近年來,平臺經濟迅速發展,創造了大量就業機會,依托互聯網平臺就業的網約配送員、網約車駕駛員、貨車司機等新就業形態勞動者數量大幅增加,維護勞動者勞動保障權益面臨新情況新問題。為解決這些問題,市總工會日前印發《關于維護新就業形態勞動者權益的若干措施》(以下簡稱《若干措施》),從建會入會、法律維權、貼心服務等領域對維護青島市靈活就業“八大群體”和新就業形態勞動者的權益作出具體規定。
《若(ruo)干措施》中明(ming)確(que)指出(chu),要通過(guo)豐富建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)渠道(dao)、創新(xin)(xin)和簡(jian)化入會(hui)(hui)(hui)(hui)(hui)(hui)流程(cheng)、傾斜資源力量(liang)促(cu)進建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)入會(hui)(hui)(hui)(hui)(hui)(hui)等方(fang)(fang)式加快(kuai)推(tui)進新(xin)(xin)就業(ye)(ye)(ye)形(xing)(xing)態(tai)勞(lao)動(dong)(dong)者(zhe)(zhe)入會(hui)(hui)(hui)(hui)(hui)(hui)。針對(dui)新(xin)(xin)就業(ye)(ye)(ye)形(xing)(xing)態(tai)勞(lao)動(dong)(dong)者(zhe)(zhe)的職業(ye)(ye)(ye)特點,要探索不同形(xing)(xing)式的建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)入會(hui)(hui)(hui)(hui)(hui)(hui)形(xing)(xing)式,在(zai)全市(shi)組(zu)織(zhi)開(kai)(kai)展新(xin)(xin)就業(ye)(ye)(ye)形(xing)(xing)態(tai)領(ling)域建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)入會(hui)(hui)(hui)(hui)(hui)(hui)集(ji)中行(xing)動(dong)(dong)。要摸清新(xin)(xin)就業(ye)(ye)(ye)形(xing)(xing)態(tai)領(ling)域勞(lao)動(dong)(dong)者(zhe)(zhe)基(ji)本情況和工(gong)(gong)會(hui)(hui)(hui)(hui)(hui)(hui)組(zu)織(zhi)建(jian)(jian)設(she)情況,建(jian)(jian)立工(gong)(gong)作(zuo)臺賬,通過(guo)單(dan)獨建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)、聯合(he)(he)建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)、行(xing)業(ye)(ye)(ye)建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)、區(qu)(qu)域建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)等多種方(fang)(fang)式建(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)。依托平(ping)臺企業(ye)(ye)(ye)工(gong)(gong)會(hui)(hui)(hui)(hui)(hui)(hui)、行(xing)業(ye)(ye)(ye)工(gong)(gong)會(hui)(hui)(hui)(hui)(hui)(hui)、社區(qu)(qu)(園(yuan)區(qu)(qu)、樓宇)工(gong)(gong)會(hui)(hui)(hui)(hui)(hui)(hui)聯合(he)(he)會(hui)(hui)(hui)(hui)(hui)(hui)等基(ji)層(ceng)工(gong)(gong)會(hui)(hui)(hui)(hui)(hui)(hui)組(zu)織(zhi),廣泛吸(xi)收新(xin)(xin)就業(ye)(ye)(ye)形(xing)(xing)態(tai)勞(lao)動(dong)(dong)者(zhe)(zhe)加入工(gong)(gong)會(hui)(hui)(hui)(hui)(hui)(hui)。依托智慧工(gong)(gong)會(hui)(hui)(hui)(hui)(hui)(hui)平(ping)臺,建(jian)(jian)設(she)“網上職工(gong)(gong)之家”,開(kai)(kai)通網上入會(hui)(hui)(hui)(hui)(hui)(hui)渠道(dao),吸(xi)引(yin)新(xin)(xin)就業(ye)(ye)(ye)形(xing)(xing)態(tai)勞(lao)動(dong)(dong)者(zhe)(zhe)實現網上入會(hui)(hui)(hui)(hui)(hui)(hui),并(bing)分類建(jian)(jian)立新(xin)(xin)就業(ye)(ye)(ye)形(xing)(xing)態(tai)勞(lao)動(dong)(dong)者(zhe)(zhe)會(hui)(hui)(hui)(hui)(hui)(hui)員(yuan)數據庫。
《若干(gan)措施(shi)》提出,要加大專(zhuan)項經費保障,按照市總工(gong)會(hui)(hui)和區市總工(gong)會(hui)(hui)各負擔50%的(de)原則建立(li)基層工(gong)會(hui)(hui)建設專(zhuan)項經費制(zhi)度,根據(ju)(ju)新就業形態勞動者新入(ru)會(hui)(hui)人數(shu)分別(bie)給予2000元(yuan)(yuan)(yuan)和5000元(yuan)(yuan)(yuan)專(zhuan)項經費;建立(li)以實績為主導的(de)差異性補貼機制(zhi),根據(ju)(ju)新就業形態工(gong)會(hui)(hui)聯合會(hui)(hui)所轄單(dan)建(聯合)工(gong)會(hui)(hui)數(shu)、職工(gong)(會(hui)(hui)員)數(shu)、規模及工(gong)作情況,每家每年(nian)分別(bie)補助5000元(yuan)(yuan)(yuan)、10000元(yuan)(yuan)(yuan)、20000元(yuan)(yuan)(yuan)工(gong)作經費。
為強(qiang)化新(xin)就業(ye)(ye)(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)的(de)(de)(de)權(quan)益(yi)保(bao)障(zhang),《若干措施》對(dui)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)參(can)加工(gong)(gong)(gong)(gong)會(hui)(hui)互(hu)助(zhu)(zhu)保(bao)障(zhang)、關(guan)愛新(xin)就業(ye)(ye)(ye)(ye)形(xing)(xing)(xing)態女(nv)職(zhi)工(gong)(gong)(gong)(gong)等(deng)做了明(ming)確要求。其中,面向參(can)加城鎮職(zhi)工(gong)(gong)(gong)(gong)基(ji)本(ben)醫(yi)療保(bao)險或城鄉居民基(ji)本(ben)醫(yi)療保(bao)險并加入工(gong)(gong)(gong)(gong)會(hui)(hui)組織的(de)(de)(de)新(xin)就業(ye)(ye)(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe),市總工(gong)(gong)(gong)(gong)會(hui)(hui)贈送一年保(bao)障(zhang)期的(de)(de)(de)重大疾病、意外(wai)傷害互(hu)助(zhu)(zhu)保(bao)障(zhang)計劃。鼓勵新(xin)就業(ye)(ye)(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)參(can)加醫(yi)療互(hu)助(zhu)(zhu)保(bao)障(zhang)計劃,由市總工(gong)(gong)(gong)(gong)會(hui)(hui)給(gei)予補(bu)助(zhu)(zhu),提(ti)高(gao)他們抵御風險的(de)(de)(de)能(neng)力。全市工(gong)(gong)(gong)(gong)會(hui)(hui)將及時指導(dao)建立(li)健全新(xin)就業(ye)(ye)(ye)(ye)形(xing)(xing)(xing)態領域(yu)(yu)基(ji)層工(gong)(gong)(gong)(gong)會(hui)(hui)女(nv)職(zhi)工(gong)(gong)(gong)(gong)組織,指導(dao)簽(qian)訂女(nv)職(zhi)工(gong)(gong)(gong)(gong)特殊權(quan)益(yi)專(zhuan)項集體(ti)合(he)同,保(bao)障(zhang)女(nv)職(zhi)工(gong)(gong)(gong)(gong)的(de)(de)(de)合(he)法(fa)權(quan)益(yi)和特殊利益(yi);免費為2000名35—59周(zhou)歲新(xin)就業(ye)(ye)(ye)(ye)形(xing)(xing)(xing)態領域(yu)(yu)女(nv)會(hui)(hui)員提(ti)供 “兩癌(ai)(ai)”(乳腺癌(ai)(ai)、宮頸癌(ai)(ai))篩(shai)查(cha),并贈送“女(nv)職(zhi)工(gong)(gong)(gong)(gong)特殊疾病保(bao)障(zhang)”。全市工(gong)(gong)(gong)(gong)會(hui)(hui)將以(yi)出行(xing)、外(wai)賣、即時配送、同城貨(huo)運等(deng)行(xing)業(ye)(ye)(ye)(ye)的(de)(de)(de)平(ping)臺企業(ye)(ye)(ye)(ye)為重點(dian),深(shen)入開(kai)展 “安康(kang)杯”和“查(cha)保(bao)促”群(qun)眾性(xing)安全生(sheng)產活動(dong)(dong)(dong)(dong),督導(dao)相關(guan)企業(ye)(ye)(ye)(ye)建立(li)健全新(xin)就業(ye)(ye)(ye)(ye)形(xing)(xing)(xing)態工(gong)(gong)(gong)(gong)傷預防機制(zhi),推(tui)進(jin)工(gong)(gong)(gong)(gong)傷預防、工(gong)(gong)(gong)(gong)傷補(bu)償、工(gong)(gong)(gong)(gong)傷康(kang)復(fu)相結合(he)的(de)(de)(de)工(gong)(gong)(gong)(gong)傷保(bao)險制(zhi)度,提(ti)升新(xin)就業(ye)(ye)(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)保(bao)障(zhang)水平(ping)。
《若(ruo)干措施》倡導強化(hua)法(fa)(fa)律(lv)維權(quan)服(fu)務,推動健全勞(lao)動保障法(fa)(fa)律(lv)制(zhi)度,加(jia)大工(gong)(gong)會(hui)(hui)法(fa)(fa)律(lv)的援助(zhu)力度,強化(hua)新就業(ye)形態領域普法(fa)(fa)宣傳,通過(guo)(guo)扎(zha)實有效的維權(quan)服(fu)務,最大限度地把新就業(ye)形態勞(lao)動者(zhe)吸(xi)引過(guo)(guo)來、組織起來、穩固下來。開(kai)展(zhan)(zhan)“勞(lao)動用工(gong)(gong)法(fa)(fa)治(zhi)體(ti)檢”,由市及區市總工(gong)(gong)會(hui)(hui)統一(yi)(yi)(yi)安排,組建(jian)專業(ye)法(fa)(fa)律(lv)隊(dui)伍,免費對(dui)平臺企(qi)業(ye)進(jin)行風險(xian)(xian)(xian)點評估,即為企(qi)業(ye)開(kai)展(zhan)(zhan)一(yi)(yi)(yi)次(ci)法(fa)(fa)律(lv)風險(xian)(xian)(xian)“體(ti)檢”,為企(qi)業(ye)經(jing)營管理人員和(he)(he)職工(gong)(gong)開(kai)展(zhan)(zhan)一(yi)(yi)(yi)次(ci)法(fa)(fa)律(lv)講座,為企(qi)業(ye)提供一(yi)(yi)(yi)次(ci)法(fa)(fa)律(lv)和(he)(he)決策咨詢,為企(qi)業(ye)制(zhi)定(ding)(ding)一(yi)(yi)(yi)個防范和(he)(he)避免法(fa)(fa)律(lv)風險(xian)(xian)(xian)的“法(fa)(fa)律(lv)處方”,指導企(qi)業(ye)工(gong)(gong)會(hui)(hui)調(diao)處一(yi)(yi)(yi)批勞(lao)動爭議(yi)案件,協助(zhu)企(qi)業(ye)工(gong)(gong)會(hui)(hui)開(kai)展(zhan)(zhan)一(yi)(yi)(yi)次(ci)職工(gong)(gong)隊(dui)伍穩定(ding)(ding)隱患排查(cha)。通過(guo)(guo)“勞(lao)動用工(gong)(gong)法(fa)(fa)治(zhi)體(ti)檢”,從(cong)根(gen)本(ben)上規(gui)范平臺企(qi)業(ye)用工(gong)(gong),使維權(quan)關口前移(yi)。
為給新(xin)(xin)(xin)就(jiu)業形態(tai)(tai)勞(lao)(lao)動(dong)者提(ti)供優(you)質貼心服(fu)(fu)務(wu),《若干措施》還(huan)提(ti)出(chu)要(yao)完成年(nian)內新(xin)(xin)(xin)增(zeng)100個服(fu)(fu)務(wu)新(xin)(xin)(xin)就(jiu)業形態(tai)(tai)勞(lao)(lao)動(dong)者愛(ai)(ai)心服(fu)(fu)務(wu)陣地的任務(wu),同(tong)時要(yao)發揮好(hao)新(xin)(xin)(xin)時代(dai)共享區域職(zhi)(zhi)工之(zhi)家、職(zhi)(zhi)工信賴的職(zhi)(zhi)工之(zhi)家、戶(hu)外勞(lao)(lao)動(dong)者驛(yi)站、心理健康(kang)服(fu)(fu)務(wu)站點和愛(ai)(ai)心媽媽小屋等愛(ai)(ai)心服(fu)(fu)務(wu)陣地作用,讓新(xin)(xin)(xin)就(jiu)業形態(tai)(tai)勞(lao)(lao)動(dong)者體會到(dao)“家”的溫馨。
