  我(wo)畢業后(hou)休整一段時(shi)間(jian)就(jiu)開(kai)始找工作。現在,有家(jia)公司與我(wo)談過后(hou),雙(shuang)方都覺得合適,準(zhun)備簽訂勞(lao)動合同(tong)。

  由于(yu)對勞動合同(tong)比較陌(mo)生,我想咨(zi)詢(xun)一(yi)下試用期有多久?此外,試用期的工資是如何規定的?

  答:根(gen)據《勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong)法(fa)》第十九(jiu)條的(de)規定(ding),勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong)期(qi)限(xian)三(san)個(ge)月(yue)以上(shang)不(bu)(bu)(bu)滿一(yi)(yi)年的(de),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)不(bu)(bu)(bu)得超過一(yi)(yi)個(ge)月(yue);勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong)期(qi)限(xian)一(yi)(yi)年以上(shang)不(bu)(bu)(bu)滿三(san)年的(de),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)不(bu)(bu)(bu)得超過二個(ge)月(yue);三(san)年以上(shang)固定(ding)期(qi)限(xian)和(he)無固定(ding)期(qi)限(xian)的(de)勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)不(bu)(bu)(bu)得超過六個(ge)月(yue)。同(tong)(tong)(tong)一(yi)(yi)用(yong)(yong)(yong)(yong)人(ren)單位與同(tong)(tong)(tong)一(yi)(yi)勞(lao)(lao)動(dong)者只能約(yue)定(ding)一(yi)(yi)次試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)。以完(wan)成一(yi)(yi)定(ding)工(gong)作任(ren)務為期(qi)限(xian)的(de)勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong)或者勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong)期(qi)限(xian)不(bu)(bu)(bu)滿三(san)個(ge)月(yue)的(de),不(bu)(bu)(bu)得約(yue)定(ding)試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)。試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)包(bao)含在勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong)期(qi)限(xian)內。勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong)僅約(yue)定(ding)試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)的(de),試(shi)(shi)用(yong)(yong)(yong)(yong)期(qi)不(bu)(bu)(bu)成立(li),該期(qi)限(xian)為勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)(tong)(tong)期(qi)限(xian)。

  《勞動合同(tong)法》第二(er)十條(tiao)規定,勞動者(zhe)在(zai)試用期的(de)(de)工(gong)資(zi)(zi)不得低(di)于(yu)本單位(wei)(wei)相同(tong)崗位(wei)(wei)最低(di)檔工(gong)資(zi)(zi)或(huo)者(zhe)勞動合同(tong)約定工(gong)資(zi)(zi)的(de)(de)百分之八十,并不得低(di)于(yu)用人單位(wei)(wei)所(suo)在(zai)地的(de)(de)最低(di)工(gong)資(zi)(zi)標準。

  據(ju)此,根據(ju)《勞動(dong)合同法》第十九條、二十條,試用(yong)期(qi)的(de)(de)長短應(ying)根據(ju)勞動(dong)合同的(de)(de)期(qi)限來具(ju)體規定(ding),試用(yong)期(qi)的(de)(de)工(gong)資(zi)(zi)(zi)不得低(di)(di)于本單位(wei)相(xiang)同崗位(wei)最低(di)(di)檔工(gong)資(zi)(zi)(zi)或者勞動(dong)合同約定(ding)工(gong)資(zi)(zi)(zi)的(de)(de)80%,并不得低(di)(di)于用(yong)人單位(wei)所在(zai)地的(de)(de)最低(di)(di)工(gong)資(zi)(zi)(zi)標準。

  第十九條(tiao) 勞動合同(tong)期(qi)限(xian)三個(ge)(ge)月以(yi)(yi)上(shang)不滿(man)一年的(de),試用期(qi)不得(de)超過一個(ge)(ge)月;勞動合同(tong)期(qi)限(xian)一年以(yi)(yi)上(shang)不滿(man)三年的(de),試用期(qi)不得(de)超過二個(ge)(ge)月;三年以(yi)(yi)上(shang)固定(ding)(ding)期(qi)限(xian)和無(wu)固定(ding)(ding)期(qi)限(xian)的(de)勞動合同(tong),試用期(qi)不得(de)超過六個(ge)(ge)月。

  同一(yi)用(yong)人單位與同一(yi)勞(lao)動者只能約定一(yi)次試用(yong)期。

  以(yi)完成(cheng)一(yi)定工作任務為(wei)期限(xian)的勞動(dong)合同或者勞動(dong)合同期限(xian)不(bu)滿三個月的,不(bu)得約定試用(yong)期。

  試(shi)用(yong)期(qi)包(bao)含在(zai)勞(lao)動合(he)同(tong)期(qi)限(xian)(xian)內。勞(lao)動合(he)同(tong)僅約(yue)定試(shi)用(yong)期(qi)的,試(shi)用(yong)期(qi)不成立,該期(qi)限(xian)(xian)為勞(lao)動合(he)同(tong)期(qi)限(xian)(xian)。

  第(di)二十條 勞動(dong)者在試用期的(de)(de)工(gong)資(zi)不得低(di)于(yu)本單位(wei)相同崗位(wei)最(zui)低(di)檔工(gong)資(zi)或(huo)者勞動(dong)合同約定工(gong)資(zi)的(de)(de)80%,并不得低(di)于(yu)用人單位(wei)所在地的(de)(de)最(zui)低(di)工(gong)資(zi)標準。
