近年來,平臺經濟迅速發展,創造了大量就業機會,依托互聯網平臺就業的網約配送員、網約車駕駛員、貨車司機等新就業形態勞動者數量大幅增加,維護勞動者勞動保障權益面臨新情況新問題。為解決這些問題,市總工會日前印發《關于維護新就業形態勞動者權益的若干措施》(以下簡稱《若干措施》),從建會入會、法律維權、貼心服務等領域對維護青島市靈活就業“八大群體”和新就業形態勞動者的權益作出具體規定。
《若(ruo)干措(cuo)施》中明確指出(chu),要(yao)通(tong)過豐(feng)富建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)渠道(dao)、創新(xin)(xin)和(he)簡(jian)化入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)流程、傾斜資源力(li)量促進建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)等(deng)方(fang)式(shi)加快推進新(xin)(xin)就(jiu)業(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)者(zhe)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)。針(zhen)對新(xin)(xin)就(jiu)業(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)者(zhe)的職(zhi)業(ye)(ye)特點,要(yao)探索不同形(xing)(xing)(xing)式(shi)的建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)形(xing)(xing)(xing)式(shi),在全市組(zu)織開展新(xin)(xin)就(jiu)業(ye)(ye)形(xing)(xing)(xing)態領域(yu)建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)集中行動(dong)(dong)。要(yao)摸清新(xin)(xin)就(jiu)業(ye)(ye)形(xing)(xing)(xing)態領域(yu)勞(lao)動(dong)(dong)者(zhe)基本情況(kuang)和(he)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)組(zu)織建(jian)(jian)(jian)設情況(kuang),建(jian)(jian)(jian)立工(gong)(gong)(gong)作臺賬,通(tong)過單獨(du)建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)、聯(lian)合建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)、行業(ye)(ye)建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)、區域(yu)建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)等(deng)多(duo)種方(fang)式(shi)建(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)。依托平(ping)臺企業(ye)(ye)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)、行業(ye)(ye)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)、社區(園區、樓宇)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)聯(lian)合會(hui)(hui)(hui)(hui)(hui)等(deng)基層工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)組(zu)織,廣泛吸(xi)收新(xin)(xin)就(jiu)業(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)者(zhe)加入(ru)(ru)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)。依托智慧工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)平(ping)臺,建(jian)(jian)(jian)設“網上職(zhi)工(gong)(gong)(gong)之家(jia)”,開通(tong)網上入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)渠道(dao),吸(xi)引新(xin)(xin)就(jiu)業(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)者(zhe)實現網上入(ru)(ru)會(hui)(hui)(hui)(hui)(hui),并分類建(jian)(jian)(jian)立新(xin)(xin)就(jiu)業(ye)(ye)形(xing)(xing)(xing)態勞(lao)動(dong)(dong)者(zhe)會(hui)(hui)(hui)(hui)(hui)員數據庫。
《若(ruo)干措施》提出,要(yao)加(jia)大專項(xiang)經(jing)(jing)(jing)費保障,按照市(shi)總(zong)工(gong)會和(he)區市(shi)總(zong)工(gong)會各負擔50%的原(yuan)則(ze)建立(li)基層工(gong)會建設專項(xiang)經(jing)(jing)(jing)費制(zhi)度,根(gen)據新就(jiu)業(ye)形(xing)態勞動者新入會人數(shu)分別(bie)給予(yu)2000元(yuan)和(he)5000元(yuan)專項(xiang)經(jing)(jing)(jing)費;建立(li)以實績(ji)為主導的差異(yi)性(xing)補貼機制(zhi),根(gen)據新就(jiu)業(ye)形(xing)態工(gong)會聯(lian)合會所轄單建(聯(lian)合)工(gong)會數(shu)、職工(gong)(會員(yuan))數(shu)、規(gui)模及工(gong)作情況,每(mei)家(jia)每(mei)年(nian)分別(bie)補助5000元(yuan)、10000元(yuan)、20000元(yuan)工(gong)作經(jing)(jing)(jing)費。
為強化新(xin)就(jiu)(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)(ye)形(xing)態(tai)(tai)(tai)(tai)勞(lao)(lao)動者(zhe)(zhe)的(de)(de)(de)權(quan)(quan)益保(bao)(bao)障(zhang),《若干措施》對勞(lao)(lao)動者(zhe)(zhe)參(can)(can)加(jia)工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)互(hu)助(zhu)保(bao)(bao)障(zhang)、關(guan)愛新(xin)就(jiu)(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)(ye)形(xing)態(tai)(tai)(tai)(tai)女職(zhi)工(gong)(gong)(gong)(gong)(gong)等(deng)做了明(ming)確要求。其中(zhong),面向參(can)(can)加(jia)城(cheng)鎮職(zhi)工(gong)(gong)(gong)(gong)(gong)基(ji)本醫療(liao)保(bao)(bao)險(xian)或(huo)城(cheng)鄉居民基(ji)本醫療(liao)保(bao)(bao)險(xian)并加(jia)入工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)組織(zhi)的(de)(de)(de)新(xin)就(jiu)(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)(ye)形(xing)態(tai)(tai)(tai)(tai)勞(lao)(lao)動者(zhe)(zhe),市總工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)贈送一年保(bao)(bao)障(zhang)期的(de)(de)(de)重大疾病、意外(wai)傷(shang)(shang)害互(hu)助(zhu)保(bao)(bao)障(zhang)計劃(hua)。鼓勵新(xin)就(jiu)(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)(ye)形(xing)態(tai)(tai)(tai)(tai)勞(lao)(lao)動者(zhe)(zhe)參(can)(can)加(jia)醫療(liao)互(hu)助(zhu)保(bao)(bao)障(zhang)計劃(hua),由市總工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)給予(yu)補(bu)助(zhu),提高(gao)他(ta)們抵(di)御風險(xian)的(de)(de)(de)能力。全(quan)市工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)將(jiang)及時(shi)指導(dao)建(jian)立健全(quan)新(xin)就(jiu)(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)(ye)形(xing)態(tai)(tai)(tai)(tai)領域(yu)基(ji)層工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)女職(zhi)工(gong)(gong)(gong)(gong)(gong)組織(zhi),指導(dao)簽(qian)訂女職(zhi)工(gong)(gong)(gong)(gong)(gong)特殊(shu)權(quan)(quan)益專項(xiang)集體合(he)同,保(bao)(bao)障(zhang)女職(zhi)工(gong)(gong)(gong)(gong)(gong)的(de)(de)(de)合(he)法權(quan)(quan)益和特殊(shu)利益;免費為2000名(ming)35—59周歲新(xin)就(jiu)(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)(ye)形(xing)態(tai)(tai)(tai)(tai)領域(yu)女會(hui)(hui)員提供 “兩癌(ai)”(乳腺(xian)癌(ai)、宮頸癌(ai))篩查,并贈送“女職(zhi)工(gong)(gong)(gong)(gong)(gong)特殊(shu)疾病保(bao)(bao)障(zhang)”。全(quan)市工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)將(jiang)以出行、外(wai)賣、即時(shi)配送、同城(cheng)貨運等(deng)行業(ye)(ye)(ye)(ye)(ye)(ye)的(de)(de)(de)平(ping)(ping)臺(tai)企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)為重點(dian),深入開展 “安(an)康(kang)杯”和“查保(bao)(bao)促”群眾性安(an)全(quan)生產活(huo)動,督導(dao)相關(guan)企(qi)業(ye)(ye)(ye)(ye)(ye)(ye)建(jian)立健全(quan)新(xin)就(jiu)(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)(ye)形(xing)態(tai)(tai)(tai)(tai)工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)預防機制(zhi),推進工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)預防、工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)補(bu)償(chang)、工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)康(kang)復相結(jie)合(he)的(de)(de)(de)工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)保(bao)(bao)險(xian)制(zhi)度,提升(sheng)新(xin)就(jiu)(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)(ye)形(xing)態(tai)(tai)(tai)(tai)勞(lao)(lao)動者(zhe)(zhe)保(bao)(bao)障(zhang)水平(ping)(ping)。
《若干措施》倡導強化(hua)法(fa)(fa)律(lv)(lv)維權(quan)服務,推動(dong)(dong)健全(quan)勞(lao)動(dong)(dong)保障法(fa)(fa)律(lv)(lv)制度(du)(du)(du),加大(da)工(gong)(gong)會法(fa)(fa)律(lv)(lv)的援助(zhu)力度(du)(du)(du),強化(hua)新(xin)就業(ye)(ye)(ye)(ye)(ye)形(xing)態領域普法(fa)(fa)宣傳,通過扎實有效(xiao)的維權(quan)服務,最大(da)限度(du)(du)(du)地(di)把(ba)新(xin)就業(ye)(ye)(ye)(ye)(ye)形(xing)態勞(lao)動(dong)(dong)者吸引(yin)過來、組(zu)織起來、穩固下來。開展“勞(lao)動(dong)(dong)用工(gong)(gong)法(fa)(fa)治體(ti)檢(jian)”,由市及區市總工(gong)(gong)會統一安排,組(zu)建(jian)專(zhuan)業(ye)(ye)(ye)(ye)(ye)法(fa)(fa)律(lv)(lv)隊(dui)伍,免費對平(ping)臺企(qi)業(ye)(ye)(ye)(ye)(ye)進(jin)行風險點評估,即(ji)為(wei)企(qi)業(ye)(ye)(ye)(ye)(ye)開展一次(ci)法(fa)(fa)律(lv)(lv)風險“體(ti)檢(jian)”,為(wei)企(qi)業(ye)(ye)(ye)(ye)(ye)經營管理(li)人員和職工(gong)(gong)開展一次(ci)法(fa)(fa)律(lv)(lv)講座,為(wei)企(qi)業(ye)(ye)(ye)(ye)(ye)提供一次(ci)法(fa)(fa)律(lv)(lv)和決策咨(zi)詢,為(wei)企(qi)業(ye)(ye)(ye)(ye)(ye)制定一個防(fang)范和避(bi)免法(fa)(fa)律(lv)(lv)風險的“法(fa)(fa)律(lv)(lv)處方”,指導企(qi)業(ye)(ye)(ye)(ye)(ye)工(gong)(gong)會調(diao)處一批勞(lao)動(dong)(dong)爭議案件(jian),協助(zhu)企(qi)業(ye)(ye)(ye)(ye)(ye)工(gong)(gong)會開展一次(ci)職工(gong)(gong)隊(dui)伍穩定隱患排查。通過“勞(lao)動(dong)(dong)用工(gong)(gong)法(fa)(fa)治體(ti)檢(jian)”,從(cong)根本上規(gui)范平(ping)臺企(qi)業(ye)(ye)(ye)(ye)(ye)用工(gong)(gong),使維權(quan)關口前移。
為給新就業(ye)形態勞動(dong)(dong)(dong)者提供優(you)質(zhi)貼心(xin)服務(wu),《若干措(cuo)施》還提出要(yao)完(wan)成年內(nei)新增(zeng)100個服務(wu)新就業(ye)形態勞動(dong)(dong)(dong)者愛(ai)(ai)心(xin)服務(wu)陣(zhen)(zhen)地的(de)任務(wu),同時(shi)要(yao)發揮好新時(shi)代共享區域職(zhi)工之家(jia)、職(zhi)工信賴的(de)職(zhi)工之家(jia)、戶(hu)外勞動(dong)(dong)(dong)者驛站、心(xin)理健康(kang)服務(wu)站點和愛(ai)(ai)心(xin)媽媽小屋等愛(ai)(ai)心(xin)服務(wu)陣(zhen)(zhen)地作用,讓新就業(ye)形態勞動(dong)(dong)(dong)者體會到“家(jia)”的(de)溫馨。
