答:根據(ju)《勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)法》第十九(jiu)條的(de)(de)規(gui)定(ding)(ding),勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)期(qi)限三(san)(san)個(ge)月以(yi)上不(bu)滿(man)一(yi)(yi)年(nian)的(de)(de),試(shi)(shi)用(yong)期(qi)不(bu)得(de)超過(guo)一(yi)(yi)個(ge)月;勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)期(qi)限一(yi)(yi)年(nian)以(yi)上不(bu)滿(man)三(san)(san)年(nian)的(de)(de),試(shi)(shi)用(yong)期(qi)不(bu)得(de)超過(guo)二(er)個(ge)月;三(san)(san)年(nian)以(yi)上固定(ding)(ding)期(qi)限和(he)無固定(ding)(ding)期(qi)限的(de)(de)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong),試(shi)(shi)用(yong)期(qi)不(bu)得(de)超過(guo)六(liu)個(ge)月。同(tong)(tong)(tong)一(yi)(yi)用(yong)人單位與同(tong)(tong)(tong)一(yi)(yi)勞(lao)(lao)(lao)動(dong)者(zhe)只能約(yue)定(ding)(ding)一(yi)(yi)次試(shi)(shi)用(yong)期(qi)。以(yi)完成一(yi)(yi)定(ding)(ding)工作任務為期(qi)限的(de)(de)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)或者(zhe)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)期(qi)限不(bu)滿(man)三(san)(san)個(ge)月的(de)(de),不(bu)得(de)約(yue)定(ding)(ding)試(shi)(shi)用(yong)期(qi)。試(shi)(shi)用(yong)期(qi)包含(han)在(zai)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)期(qi)限內(nei)。勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)僅約(yue)定(ding)(ding)試(shi)(shi)用(yong)期(qi)的(de)(de),試(shi)(shi)用(yong)期(qi)不(bu)成立,該(gai)期(qi)限為勞(lao)(lao)(lao)動(dong)合同(tong)(tong)(tong)期(qi)限。
《勞動合同法》第二十條規定(ding),勞動者在試用期(qi)的工資(zi)(zi)不得(de)低于本單(dan)位相同崗位最(zui)低檔工資(zi)(zi)或(huo)者勞動合同約定(ding)工資(zi)(zi)的百分之八十,并不得(de)低于用人單(dan)位所在地的最(zui)低工資(zi)(zi)標準。
據(ju)(ju)此(ci),根(gen)據(ju)(ju)《勞動(dong)(dong)合(he)同法》第(di)十九條、二十條,試用期(qi)的(de)(de)長短應根(gen)據(ju)(ju)勞動(dong)(dong)合(he)同的(de)(de)期(qi)限來具體規定,試用期(qi)的(de)(de)工(gong)資(zi)不得低(di)于本單位(wei)相同崗位(wei)最(zui)低(di)檔工(gong)資(zi)或者(zhe)勞動(dong)(dong)合(he)同約定工(gong)資(zi)的(de)(de)80%,并不得低(di)于用人(ren)單位(wei)所(suo)在地的(de)(de)最(zui)低(di)工(gong)資(zi)標準。

第十九條 勞(lao)動(dong)合(he)同期限(xian)三個(ge)(ge)月(yue)以(yi)上(shang)不(bu)滿一(yi)年(nian)的,試(shi)用(yong)期不(bu)得超(chao)過一(yi)個(ge)(ge)月(yue);勞(lao)動(dong)合(he)同期限(xian)一(yi)年(nian)以(yi)上(shang)不(bu)滿三年(nian)的,試(shi)用(yong)期不(bu)得超(chao)過二(er)個(ge)(ge)月(yue);三年(nian)以(yi)上(shang)固定期限(xian)和無固定期限(xian)的勞(lao)動(dong)合(he)同,試(shi)用(yong)期不(bu)得超(chao)過六個(ge)(ge)月(yue)。
同一(yi)用人(ren)單位與同一(yi)勞動者只能約定一(yi)次試用期。
以完成一定工作任務為期限(xian)(xian)的(de)(de)勞動合(he)同或者(zhe)勞動合(he)同期限(xian)(xian)不滿三個月的(de)(de),不得約定試用期。
試用(yong)期(qi)(qi)包含在(zai)勞(lao)動合同(tong)(tong)期(qi)(qi)限內。勞(lao)動合同(tong)(tong)僅約定試用(yong)期(qi)(qi)的(de),試用(yong)期(qi)(qi)不成立,該期(qi)(qi)限為勞(lao)動合同(tong)(tong)期(qi)(qi)限。
第二十條 勞(lao)動者在試用期的(de)工(gong)資不(bu)得(de)低(di)(di)于(yu)本單位相同崗位最低(di)(di)檔(dang)工(gong)資或者勞(lao)動合同約定工(gong)資的(de)80%,并不(bu)得(de)低(di)(di)于(yu)用人單位所在地的(de)最低(di)(di)工(gong)資標準(zhun)。
