答:根據(ju)《勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)法》第(di)十九條的(de)規定(ding)(ding),勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)期(qi)(qi)限(xian)(xian)三(san)(san)個(ge)(ge)(ge)月(yue)(yue)以上不(bu)滿一年的(de),試(shi)用(yong)(yong)(yong)期(qi)(qi)不(bu)得超過(guo)(guo)一個(ge)(ge)(ge)月(yue)(yue);勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)期(qi)(qi)限(xian)(xian)一年以上不(bu)滿三(san)(san)年的(de),試(shi)用(yong)(yong)(yong)期(qi)(qi)不(bu)得超過(guo)(guo)二個(ge)(ge)(ge)月(yue)(yue);三(san)(san)年以上固定(ding)(ding)期(qi)(qi)限(xian)(xian)和無(wu)固定(ding)(ding)期(qi)(qi)限(xian)(xian)的(de)勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong),試(shi)用(yong)(yong)(yong)期(qi)(qi)不(bu)得超過(guo)(guo)六個(ge)(ge)(ge)月(yue)(yue)。同(tong)(tong)一用(yong)(yong)(yong)人單位與同(tong)(tong)一勞(lao)(lao)動(dong)(dong)者(zhe)只能約定(ding)(ding)一次試(shi)用(yong)(yong)(yong)期(qi)(qi)。以完(wan)成(cheng)一定(ding)(ding)工作(zuo)任務(wu)為(wei)期(qi)(qi)限(xian)(xian)的(de)勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)或者(zhe)勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)期(qi)(qi)限(xian)(xian)不(bu)滿三(san)(san)個(ge)(ge)(ge)月(yue)(yue)的(de),不(bu)得約定(ding)(ding)試(shi)用(yong)(yong)(yong)期(qi)(qi)。試(shi)用(yong)(yong)(yong)期(qi)(qi)包含在勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)期(qi)(qi)限(xian)(xian)內。勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)僅約定(ding)(ding)試(shi)用(yong)(yong)(yong)期(qi)(qi)的(de),試(shi)用(yong)(yong)(yong)期(qi)(qi)不(bu)成(cheng)立,該期(qi)(qi)限(xian)(xian)為(wei)勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)期(qi)(qi)限(xian)(xian)。
《勞動合同法》第二十(shi)條規定(ding),勞動者在試(shi)用(yong)期的工(gong)資(zi)不(bu)得低(di)于(yu)本單位相同崗位最低(di)檔工(gong)資(zi)或(huo)者勞動合同約定(ding)工(gong)資(zi)的百分之八十(shi),并不(bu)得低(di)于(yu)用(yong)人單位所在地的最低(di)工(gong)資(zi)標(biao)準。
據(ju)此,根據(ju)《勞(lao)動(dong)合(he)(he)(he)同法》第(di)十(shi)九(jiu)條(tiao)、二十(shi)條(tiao),試用期(qi)的(de)長(chang)短應根據(ju)勞(lao)動(dong)合(he)(he)(he)同的(de)期(qi)限來具體規定,試用期(qi)的(de)工資(zi)不得低(di)于本單位(wei)相同崗位(wei)最低(di)檔工資(zi)或者(zhe)勞(lao)動(dong)合(he)(he)(he)同約定工資(zi)的(de)80%,并不得低(di)于用人單位(wei)所在(zai)地的(de)最低(di)工資(zi)標準。

第十九條 勞動(dong)(dong)合(he)同(tong)期(qi)(qi)限(xian)三(san)個月(yue)以上(shang)不(bu)滿一年的(de)(de),試(shi)用(yong)(yong)期(qi)(qi)不(bu)得超過一個月(yue);勞動(dong)(dong)合(he)同(tong)期(qi)(qi)限(xian)一年以上(shang)不(bu)滿三(san)年的(de)(de),試(shi)用(yong)(yong)期(qi)(qi)不(bu)得超過二(er)個月(yue);三(san)年以上(shang)固(gu)定期(qi)(qi)限(xian)和無(wu)固(gu)定期(qi)(qi)限(xian)的(de)(de)勞動(dong)(dong)合(he)同(tong),試(shi)用(yong)(yong)期(qi)(qi)不(bu)得超過六個月(yue)。
同一(yi)用人單位與同一(yi)勞動者(zhe)只能約定一(yi)次(ci)試(shi)用期。
以完成一定工(gong)作任務為期限(xian)的勞動(dong)合(he)同(tong)或(huo)者勞動(dong)合(he)同(tong)期限(xian)不滿三個月的,不得(de)約定試(shi)用期。
試(shi)用期包含在(zai)勞(lao)動(dong)合(he)同(tong)(tong)期限(xian)內(nei)。勞(lao)動(dong)合(he)同(tong)(tong)僅約定(ding)試(shi)用期的,試(shi)用期不(bu)成立(li),該期限(xian)為勞(lao)動(dong)合(he)同(tong)(tong)期限(xian)。
第二十條 勞(lao)動者(zhe)在試用期的(de)(de)工資不(bu)得低(di)于本單(dan)位(wei)相同崗位(wei)最低(di)檔工資或者(zhe)勞(lao)動合同約定工資的(de)(de)80%,并不(bu)得低(di)于用人(ren)單(dan)位(wei)所(suo)在地的(de)(de)最低(di)工資標準。
