“十一”假期即將來臨。由于工作需要,不少職工仍需堅守在工作崗位上。用人單位安排勞動者假期上班,加班工資如何計算?國家對支付加班工資有哪些規定?
問:國家對支付加班工資有哪些規定?
主持(chi)人(ren):根據(ju)《勞動(dong)(dong)合同法》規(gui)定(ding)(ding),用人(ren)單位應當嚴格執行勞動(dong)(dong)定(ding)(ding)額標(biao)準,不得強迫(po)或變相強迫(po)勞動(dong)(dong)者(zhe)(zhe)加班(ban)(ban)。用人(ren)單位安(an)(an)排加班(ban)(ban)的(de)(de),應當按(an)照國家有關規(gui)定(ding)(ding)向勞動(dong)(dong)者(zhe)(zhe)支付加班(ban)(ban)費。用人(ren)單位應當按(an)照下列標(biao)準支付高(gao)于(yu)勞動(dong)(dong)者(zhe)(zhe)正常工(gong)作(zuo)時間工(gong)資(zi)(zi)的(de)(de)工(gong)資(zi)(zi)報(bao)(bao)酬(chou):一是(shi)(shi)安(an)(an)排勞動(dong)(dong)者(zhe)(zhe)延(yan)長工(gong)作(zuo)時間的(de)(de),支付不低于(yu)工(gong)資(zi)(zi)150%的(de)(de)工(gong)資(zi)(zi)報(bao)(bao)酬(chou);二是(shi)(shi)休息日(ri)安(an)(an)排勞動(dong)(dong)者(zhe)(zhe)工(gong)作(zuo)又不能安(an)(an)排補休的(de)(de),支付不低于(yu)工(gong)資(zi)(zi)200%的(de)(de)工(gong)資(zi)(zi)報(bao)(bao)酬(chou);三(san)是(shi)(shi)法定(ding)(ding)休假(jia)日(ri)安(an)(an)排勞動(dong)(dong)者(zhe)(zhe)工(gong)作(zuo)的(de)(de),支付不低于(yu)工(gong)資(zi)(zi)300%的(de)(de)工(gong)資(zi)(zi)報(bao)(bao)酬(chou)。
問:“十一”期間加班費應該如何計算?
主(zhu)持人(ren):根據國務院辦公(gong)廳《關于2018年(nian)部分節假(jia)日(ri)(ri)(ri)安(an)排的通知》,10月(yue)1日(ri)(ri)(ri)至(zhi)(zhi)(zhi)10月(yue)7日(ri)(ri)(ri)放(fang)假(jia)調休(xiu),共7天。其中,10月(yue)1日(ri)(ri)(ri)至(zhi)(zhi)(zhi)10月(yue)3日(ri)(ri)(ri)為法定休(xiu)假(jia)日(ri)(ri)(ri)。按照(zhao)前(qian)述規定,用人(ren)單(dan)位在這(zhe)三天安(an)排勞(lao)動(dong)者加班的,應按照(zhao)不低于勞(lao)動(dong)者本人(ren)上(shang)一個月(yue)平均日(ri)(ri)(ri)工(gong)(gong)資(zi)或小時(shi)工(gong)(gong)資(zi)的三倍另行支付(fu)加班工(gong)(gong)資(zi);10月(yue)4日(ri)(ri)(ri)至(zhi)(zhi)(zhi)7日(ri)(ri)(ri)為休(xiu)息日(ri)(ri)(ri)放(fang)假(jia),如(ru)果(guo)用人(ren)單(dan)位在這(zhe)四天休(xiu)息日(ri)(ri)(ri)安(an)排勞(lao)動(dong)者加班又不能安(an)排補休(xiu)的,應支付(fu)不低于兩倍工(gong)(gong)資(zi)的工(gong)(gong)資(zi)報酬。
在(zai)計(ji)算(suan)加班工資(zi)時(shi),日工資(zi)按(an)平(ping)均每月計(ji)薪(xin)天(tian)數21.75天(tian)折算(suan),小(xiao)時(shi)工資(zi)則(ze)在(zai)日工資(zi)的基礎上再(zai)除(chu)以8小(xiao)時(shi)。例(li)如,在(zai)10月2日法定休假日加班,這一(yi)天(tian)的加班工資(zi)計(ji)算(suan)公式為(wei)(月工資(zi)÷21.75×300%)。
問:用人單位可以強迫員工長時間加班嗎?
主持人(ren):根據相(xiang)關規定,用人(ren)單位未(wei)與(yu)工(gong)會和勞(lao)動(dong)者協商,強迫勞(lao)動(dong)者延長工(gong)作(zuo)時(shi)間的,應給予警(jing)告,責令改正,并可按每名勞(lao)動(dong)者每延長工(gong)作(zuo)時(shi)間一(yi)小(xiao)時(shi)罰款一(yi)百(bai)元以下的標準(zhun)處罰。此外,用人(ren)單位安排懷孕七(qi)個(ge)月(yue)以上的女職工(gong)延長工(gong)作(zuo)時(shi)間和從(cong)事夜班(ban)勞(lao)動(dong)等行為也是(shi)不(bu)允(yun)許的。
需要(yao)說明的是,職(zhi)工(gong)并非在任(ren)何情況(kuang)下都能拒絕加(jia)班。用人單位(wei)由于生(sheng)產(chan)經營需要(yao),經與工(gong)會和勞動(dong)(dong)者協商(shang)后可(ke)以延(yan)長(chang)(chang)工(gong)作(zuo)時間,一(yi)般每日不(bu)(bu)得超(chao)過1小時。此外,為(wei)保障公(gong)眾利益的需要(yao),勞動(dong)(dong)法規(gui)定(ding)單位(wei)在某些特(te)殊(shu)情況(kuang),如必須利用法定(ding)節假日或公(gong)休假日的停產(chan)期(qi)間檢修、保養設備等情況(kuang),延(yan)長(chang)(chang)工(gong)作(zuo)時間可(ke)不(bu)(bu)受相關限制。因(yin)特(te)殊(shu)原(yuan)因(yin)需要(yao)延(yan)長(chang)(chang)工(gong)作(zuo)時間的,在保障勞動(dong)(dong)者身體健康的條件下,延(yan)長(chang)(chang)工(gong)作(zuo)時間每天(tian)不(bu)(bu)得超(chao)過3小時。
