近日(ri),山東省濟南市歷下(xia)區山大路社區的調(diao)解員(yuan)趕(gan)赴一家醫(yi)藥研究(jiu)院,現場(chang)處理了(le)一起欠薪糾紛(fen)。不久前,該研究(jiu)院的一處房屋(wu)進(jin)行(xing)屋(wu)頂修繕,項目完工(gong)后,承包人(ren)拖(tuo)欠工(gong)人(ren)工(gong)資。無奈之下(xia),情(qing)緒(xu)激(ji)動(dong)的工(gong)人(ren)來到施工(gong)現場(chang),想要(yao)討個說法。調(diao)解員(yuan)趕(gan)赴現場(chang)后,一邊安(an)撫工(gong)人(ren)的情(qing)緒(xu),一邊聯系司法、綜(zong)治(zhi)、公安(an)等部門介(jie)入追繳欠薪,最(zui)終幫助(zhu)農(nong)民(min)工(gong)順利拿到了(le)工(gong)資。
近年來,濟南市(shi)(shi)堅持將矛盾糾紛解(jie)決(jue)在(zai)基(ji)層的工作原則,投入大量人力物力財力,搭(da)建起覆蓋(gai)全市(shi)(shi)146個(ge)鄉(xiang)鎮(街道)、95%的大中型(xing)企業以(yi)及90%的科教文衛(wei)事業單位、非公(gong)企業的勞動人事爭(zheng)議調解(jie)組織網絡,許多(duo)矛盾糾紛不出企業、不出社區、不出街道就能輕(qing)松化解(jie)。2018年,濟南市(shi)(shi)各級(ji)調解(jie)組織調解(jie)成功(gong)率達(da)70.2%。
樓宇企業有了“調解站”
2017年初,濟南市研發(fa)了“全(quan)(quan)市勞動人事(shi)爭議調(diao)解仲裁網(wang)格化(hua)管(guan)理系統”,將(jiang)全(quan)(quan)市調(diao)解組(zu)織納入(ru)網(wang)格化(hua)管(guan)理系統并生成“電子地圖”。網(wang)格化(hua)管(guan)理模式的(de)引入(ru),為建(jian)立健全(quan)(quan)多層級勞動人事(shi)爭議調(diao)解組(zu)織網(wang)絡(luo)提供(gong)了便利(li)。
今年1月(yue)15日,濟(ji)南市(shi)歷下區文東街道勞(lao)動人事(shi)爭議(yi)調解中(zhong)心(xin)負責人帶(dai)領業(ye)務骨干來到轄(xia)區的創展(zhan)中(zhong)心(xin),召(zhao)開樓宇(yu)企業(ye)勞(lao)動關系(xi)調解聯(lian)席會,與數十(shi)家(jia)樓宇(yu)企業(ye)負責人面(mian)(mian)對面(mian)(mian)交(jiao)流,解答了企業(ye)用工、勞(lao)動保(bao)障等(deng)方面(mian)(mian)的現場咨詢。
“樓宇是(shi)企業用工集(ji)結地,容易(yi)發(fa)生勞(lao)動爭議(yi)。我(wo)們嘗試(shi)以樓宇為單位(wei)創建調解組織,以便深入(ru)宣傳勞(lao)動保障法律(lv)法規,規范企業用工行為。”文東街道勞(lao)動人事爭議(yi)調解中心負(fu)責人表示。
文東(dong)街道勞動人事爭(zheng)議(yi)調解中心作(zuo)為(wei)(wei)(wei)人社(she)(she)部確定的全(quan)國綜合示范單位(wei),積(ji)極探索網(wang)(wang)格化(hua)工(gong)作(zuo)模式,組建起街道、社(she)(she)區(qu)和樓宇(yu)三級(ji)調解組織(zhi)網(wang)(wang)絡。他們將13個社(she)(she)區(qu)作(zuo)為(wei)(wei)(wei)13個大網(wang)(wang)格,再以居民(min)樓院、商務(wu)樓宇(yu)、各類市場、社(she)(she)會(hui)組織(zhi)為(wei)(wei)(wei)單位(wei),細分為(wei)(wei)(wei)81個小網(wang)(wang)格,通過召(zhao)開(kai)座談會(hui)、舉辦法律講座等形(xing)式,指導企業規范用工(gong),大大減少了勞動爭(zheng)議(yi)發生率。
爭議化解有了“聯動隊”
前不久,文(wen)東街道(dao)誠基社(she)區的(de)調(diao)(diao)(diao)解(jie)員(yuan)在巡查(cha)時發現,一家物業(ye)公司(si)的(de)160名保潔(jie)、保安(an)和管理人(ren)員(yuan)因公司(si)拖(tuo)欠工資(zi)集體脫(tuo)崗,導(dao)致社(she)區環境臟亂。了解(jie)情(qing)況(kuang)后(hou),文(wen)東街道(dao)調(diao)(diao)(diao)解(jie)委員(yuan)會(hui)第(di)一時間介入,在多次調(diao)(diao)(diao)解(jie)無果的(de)情(qing)況(kuang)下,協(xie)調(diao)(diao)(diao)區勞動(dong)保障監察(cha)大隊、住建局、物業(ye)公司(si)、派出所、社(she)區居委會(hui)等(deng)多個機構,共同召開物業(ye)公司(si)欠薪專題會(hui),成功解(jie)決了這起涉案(an)金額達150萬元的(de)欠薪案(an)件。
近年來,濟南市人社局進一步加強(qiang)勞動人事(shi)爭(zheng)議多(duo)元處理機制建(jian)設(she),加大與工會(hui)、企業(ye)、綜治等部門的協調聯動,推(tui)出一系列新(xin)政策、新(xin)舉措。
2018年5月(yue),濟南市人社局會同市工(gong)(gong)(gong)會、人民法院、財政局等9個(ge)部門(men)聯合(he)印(yin)發(fa)《濟南市勞(lao)(lao)動(dong)人事爭(zheng)(zheng)(zheng)議(yi)調解(jie)(jie)工(gong)(gong)(gong)作(zuo)辦法》,就加強爭(zheng)(zheng)(zheng)議(yi)預(yu)(yu)防(fang)調解(jie)(jie)、完善爭(zheng)(zheng)(zheng)議(yi)多元處(chu)理、堅持多方協調聯動(dong)參與等工(gong)(gong)(gong)作(zuo),明確職(zhi)責分(fen)工(gong)(gong)(gong),加強各部門(men)在爭(zheng)(zheng)(zheng)議(yi)調解(jie)(jie)工(gong)(gong)(gong)作(zuo)中的(de)協作(zuo)配合(he);8月(yue),濟南市總工(gong)(gong)(gong)會、人社局、司法局、人民法院四(si)部門(men)聯合(he)印(yin)發(fa)《關于建立“四(si)方聯動(dong)”機制(zhi)加強勞(lao)(lao)動(dong)關系矛盾預(yu)(yu)防(fang)化(hua)解(jie)(jie)工(gong)(gong)(gong)作(zuo)的(de)意見(jian)》,建立健全了勞(lao)(lao)動(dong)關系矛盾信息排查預(yu)(yu)警預(yu)(yu)報(bao)、快(kuai)速(su)處(chu)置應急(ji)聯動(dong)、后(hou)續跟(gen)蹤督促整改等機制(zhi),為勞(lao)(lao)動(dong)人事爭(zheng)(zheng)(zheng)議(yi)多元處(chu)理格(ge)局的(de)形(xing)成提供了制(zhi)度保障。
農民工維權有了“直通車”
2018年年底(di),郭師傅等(deng)59名工(gong)(gong)(gong)(gong)人在濟(ji)南市一處建筑工(gong)(gong)(gong)(gong)地從事結(jie)構砌體和(he)零工(gong)(gong)(gong)(gong)作業。工(gong)(gong)(gong)(gong)程結(jie)束(shu)后,分包(bao)(bao)方(fang)勞(lao)務(wu)公司以發包(bao)(bao)方(fang)未撥(bo)付工(gong)(gong)(gong)(gong)程款為由拖(tuo)欠(qian)工(gong)(gong)(gong)(gong)人工(gong)(gong)(gong)(gong)資。郭師傅等(deng)人多次討(tao)薪無(wu)果后,于2019年1月9日來到(dao)(dao)濟(ji)南市農民工(gong)(gong)(gong)(gong)綜合服務(wu)中(zhong)心尋求幫助。濟(ji)南市仲(zhong)裁院勞(lao)動維權窗口值班(ban)人員了解(jie)情(qing)況后,立即啟動農民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資清欠(qian)綠色通道及相關預案,積(ji)極協調發包(bao)(bao)方(fang)及分包(bao)(bao)方(fang)勞(lao)務(wu)公司到(dao)(dao)現(xian)場處理,三方(fang)最終達成調解(jie)協議,于1月22日前全部(bu)結(jie)清了所欠(qian)的工(gong)(gong)(gong)(gong)人工(gong)(gong)(gong)(gong)資。
為保障農(nong)民(min)工(gong)(gong)(gong)的(de)勞動報酬權益(yi),濟南市(shi)(shi)仲(zhong)裁(cai)院依托濟南市(shi)(shi)農(nong)民(min)工(gong)(gong)(gong)綜合服(fu)務中心,聯(lian)合市(shi)(shi)清(qing)(qing)欠辦等部(bu)門,啟動多方調解機制,成立農(nong)民(min)工(gong)(gong)(gong)調解委員會。他(ta)們依托建(jian)設部(bu)門對建(jian)筑(zhu)市(shi)(shi)場、建(jian)筑(zhu)隊伍(wu)以及(ji)(ji)施工(gong)(gong)(gong)人(ren)員、施工(gong)(gong)(gong)隊伍(wu)資質(zhi)的(de)行(xing)政管理權,在(zai)查(cha)清(qing)(qing)承包關(guan)系(xi)(xi)、權利義務關(guan)系(xi)(xi)及(ji)(ji)工(gong)(gong)(gong)程款、農(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資等資金流向(xiang)的(de)基礎上,召集與案件有(you)關(guan)的(de)公(gong)司(si)(si)和個人(ren),查(cha)明(ming)事(shi)實證據,多方調解溝(gou)通,通過平等協商的(de)方式化解糾(jiu)紛,努力做到“小事(shi)不出工(gong)(gong)(gong)地,大事(shi)不出公(gong)司(si)(si)”。
據統計,2018年,農民(min)工調(diao)解委員會(hui)先(xian)后11次為203名農民(min)工追回欠(qian)薪510多萬元(yuan)。
法律援助有了“新平臺”
王(wang)(wang)女(nv)士(shi)在濟南市高新區一家(jia)化工企(qi)業(ye)從事財務管(guan)理工作。2018年(nian)產假結束(shu)后(hou),她回(hui)到企(qi)業(ye)上班,發現用人單位(wei)將自(zi)己的崗位(wei)調(diao)整(zheng)至車間。因車間化工原料刺激性(xing)氣味(wei)太大,尚(shang)在哺(bu)乳期的王(wang)(wang)女(nv)士(shi)經反映無果(guo)后(hou),只能提(ti)出離職。王(wang)(wang)女(nv)士(shi)家(jia)在農村,收入較低,加上父母年(nian)邁多病,家(jia)庭經濟困難。迷茫無措之下,王(wang)(wang)女(nv)士(shi)于今年(nian)2月來到濟南市仲裁院法律援助工作站求助,值(zhi)班律師劉(liu)成璐為王(wang)(wang)女(nv)士(shi)辦理了法律援助手續(xu),并幫其(qi)搜集相關證據,促使(shi)雙方于庭前達成和解。
為(wei)維(wei)護困難群體(ti)的合法權益,濟(ji)南市(shi)仲裁院與山東辰(chen)靜律(lv)(lv)師(shi)事(shi)務(wu)(wu)所合作成(cheng)立(li)法律(lv)(lv)援(yuan)(yuan)助(zhu)(zhu)(zhu)工作站(zhan),每天派駐律(lv)(lv)師(shi)在市(shi)仲裁院立(li)案大廳值(zhi)班,免費為(wei)群眾提(ti)供法律(lv)(lv)咨詢服務(wu)(wu)。為(wei)提(ti)高法律(lv)(lv)援(yuan)(yuan)助(zhu)(zhu)(zhu)效率,擴大法律(lv)(lv)援(yuan)(yuan)助(zhu)(zhu)(zhu)覆(fu)蓋面(mian),他們推出(chu)“援(yuan)(yuan)寶”手機(ji)APP,實(shi)現(xian)了法律(lv)(lv)援(yuan)(yuan)助(zhu)(zhu)(zhu)案件的網上申(shen)請咨詢、受(shou)理審(shen)批、指(zhi)派律(lv)(lv)師(shi)、信息存儲、數據分析,使群眾足不(bu)出(chu)戶(hu)就能享(xiang)受(shou)到專業的法律(lv)(lv)援(yuan)(yuan)助(zhu)(zhu)(zhu)服務(wu)(wu)。
截(jie)至(zhi)目前,濟南市已有6個區縣的(de)仲裁機構設立(li)了法律援(yuan)助(zhu)工(gong)(gong)作站。2018年,全(quan)市勞(lao)動人事爭(zheng)議法律援(yuan)助(zhu)工(gong)(gong)作站免費為(wei)890名企業職工(gong)(gong)、農民(min)工(gong)(gong)受理(li)勞(lao)動爭(zheng)議案(an)件(jian),挽回(hui)經(jing)濟損失338.2萬元。
