煙臺芝罘區人力(li)資(zi)(zi)源和社(she)會保障局近日公布了新(xin)的最(zui)低(di)(di)(di)工(gong)(gong)資(zi)(zi)標(biao)(biao)準(zhun),芝罘區最(zui)低(di)(di)(di)工(gong)(gong)資(zi)(zi)標(biao)(biao)準(zhun)由原(yuan)來的1380元調整(zheng)到1500元,小時最(zui)低(di)(di)(di)工(gong)(gong)資(zi)(zi)標(biao)(biao)準(zhun)由原(yuan)來的14.5元調整(zheng)到15元,新(xin)標(biao)(biao)準(zhun)現已實行。
按(an)照國(guo)家有關(guan)(guan)法(fa)律法(fa)規和(he)(he)政策,最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)標(biao)準是(shi)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)在(zai)(zai)法(fa)定工(gong)(gong)(gong)(gong)(gong)(gong)作時(shi)(shi)間(jian)(jian)(jian)或依法(fa)簽訂的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同約定的(de)(de)(de)工(gong)(gong)(gong)(gong)(gong)(gong)作時(shi)(shi)間(jian)(jian)(jian)內(nei)提供了(le)正常(chang)勞(lao)(lao)(lao)動(dong)(dong)(dong)的(de)(de)(de)前提下,用(yong)人(ren)單(dan)(dan)位(wei)依法(fa)應支(zhi)付的(de)(de)(de)最(zui)低(di)勞(lao)(lao)(lao)動(dong)(dong)(dong)報酬(chou)。最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)規定適(shi)用(yong)于(yu)各類企(qi)業(ye)、民辦非企(qi)業(ye)單(dan)(dan)位(wei)、有雇工(gong)(gong)(gong)(gong)(gong)(gong)的(de)(de)(de)個(ge)體(ti)工(gong)(gong)(gong)(gong)(gong)(gong)商戶(統稱(cheng)用(yong)人(ren)單(dan)(dan)位(wei))和(he)(he)與之(zhi)形成(cheng)勞(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe),包(bao)括農(nong)民工(gong)(gong)(gong)(gong)(gong)(gong)。月最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)標(biao)準適(shi)用(yong)于(yu)全(quan)(quan)日(ri)制(zhi)就業(ye)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe),小時(shi)(shi)最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)標(biao)準適(shi)用(yong)于(yu)非全(quan)(quan)日(ri)制(zhi)就業(ye)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)。非全(quan)(quan)日(ri)制(zhi)就業(ye)是(shi)指以小時(shi)(shi)計酬(chou)為(wei)主,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)在(zai)(zai)同一用(yong)人(ren)單(dan)(dan)位(wei)平均每日(ri)工(gong)(gong)(gong)(gong)(gong)(gong)作時(shi)(shi)間(jian)(jian)(jian)不超(chao)過4小時(shi)(shi),每周累計不超(chao)過24小時(shi)(shi)的(de)(de)(de)用(yong)工(gong)(gong)(gong)(gong)(gong)(gong)形式。正常(chang)勞(lao)(lao)(lao)動(dong)(dong)(dong)是(shi)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)按(an)依法(fa)簽訂的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同約定,在(zai)(zai)法(fa)定工(gong)(gong)(gong)(gong)(gong)(gong)作時(shi)(shi)間(jian)(jian)(jian)或勞(lao)(lao)(lao)動(dong)(dong)(dong)合同約定的(de)(de)(de)工(gong)(gong)(gong)(gong)(gong)(gong)作時(shi)(shi)間(jian)(jian)(jian)內(nei)從事(shi)的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)。勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)依法(fa)享受帶薪(xin)年(nian)休假、探親假、婚喪假、生育(產)假、節育手術假等國(guo)家規定的(de)(de)(de)假期間(jian)(jian)(jian),以及法(fa)定工(gong)(gong)(gong)(gong)(gong)(gong)作時(shi)(shi)間(jian)(jian)(jian)內(nei)依法(fa)參加社會活動(dong)(dong)(dong)期間(jian)(jian)(jian),視為(wei)提供了(le)正常(chang)勞(lao)(lao)(lao)動(dong)(dong)(dong)。勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)個(ge)人(ren)應當繳(jiao)納的(de)(de)(de)社會保險費和(he)(he)住房公(gong)積金(jin),包(bao)含在(zai)(zai)最(zui)低(di)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)標(biao)準之(zhi)內(nei)。
最(zui)低(di)工資標(biao)準(zhun)不包括(kuo)延(yan)長工作(zuo)(zuo)時間、休息日工作(zuo)(zuo)和法定節假日工作(zuo)(zuo)的(de)(de)加班工資;中班、夜(ye)班、高溫(wen)、低(di)溫(wen)、井下、有毒有害(hai)等特殊工作(zuo)(zuo)環境、條件下的(de)(de)津(jin)貼(tie)(tie)(tie);法律(lv)、法規(gui)和國(guo)家(jia)、省規(gui)定的(de)(de)勞(lao)動(dong)者(zhe)應(ying)享受的(de)(de)福利待遇。最(zui)低(di)工資標(biao)準(zhun)主(zhu)要包括(kuo)對(dui)勞(lao)動(dong)者(zhe)進(jin)行培訓的(de)(de)費用(yong)(yong);按國(guo)家(jia)勞(lao)動(dong)安(an)全衛(wei)(wei)生規(gui)定發給勞(lao)動(dong)者(zhe)的(de)(de)費用(yong)(yong)和用(yong)(yong)品,以及用(yong)(yong)人單位(wei)自身(shen)規(gui)定的(de)(de)工作(zuo)(zuo)用(yong)(yong)品(如工作(zuo)(zuo)著裝等);按國(guo)家(jia)住(zhu)房制度(du)改革規(gui)定由用(yong)(yong)人單位(wei)為勞(lao)動(dong)者(zhe)繳納的(de)(de)住(zhu)房公積金(jin);用(yong)(yong)人單位(wei)為勞(lao)動(dong)者(zhe)支付的(de)(de)醫(yi)療衛(wei)(wei)生費、喪葬撫恤救濟金(jin)、探親路費、計劃生育補貼(tie)(tie)(tie)、生活困難(nan)補助(zhu)、冬季(ji)取暖補貼(tie)(tie)(tie)、夏季(ji)防暑(shu)降(jiang)溫(wen)費等。
用(yong)人(ren)單位因生產(chan)經(jing)營困難,確需按(an)照最低工資(zi)標準支付勞動者工資(zi)的,應當履行必要的民主(zhu)程序(經(jing)職(zhi)工代表大會或職(zhi)工大會討論(lun)通(tong)過(guo)),并報(bao)人(ren)力資(zi)源社會保障(zhang)部門備案。用(yong)人(ren)單位生產(chan)經(jing)營恢復正(zheng)常后,應及時恢復或提高工資(zi)標準。
