(gong)底數清(qing)(qing)(qing)、基(ji)本情況清(qing)(qing)(qing)、出勤(qin)記錄清(qing)(qing)(qing)、工(gong)(gong)(gong)資(zi)發放(fang)記錄清(qing)(qing)(qing)、進出項目(mu)(mu)(mu)時間清(qing)(qing)(qing)等(deng)“五清(qing)(qing)(qing)”目(mu)(mu)(mu)標(biao)的管(guan)理(li)制(zhi)度。推(tui)行(xing)農(nong)(nong)(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)結算月(yue)公示制(zhi)度。每月(yue)月(yue)底前根(gen)據出勤(qin)及完成(cheng)的實(shi)(shi)物量情況,計算農(nong)(nong)(nong)民(min)工(gong)(gong)(gong)應得月(yue)工(gong)(gong)(gong)資(zi)額,由(you)總(zong)(zong)承(cheng)包(bao)(bao)企(qi)業(ye)、分包(bao)(bao)單位和農(nong)(nong)(nong)民(min)工(gong)(gong)(gong)簽字認(ren)可后在施(shi)工(gong)(gong)(gong)現(xian)場(chang)公示。

嚴把入(ru)口關,對入(ru)章施工(gong)企業,必須持有合法(fa)有效(xiao)的外地企業進濟備(bei)案(an)證(zheng)、資質注冊(ce)地建設行政主管(guan)部門出具的無拖(tuo)欠農民(min)工(gong)工(gong)資不(bu)良行為(wei)證(zheng)明材料(liao)。同時(shi)在領取中(zhong)標通知書時(shi),必須提供加(jia)蓋總承包單(dan)位公章且有單(dan)位法(fa)人及項(xiang)目(mu)經(jing)理簽(qian)名的承諾不(bu)拖(tuo)欠農民(min)工(gong)工(gong)資保(bao)證(zheng)書。

建立5支巡查小組 全面督導落實 實現清欠的常態化

“先防(fang)欠(qian),再(zai)清(qing)欠(qian),由清(qing)欠(qian)辦牽(qian)頭,從機關各科室、后勤部(bu)門抽調工(gong)(gong)(gong)作人員成(cheng)立5個巡視小(xiao)組,對全市(shi)581個建筑項(xiang)(xiang)目(mu)工(gong)(gong)(gong)地進(jin)行定(ding)期走(zou)訪,監督每月農(nong)民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)支(zhi)付及(ji)公(gong)示情(qing)況(kuang)(kuang)情(qing)況(kuang)(kuang),將(jiang)農(nong)民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)清(qing)欠(qian)工(gong)(gong)(gong)作常(chang)態(tai)化,制度化。”章丘住建委(wei)相關負(fu)責(ze)人表(biao)示。若發現相關總承包(bao)企業不(bu)按規定(ding)報(bao)送農(nong)民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)發放(fang)表(biao)、考勤表(biao),不(bu)按規定(ding)按月支(zhi)付農(nong)民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)及(ji)未公(gong)示工(gong)(gong)(gong)資(zi)表(biao)的工(gong)(gong)(gong)程項(xiang)(xiang)目(mu),一(yi)律停工(gong)(gong)(gong)整改,經(jing)住建委(wei)清(qing)欠(qian)辦復核合(he)格后方(fang)可恢復施工(gong)(gong)(gong),情(qing)節(jie)嚴重(zhong)的,將(jiang)對責(ze)任單位及(ji)責(ze)任人,按相關規定(ding)予以處罰。

進(jin)一(yi)步切(qie)實履(lv)行“屬地管(guan)理(li)”職責。各(ge)鎮、街(jie)道辦對本轄(xia)區(qu)(qu)的(de)新(xin)型農村(cun)社區(qu)(qu)建設(she)(she)(she)、舊村(cun)改造工(gong)(gong)程加強(qiang)監督檢(jian)查,做好(hao)農民工(gong)(gong)工(gong)(gong)資(zi)拖欠問題日常排查,及早發(fa)現和處(chu)置勞(lao)資(zi)糾紛。經濟開發(fa)區(qu)(qu)、工(gong)(gong)業園區(qu)(qu),要(yao)進(jin)一(yi)步強(qiang)化(hua)對引進(jin)引辦企業的(de)監督管(guan)理(li),督促各(ge)企業按照(zhao)基本建設(she)(she)(she)程序完善相關建設(she)(she)(she)手續,同時做好(hao)農民工(gong)(gong)工(gong)(gong)資(zi)支付(fu)管(guan)理(li)工(gong)(gong)作(zuo)。

把農民工當親人 發揮建筑業主體能動性

2014年,章(zhang)丘市立(li)足教育實(shi)踐活動(dong),做(zuo)實(shi)事、轉作(zuo)風、求(qiu)(qiu)實(shi)效。在全市建筑(zhu)行業,力(li)求(qiu)(qiu)突(tu)破農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資清(qing)欠(qian)難(nan)題(ti),做(zuo)服務、轉思想、促(cu)創(chuang)新。多措并舉,讓農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)真正(zheng)體會到變化(hua),做(zuo)農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)“娘家(jia)人”,創(chuang)新清(qing)欠(qian)工(gong)(gong)(gong)(gong)(gong)作(zuo)機制(zhi),月(yue)月(yue)公(gong)示農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資,天天監督工(gong)(gong)(gong)(gong)(gong)資發放(fang),時(shi)時(shi)預防農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資拖欠(qian),把清(qing)欠(qian)工(gong)(gong)(gong)(gong)(gong)作(zuo)常態化(hua),保障農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)權益。
