煙臺芝罘區人力資(zi)源和社會保障局近(jin)日公布了新的(de)(de)最(zui)低工(gong)資(zi)標(biao)準,芝罘區最(zui)低工(gong)資(zi)標(biao)準由原來(lai)(lai)的(de)(de)1380元(yuan)調整到1500元(yuan),小時(shi)最(zui)低工(gong)資(zi)標(biao)準由原來(lai)(lai)的(de)(de)14.5元(yuan)調整到15元(yuan),新標(biao)準現(xian)已實行(xing)。
按照國(guo)(guo)家(jia)(jia)有(you)關法(fa)律法(fa)規(gui)和(he)政策,最(zui)低(di)(di)工(gong)(gong)資標(biao)準(zhun)是(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)在(zai)(zai)法(fa)定(ding)工(gong)(gong)作時(shi)(shi)間(jian)(jian)或依法(fa)簽訂的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)約(yue)(yue)定(ding)的(de)(de)工(gong)(gong)作時(shi)(shi)間(jian)(jian)內(nei)(nei)提供了(le)正(zheng)(zheng)常(chang)勞(lao)(lao)(lao)(lao)動(dong)(dong)的(de)(de)前提下,用人單(dan)位(wei)依法(fa)應支付的(de)(de)最(zui)低(di)(di)勞(lao)(lao)(lao)(lao)動(dong)(dong)報酬(chou)。最(zui)低(di)(di)工(gong)(gong)資規(gui)定(ding)適用于各類企業(ye)(ye)(ye)、民辦非企業(ye)(ye)(ye)單(dan)位(wei)、有(you)雇工(gong)(gong)的(de)(de)個體工(gong)(gong)商戶(統稱用人單(dan)位(wei))和(he)與之(zhi)(zhi)形成勞(lao)(lao)(lao)(lao)動(dong)(dong)關系(xi)的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe),包括農民工(gong)(gong)。月最(zui)低(di)(di)工(gong)(gong)資標(biao)準(zhun)適用于全(quan)日(ri)(ri)制(zhi)就(jiu)業(ye)(ye)(ye)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe),小時(shi)(shi)最(zui)低(di)(di)工(gong)(gong)資標(biao)準(zhun)適用于非全(quan)日(ri)(ri)制(zhi)就(jiu)業(ye)(ye)(ye)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)。非全(quan)日(ri)(ri)制(zhi)就(jiu)業(ye)(ye)(ye)是(shi)指以(yi)小時(shi)(shi)計酬(chou)為(wei)主(zhu),勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)在(zai)(zai)同(tong)一用人單(dan)位(wei)平均(jun)每(mei)日(ri)(ri)工(gong)(gong)作時(shi)(shi)間(jian)(jian)不超(chao)過(guo)4小時(shi)(shi),每(mei)周累計不超(chao)過(guo)24小時(shi)(shi)的(de)(de)用工(gong)(gong)形式。正(zheng)(zheng)常(chang)勞(lao)(lao)(lao)(lao)動(dong)(dong)是(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)按依法(fa)簽訂的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)約(yue)(yue)定(ding),在(zai)(zai)法(fa)定(ding)工(gong)(gong)作時(shi)(shi)間(jian)(jian)或勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)約(yue)(yue)定(ding)的(de)(de)工(gong)(gong)作時(shi)(shi)間(jian)(jian)內(nei)(nei)從事的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)。勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)依法(fa)享(xiang)受帶薪年休(xiu)假(jia)(jia)、探親假(jia)(jia)、婚(hun)喪(sang)假(jia)(jia)、生育(產)假(jia)(jia)、節(jie)育手術假(jia)(jia)等(deng)國(guo)(guo)家(jia)(jia)規(gui)定(ding)的(de)(de)假(jia)(jia)期間(jian)(jian),以(yi)及法(fa)定(ding)工(gong)(gong)作時(shi)(shi)間(jian)(jian)內(nei)(nei)依法(fa)參加社會(hui)活動(dong)(dong)期間(jian)(jian),視為(wei)提供了(le)正(zheng)(zheng)常(chang)勞(lao)(lao)(lao)(lao)動(dong)(dong)。勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)個人應當(dang)繳納的(de)(de)社會(hui)保險費和(he)住房公積(ji)金,包含在(zai)(zai)最(zui)低(di)(di)工(gong)(gong)資標(biao)準(zhun)之(zhi)(zhi)內(nei)(nei)。
最(zui)低工(gong)(gong)資標(biao)準(zhun)不包括延長(chang)工(gong)(gong)作(zuo)時間、休息(xi)日工(gong)(gong)作(zuo)和法定節假日工(gong)(gong)作(zuo)的(de)加班工(gong)(gong)資;中班、夜班、高溫(wen)、低溫(wen)、井下(xia)、有(you)毒有(you)害等(deng)特殊(shu)工(gong)(gong)作(zuo)環境、條件(jian)下(xia)的(de)津貼(tie);法律、法規(gui)和國(guo)家、省(sheng)規(gui)定的(de)勞(lao)(lao)(lao)動(dong)者應享受的(de)福(fu)利待(dai)遇。最(zui)低工(gong)(gong)資標(biao)準(zhun)主要包括對勞(lao)(lao)(lao)動(dong)者進行培訓的(de)費用(yong);按國(guo)家勞(lao)(lao)(lao)動(dong)安全衛生(sheng)(sheng)規(gui)定發給勞(lao)(lao)(lao)動(dong)者的(de)費用(yong)和用(yong)品,以及用(yong)人單位(wei)自身規(gui)定的(de)工(gong)(gong)作(zuo)用(yong)品(如工(gong)(gong)作(zuo)著裝等(deng));按國(guo)家住房制(zhi)度改革規(gui)定由(you)用(yong)人單位(wei)為(wei)勞(lao)(lao)(lao)動(dong)者繳納的(de)住房公積金;用(yong)人單位(wei)為(wei)勞(lao)(lao)(lao)動(dong)者支付的(de)醫療衛生(sheng)(sheng)費、喪葬撫恤(xu)救濟金、探親路費、計劃生(sheng)(sheng)育補(bu)(bu)貼(tie)、生(sheng)(sheng)活困難補(bu)(bu)助、冬季(ji)取暖補(bu)(bu)貼(tie)、夏季(ji)防暑降溫(wen)費等(deng)。
用人(ren)(ren)(ren)單(dan)位(wei)因生產經(jing)營困難,確需按照最(zui)低工(gong)資(zi)標準支付勞動(dong)者工(gong)資(zi)的,應(ying)當(dang)履行(xing)必要的民主程(cheng)序(xu)(經(jing)職(zhi)工(gong)代表大會或(huo)職(zhi)工(gong)大會討論(lun)通過),并報人(ren)(ren)(ren)力資(zi)源社(she)會保障部門備案。用人(ren)(ren)(ren)單(dan)位(wei)生產經(jing)營恢復(fu)正常后,應(ying)及(ji)時恢復(fu)或(huo)提(ti)高工(gong)資(zi)標準。
