近年來,平臺經濟迅速發展,創造了大量就業機會,依托互聯網平臺就業的網約配送員、網約車駕駛員、貨車司機等新就業形態勞動者數量大幅增加,維護勞動者勞動保障權益面臨新情況新問題。為解決這些問題,市總工會日前印發《關于維護新就業形態勞動者權益的若干措施》(以下簡稱《若干措施》),從建會入會、法律維權、貼心服務等領域對維護青島市靈活就業“八大群體”和新就業形態勞動者的權益作出具體規定。

  《若干措施》中明確指出,要通過豐富建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)渠道、創新(xin)(xin)和簡化(hua)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)流程、傾斜資(zi)源力(li)量促(cu)進建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)等(deng)方式(shi)(shi)加快推(tui)進新(xin)(xin)就業(ye)形(xing)(xing)(xing)態(tai)(tai)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)。針對新(xin)(xin)就業(ye)形(xing)(xing)(xing)態(tai)(tai)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)的(de)職(zhi)業(ye)特點,要探索不同形(xing)(xing)(xing)式(shi)(shi)的(de)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)形(xing)(xing)(xing)式(shi)(shi),在全市(shi)組(zu)織開展(zhan)新(xin)(xin)就業(ye)形(xing)(xing)(xing)態(tai)(tai)領(ling)域建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)集(ji)中行動(dong)(dong)(dong)。要摸清新(xin)(xin)就業(ye)形(xing)(xing)(xing)態(tai)(tai)領(ling)域勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)基本(ben)情況和工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)組(zu)織建(jian)(jian)(jian)(jian)設(she)情況,建(jian)(jian)(jian)(jian)立(li)工(gong)作臺(tai)賬(zhang),通過單(dan)獨建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)、聯(lian)合(he)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)、行業(ye)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)、區(qu)域建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)等(deng)多種方式(shi)(shi)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)。依(yi)托(tuo)平臺(tai)企業(ye)工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)、行業(ye)工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)、社區(qu)(園區(qu)、樓(lou)宇(yu))工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)聯(lian)合(he)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)等(deng)基層工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)組(zu)織,廣泛(fan)吸(xi)收新(xin)(xin)就業(ye)形(xing)(xing)(xing)態(tai)(tai)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)加入(ru)(ru)工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)。依(yi)托(tuo)智慧工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)平臺(tai),建(jian)(jian)(jian)(jian)設(she)“網(wang)上職(zhi)工(gong)之家”,開通網(wang)上入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)渠道,吸(xi)引新(xin)(xin)就業(ye)形(xing)(xing)(xing)態(tai)(tai)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)實現網(wang)上入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)(hui)(hui),并分類建(jian)(jian)(jian)(jian)立(li)新(xin)(xin)就業(ye)形(xing)(xing)(xing)態(tai)(tai)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)員數據庫。

  《若干(gan)措施》提出,要加大專(zhuan)(zhuan)項經(jing)費(fei)(fei)保障,按照(zhao)市(shi)總工會(hui)和(he)區市(shi)總工會(hui)各(ge)負(fu)擔50%的(de)(de)原則(ze)建(jian)立基層工會(hui)建(jian)設專(zhuan)(zhuan)項經(jing)費(fei)(fei)制(zhi)度,根據新(xin)就業形態勞動者(zhe)新(xin)入會(hui)人數分別給予2000元(yuan)和(he)5000元(yuan)專(zhuan)(zhuan)項經(jing)費(fei)(fei);建(jian)立以實績為主導的(de)(de)差異性(xing)補貼機制(zhi),根據新(xin)就業形態工會(hui)聯(lian)(lian)合(he)會(hui)所轄(xia)單(dan)建(jian)(聯(lian)(lian)合(he))工會(hui)數、職工(會(hui)員)數、規模(mo)及工作(zuo)情況,每家每年分別補助5000元(yuan)、10000元(yuan)、20000元(yuan)工作(zuo)經(jing)費(fei)(fei)。

  為(wei)強化新(xin)就(jiu)(jiu)業(ye)(ye)形態(tai)勞(lao)動(dong)(dong)者的(de)權益保(bao)(bao)障(zhang)(zhang),《若(ruo)干(gan)措施》對勞(lao)動(dong)(dong)者參加(jia)工(gong)(gong)(gong)會(hui)(hui)互助保(bao)(bao)障(zhang)(zhang)、關(guan)愛新(xin)就(jiu)(jiu)業(ye)(ye)形態(tai)女(nv)職(zhi)(zhi)工(gong)(gong)(gong)等做(zuo)了明確要求。其中(zhong),面向參加(jia)城(cheng)(cheng)鎮職(zhi)(zhi)工(gong)(gong)(gong)基本(ben)醫療(liao)保(bao)(bao)險(xian)(xian)或城(cheng)(cheng)鄉居(ju)民基本(ben)醫療(liao)保(bao)(bao)險(xian)(xian)并加(jia)入工(gong)(gong)(gong)會(hui)(hui)組織的(de)新(xin)就(jiu)(jiu)業(ye)(ye)形態(tai)勞(lao)動(dong)(dong)者,市總(zong)工(gong)(gong)(gong)會(hui)(hui)贈送(song)一年保(bao)(bao)障(zhang)(zhang)期的(de)重大疾(ji)病、意外傷(shang)害互助保(bao)(bao)障(zhang)(zhang)計劃(hua)。鼓勵新(xin)就(jiu)(jiu)業(ye)(ye)形態(tai)勞(lao)動(dong)(dong)者參加(jia)醫療(liao)互助保(bao)(bao)障(zhang)(zhang)計劃(hua),由市總(zong)工(gong)(gong)(gong)會(hui)(hui)給予補助,提高他們抵(di)御(yu)風險(xian)(xian)的(de)能力。全市工(gong)(gong)(gong)會(hui)(hui)將及(ji)時指導(dao)建(jian)立健全新(xin)就(jiu)(jiu)業(ye)(ye)形態(tai)領域基層工(gong)(gong)(gong)會(hui)(hui)女(nv)職(zhi)(zhi)工(gong)(gong)(gong)組織,指導(dao)簽(qian)訂(ding)女(nv)職(zhi)(zhi)工(gong)(gong)(gong)特(te)(te)殊(shu)權益專項集體合(he)同(tong),保(bao)(bao)障(zhang)(zhang)女(nv)職(zhi)(zhi)工(gong)(gong)(gong)的(de)合(he)法權益和特(te)(te)殊(shu)利益;免費為(wei)2000名35—59周(zhou)歲新(xin)就(jiu)(jiu)業(ye)(ye)形態(tai)領域女(nv)會(hui)(hui)員提供 “兩癌”(乳腺(xian)癌、宮(gong)頸(jing)癌)篩查(cha),并贈送(song)“女(nv)職(zhi)(zhi)工(gong)(gong)(gong)特(te)(te)殊(shu)疾(ji)病保(bao)(bao)障(zhang)(zhang)”。全市工(gong)(gong)(gong)會(hui)(hui)將以出(chu)行(xing)、外賣、即時配送(song)、同(tong)城(cheng)(cheng)貨運(yun)等行(xing)業(ye)(ye)的(de)平(ping)(ping)臺企(qi)業(ye)(ye)為(wei)重點(dian),深入開展 “安(an)康(kang)杯”和“查(cha)保(bao)(bao)促”群眾性安(an)全生(sheng)產活動(dong)(dong),督(du)導(dao)相(xiang)(xiang)關(guan)企(qi)業(ye)(ye)建(jian)立健全新(xin)就(jiu)(jiu)業(ye)(ye)形態(tai)工(gong)(gong)(gong)傷(shang)預(yu)防機制(zhi),推進工(gong)(gong)(gong)傷(shang)預(yu)防、工(gong)(gong)(gong)傷(shang)補償、工(gong)(gong)(gong)傷(shang)康(kang)復相(xiang)(xiang)結合(he)的(de)工(gong)(gong)(gong)傷(shang)保(bao)(bao)險(xian)(xian)制(zhi)度(du),提升新(xin)就(jiu)(jiu)業(ye)(ye)形態(tai)勞(lao)動(dong)(dong)者保(bao)(bao)障(zhang)(zhang)水平(ping)(ping)。

《若干措施》倡(chang)導強(qiang)化法(fa)(fa)(fa)(fa)律(lv)(lv)維權(quan)服(fu)務,推動(dong)(dong)(dong)健全勞動(dong)(dong)(dong)保(bao)障(zhang)法(fa)(fa)(fa)(fa)律(lv)(lv)制度(du),加大(da)工(gong)(gong)會(hui)(hui)法(fa)(fa)(fa)(fa)律(lv)(lv)的(de)援助力(li)度(du),強(qiang)化新就(jiu)業(ye)形態(tai)領(ling)域(yu)普法(fa)(fa)(fa)(fa)宣傳,通(tong)過扎實(shi)有效的(de)維權(quan)服(fu)務,最大(da)限度(du)地把新就(jiu)業(ye)形態(tai)勞動(dong)(dong)(dong)者吸引過來、組織(zhi)起來、穩固下來。開(kai)(kai)展“勞動(dong)(dong)(dong)用工(gong)(gong)法(fa)(fa)(fa)(fa)治體(ti)(ti)檢”,由市(shi)及區(qu)市(shi)總工(gong)(gong)會(hui)(hui)統一(yi)(yi)安(an)排,組建專(zhuan)業(ye)法(fa)(fa)(fa)(fa)律(lv)(lv)隊伍,免費對平(ping)臺企(qi)業(ye)進行風(feng)(feng)險(xian)點評估,即(ji)為(wei)(wei)企(qi)業(ye)開(kai)(kai)展一(yi)(yi)次法(fa)(fa)(fa)(fa)律(lv)(lv)風(feng)(feng)險(xian)“體(ti)(ti)檢”,為(wei)(wei)企(qi)業(ye)經營管理(li)人員和(he)職工(gong)(gong)開(kai)(kai)展一(yi)(yi)次法(fa)(fa)(fa)(fa)律(lv)(lv)講座,為(wei)(wei)企(qi)業(ye)提供(gong)一(yi)(yi)次法(fa)(fa)(fa)(fa)律(lv)(lv)和(he)決(jue)策咨詢(xun),為(wei)(wei)企(qi)業(ye)制定(ding)一(yi)(yi)個防范(fan)和(he)避(bi)免法(fa)(fa)(fa)(fa)律(lv)(lv)風(feng)(feng)險(xian)的(de)“法(fa)(fa)(fa)(fa)律(lv)(lv)處方”,指(zhi)導企(qi)業(ye)工(gong)(gong)會(hui)(hui)調處一(yi)(yi)批勞動(dong)(dong)(dong)爭議案件,協(xie)助企(qi)業(ye)工(gong)(gong)會(hui)(hui)開(kai)(kai)展一(yi)(yi)次職工(gong)(gong)隊伍穩定(ding)隱患排查。通(tong)過“勞動(dong)(dong)(dong)用工(gong)(gong)法(fa)(fa)(fa)(fa)治體(ti)(ti)檢”,從根本上(shang)規范(fan)平(ping)臺企(qi)業(ye)用工(gong)(gong),使維權(quan)關口(kou)前移。

  為(wei)給(gei)新就業(ye)(ye)形態(tai)(tai)勞(lao)動(dong)者提供(gong)優質貼心(xin)(xin)服(fu)務,《若干措(cuo)施》還提出要完成(cheng)年內(nei)新增100個服(fu)務新就業(ye)(ye)形態(tai)(tai)勞(lao)動(dong)者愛心(xin)(xin)服(fu)務陣(zhen)地的任務,同時要發揮好新時代(dai)共(gong)享區(qu)域職工之家、職工信賴的職工之家、戶外勞(lao)動(dong)者驛(yi)站、心(xin)(xin)理健(jian)康服(fu)務站點和愛心(xin)(xin)媽媽小屋等愛心(xin)(xin)服(fu)務陣(zhen)地作(zuo)用,讓新就業(ye)(ye)形態(tai)(tai)勞(lao)動(dong)者體會到“家”的溫馨(xin)。
