最(zui)(zui)低工(gong)(gong)資是指(zhi)勞(lao)(lao)動(dong)(dong)者(zhe)在法定(ding)工(gong)(gong)作時(shi)間或依法簽訂(ding)的(de)勞(lao)(lao)動(dong)(dong)合同約(yue)定(ding)的(de)工(gong)(gong)作時(shi)間內提供(gong)了正常勞(lao)(lao)動(dong)(dong)的(de)前(qian)提下,用人單位依法應支付的(de)最(zui)(zui)低勞(lao)(lao)動(dong)(dong)報(bao)酬(chou)。月最(zui)(zui)低工(gong)(gong)資標準適用于(yu)全日制就(jiu)業勞(lao)(lao)動(dong)(dong)者(zhe),小時(shi)最(zui)(zui)低工(gong)(gong)資標準適用于(yu)非全日制就(jiu)業勞(lao)(lao)動(dong)(dong)者(zhe)。
日(ri)前,德(de)州市人社局發布通知,自2014年3月1日(ri)起,德(de)州月最低(di)工資標(biao)(biao)準(zhun)由1080元(yuan)(yuan)調整為1200元(yuan)(yuan),小(xiao)時最低(di)工資標(biao)(biao)準(zhun)由11元(yuan)(yuan)調整為12元(yuan)(yuan)。
我省(sheng)自(zi)2014年(nian)3月(yue)(yue)份起(qi)再次調整最(zui)低(di)工資標準(zhun),最(zui)低(di)工資標準(zhun)根據各(ge)地的(de)經濟發(fa)展(zhan)水平分為3檔(dang),其中德(de)州(zhou)市月(yue)(yue)最(zui)低(di)工資為1200元,最(zui)低(di)小時工資為12元。此前,德(de)州(zhou)市最(zui)低(di)工資標準(zhun)為1080元,小時最(zui)低(di)工資標準(zhun)為11元。
“每個(ge)月1200元(yuan)或者每個(ge)小時12元(yuan),是少數生產經(jing)營(ying)困難(nan)、經(jing)濟效益下降(jiang)、確無正(zheng)常工(gong)(gong)(gong)(gong)資(zi)支(zhi)付能力的用人單位(wei)(wei)支(zhi)付給勞(lao)動(dong)者的最低勞(lao)動(dong)報酬,至少是連(lian)續3個(ge)月以(yi)上(shang)不(bu)能正(zheng)常發放工(gong)(gong)(gong)(gong)資(zi)的。”德州市(shi)人社局勞(lao)動(dong)關系科工(gong)(gong)(gong)(gong)作(zuo)(zuo)人員介紹,“有支(zhi)付能力的用人單位(wei)(wei)不(bu)得將最低工(gong)(gong)(gong)(gong)資(zi)作(zuo)(zuo)為正(zheng)常的工(gong)(gong)(gong)(gong)資(zi)支(zhi)付標準(zhun),如果用人單位(wei)(wei)需要(yao)按最低工(gong)(gong)(gong)(gong)資(zi)標準(zhun)支(zhi)付工(gong)(gong)(gong)(gong)資(zi),應履行必(bi)要(yao)的民主程序并事先報同級人力資(zi)源(yuan)社會保障行政部(bu)門備案。”
勞動者個(ge)人應當(dang)繳納(na)的(de)社會保(bao)險費和住房公積金(jin)包含(han)在(zai)最(zui)(zui)低工資(zi)標(biao)準(zhun)之內(nei)。值(zhi)得注意的(de)是,延長工作時(shi)間的(de)加(jia)班(ban)加(jia)點工資(zi),中班(ban)、夜(ye)班(ban)、高溫(wen)、低溫(wen)、井下(xia)、有毒有害(hai)等特殊工作環(huan)境(jing)、條(tiao)件下(xia)的(de)津貼,以及法律(lv)、法規和國家、省(sheng)規定的(de)勞動者應當(dang)享受的(de)福利待遇(yu)不包含(han)在(zai)最(zui)(zui)低工資(zi)標(biao)準(zhun)的(de)項目(mu)內(nei)。
