煙臺芝罘區人力資源和社會(hui)保障局近日公布了新(xin)的最低(di)工資標(biao)(biao)準(zhun),芝罘區最低(di)工資標(biao)(biao)準(zhun)由原(yuan)來的1380元調整到1500元,小時最低(di)工資標(biao)(biao)準(zhun)由原(yuan)來的14.5元調整到15元,新(xin)標(biao)(biao)準(zhun)現已(yi)實行。
按照國家有(you)關法(fa)律法(fa)規和(he)政策,最低(di)工(gong)(gong)(gong)(gong)資標(biao)準是(shi)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者在(zai)法(fa)定(ding)工(gong)(gong)(gong)(gong)作時(shi)間(jian)或依(yi)(yi)法(fa)簽訂(ding)的(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)約定(ding)的(de)工(gong)(gong)(gong)(gong)作時(shi)間(jian)內提供了正常勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)的(de)前提下,用(yong)(yong)人單(dan)(dan)位依(yi)(yi)法(fa)應支付(fu)的(de)最低(di)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)報酬。最低(di)工(gong)(gong)(gong)(gong)資規定(ding)適(shi)用(yong)(yong)于各類企業、民辦(ban)非(fei)企業單(dan)(dan)位、有(you)雇工(gong)(gong)(gong)(gong)的(de)個體工(gong)(gong)(gong)(gong)商戶(統(tong)稱用(yong)(yong)人單(dan)(dan)位)和(he)與之(zhi)形(xing)成(cheng)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)關系的(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者,包括農(nong)民工(gong)(gong)(gong)(gong)。月最低(di)工(gong)(gong)(gong)(gong)資標(biao)準適(shi)用(yong)(yong)于全日(ri)(ri)(ri)制(zhi)就(jiu)(jiu)業勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者,小(xiao)(xiao)時(shi)最低(di)工(gong)(gong)(gong)(gong)資標(biao)準適(shi)用(yong)(yong)于非(fei)全日(ri)(ri)(ri)制(zhi)就(jiu)(jiu)業勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者。非(fei)全日(ri)(ri)(ri)制(zhi)就(jiu)(jiu)業是(shi)指以小(xiao)(xiao)時(shi)計酬為(wei)主,勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者在(zai)同(tong)(tong)一用(yong)(yong)人單(dan)(dan)位平均每日(ri)(ri)(ri)工(gong)(gong)(gong)(gong)作時(shi)間(jian)不超過(guo)4小(xiao)(xiao)時(shi),每周累計不超過(guo)24小(xiao)(xiao)時(shi)的(de)用(yong)(yong)工(gong)(gong)(gong)(gong)形(xing)式。正常勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)是(shi)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者按依(yi)(yi)法(fa)簽訂(ding)的(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)約定(ding),在(zai)法(fa)定(ding)工(gong)(gong)(gong)(gong)作時(shi)間(jian)或勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)約定(ding)的(de)工(gong)(gong)(gong)(gong)作時(shi)間(jian)內從事的(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者依(yi)(yi)法(fa)享受(shou)帶薪(xin)年休(xiu)假(jia)、探親(qin)假(jia)、婚喪假(jia)、生育(yu)(產)假(jia)、節育(yu)手術(shu)假(jia)等國家規定(ding)的(de)假(jia)期間(jian),以及(ji)法(fa)定(ding)工(gong)(gong)(gong)(gong)作時(shi)間(jian)內依(yi)(yi)法(fa)參(can)加(jia)社會活(huo)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)期間(jian),視為(wei)提供了正常勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)者個人應當繳納的(de)社會保險(xian)費和(he)住房(fang)公積(ji)金,包含在(zai)最低(di)工(gong)(gong)(gong)(gong)資標(biao)準之(zhi)內。
最低(di)工(gong)資標準不包(bao)括(kuo)延(yan)長工(gong)作(zuo)(zuo)(zuo)時間、休息日工(gong)作(zuo)(zuo)(zuo)和法(fa)定(ding)(ding)節假日工(gong)作(zuo)(zuo)(zuo)的(de)(de)加班工(gong)資;中班、夜班、高溫、低(di)溫、井下、有毒有害等特殊工(gong)作(zuo)(zuo)(zuo)環境(jing)、條(tiao)件(jian)下的(de)(de)津(jin)貼;法(fa)律(lv)、法(fa)規和國家、省規定(ding)(ding)的(de)(de)勞動(dong)(dong)者(zhe)應享受的(de)(de)福利待(dai)遇(yu)。最低(di)工(gong)資標準主要包(bao)括(kuo)對(dui)勞動(dong)(dong)者(zhe)進行(xing)培訓(xun)的(de)(de)費(fei)(fei)(fei)(fei)用;按國家勞動(dong)(dong)安全衛(wei)生規定(ding)(ding)發給勞動(dong)(dong)者(zhe)的(de)(de)費(fei)(fei)(fei)(fei)用和用品,以及(ji)用人單(dan)(dan)位(wei)自身規定(ding)(ding)的(de)(de)工(gong)作(zuo)(zuo)(zuo)用品(如工(gong)作(zuo)(zuo)(zuo)著裝(zhuang)等);按國家住房制度改革規定(ding)(ding)由用人單(dan)(dan)位(wei)為(wei)勞動(dong)(dong)者(zhe)繳納的(de)(de)住房公(gong)積(ji)金;用人單(dan)(dan)位(wei)為(wei)勞動(dong)(dong)者(zhe)支付的(de)(de)醫療衛(wei)生費(fei)(fei)(fei)(fei)、喪(sang)葬撫恤救濟金、探親路費(fei)(fei)(fei)(fei)、計劃(hua)生育補貼、生活(huo)困難補助、冬季(ji)取(qu)暖補貼、夏(xia)季(ji)防暑降溫費(fei)(fei)(fei)(fei)等。
用(yong)人單位(wei)因生產經營困難,確需按(an)照最低工資(zi)標(biao)準(zhun)支(zhi)付勞動者(zhe)工資(zi)的,應(ying)當履行必要(yao)的民主程(cheng)序(經職(zhi)工代表大會或(huo)(huo)職(zhi)工大會討論通過),并報人力資(zi)源社會保障部門備案。用(yong)人單位(wei)生產經營恢復(fu)正(zheng)常后,應(ying)及時恢復(fu)或(huo)(huo)提高工資(zi)標(biao)準(zhun)。
