“十一”加班 先算算加班費

“十一”假期即將來臨。由于工作需要,不少職工仍需堅守在工作崗位上。用人單位安排勞動者假期上班,加班工資如何計算?國家對支付加班工資有哪些規定?

  問:國家對支付加班工資有哪些規定?

  主持人(ren)(ren):根(gen)據《勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)法》規定(ding)(ding),用(yong)人(ren)(ren)單位應當(dang)嚴格執(zhi)行(xing)勞(lao)(lao)(lao)動(dong)(dong)(dong)定(ding)(ding)額標準,不(bu)得強(qiang)迫或變相強(qiang)迫勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)加(jia)班(ban)。用(yong)人(ren)(ren)單位安(an)排(pai)加(jia)班(ban)的(de),應當(dang)按(an)(an)照國家有關規定(ding)(ding)向勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)支付加(jia)班(ban)費。用(yong)人(ren)(ren)單位應當(dang)按(an)(an)照下列(lie)標準支付高于(yu)(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)正(zheng)常工(gong)(gong)作(zuo)時(shi)間(jian)工(gong)(gong)資(zi)的(de)工(gong)(gong)資(zi)報酬(chou)(chou):一是(shi)安(an)排(pai)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)延(yan)長工(gong)(gong)作(zuo)時(shi)間(jian)的(de),支付不(bu)低于(yu)(yu)工(gong)(gong)資(zi)150%的(de)工(gong)(gong)資(zi)報酬(chou)(chou);二是(shi)休息日(ri)安(an)排(pai)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)工(gong)(gong)作(zuo)又(you)不(bu)能安(an)排(pai)補(bu)休的(de),支付不(bu)低于(yu)(yu)工(gong)(gong)資(zi)200%的(de)工(gong)(gong)資(zi)報酬(chou)(chou);三(san)是(shi)法定(ding)(ding)休假(jia)日(ri)安(an)排(pai)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)工(gong)(gong)作(zuo)的(de),支付不(bu)低于(yu)(yu)工(gong)(gong)資(zi)300%的(de)工(gong)(gong)資(zi)報酬(chou)(chou)。

  問:“十一”期間加班費應該如何計算?

  主持人(ren):根據國務院辦公廳《關于2018年(nian)部分節(jie)假(jia)(jia)(jia)日(ri)(ri)(ri)(ri)安(an)排(pai)的(de)(de)通知(zhi)》,10月(yue)(yue)(yue)1日(ri)(ri)(ri)(ri)至(zhi)10月(yue)(yue)(yue)7日(ri)(ri)(ri)(ri)放假(jia)(jia)(jia)調休(xiu)(xiu)(xiu),共(gong)7天。其(qi)中(zhong),10月(yue)(yue)(yue)1日(ri)(ri)(ri)(ri)至(zhi)10月(yue)(yue)(yue)3日(ri)(ri)(ri)(ri)為法定休(xiu)(xiu)(xiu)假(jia)(jia)(jia)日(ri)(ri)(ri)(ri)。按照前述規定,用人(ren)單(dan)位在(zai)這三(san)天安(an)排(pai)勞動(dong)者加(jia)班的(de)(de),應(ying)按照不低于勞動(dong)者本人(ren)上一(yi)個月(yue)(yue)(yue)平均日(ri)(ri)(ri)(ri)工(gong)(gong)資(zi)或(huo)小時工(gong)(gong)資(zi)的(de)(de)三(san)倍另(ling)行支付加(jia)班工(gong)(gong)資(zi);10月(yue)(yue)(yue)4日(ri)(ri)(ri)(ri)至(zhi)7日(ri)(ri)(ri)(ri)為休(xiu)(xiu)(xiu)息(xi)日(ri)(ri)(ri)(ri)放假(jia)(jia)(jia),如(ru)果用人(ren)單(dan)位在(zai)這四天休(xiu)(xiu)(xiu)息(xi)日(ri)(ri)(ri)(ri)安(an)排(pai)勞動(dong)者加(jia)班又不能安(an)排(pai)補休(xiu)(xiu)(xiu)的(de)(de),應(ying)支付不低于兩倍工(gong)(gong)資(zi)的(de)(de)工(gong)(gong)資(zi)報酬(chou)。

  在(zai)(zai)計(ji)算(suan)加(jia)班工資(zi)時(shi),日工資(zi)按平均(jun)每(mei)月計(ji)薪(xin)天(tian)(tian)數21.75天(tian)(tian)折算(suan),小時(shi)工資(zi)則在(zai)(zai)日工資(zi)的(de)基礎上再除以8小時(shi)。例如,在(zai)(zai)10月2日法(fa)定(ding)休(xiu)假日加(jia)班,這一(yi)天(tian)(tian)的(de)加(jia)班工資(zi)計(ji)算(suan)公式(shi)為(月工資(zi)÷21.75×300%)。

  問:用人單位可以強迫員工長時間加班嗎?

  主持人(ren):根據相(xiang)關規定,用人(ren)單(dan)位(wei)未與(yu)工(gong)會和(he)勞動(dong)者協商,強(qiang)迫勞動(dong)者延(yan)(yan)長工(gong)作(zuo)時間(jian)的,應給予警(jing)告,責令改正(zheng),并(bing)可按每名勞動(dong)者每延(yan)(yan)長工(gong)作(zuo)時間(jian)一(yi)小時罰款一(yi)百元(yuan)以下的標準處(chu)罰。此外,用人(ren)單(dan)位(wei)安排懷孕七個(ge)月以上的女職工(gong)延(yan)(yan)長工(gong)作(zuo)時間(jian)和(he)從事夜班勞動(dong)等行為也是不允(yun)許的。

  需要(yao)說明的(de)(de)是,職工(gong)(gong)(gong)并(bing)非(fei)在(zai)任何情況(kuang)(kuang)下都(dou)能拒絕加(jia)班。用人(ren)單位由(you)于生(sheng)產經(jing)(jing)營需要(yao),經(jing)(jing)與工(gong)(gong)(gong)會和勞(lao)動者(zhe)協商后可以延長(chang)(chang)工(gong)(gong)(gong)作(zuo)時(shi)間(jian),一般每(mei)日不(bu)得超過(guo)1小(xiao)(xiao)時(shi)。此外(wai),為保障公(gong)眾利(li)益的(de)(de)需要(yao),勞(lao)動法規定單位在(zai)某些特(te)殊情況(kuang)(kuang),如必須利(li)用法定節假(jia)(jia)日或公(gong)休假(jia)(jia)日的(de)(de)停產期間(jian)檢修、保養設備(bei)等情況(kuang)(kuang),延長(chang)(chang)工(gong)(gong)(gong)作(zuo)時(shi)間(jian)可不(bu)受相關限制。因特(te)殊原因需要(yao)延長(chang)(chang)工(gong)(gong)(gong)作(zuo)時(shi)間(jian)的(de)(de),在(zai)保障勞(lao)動者(zhe)身(shen)體健康的(de)(de)條件下,延長(chang)(chang)工(gong)(gong)(gong)作(zuo)時(shi)間(jian)每(mei)天不(bu)得超過(guo)3小(xiao)(xiao)時(shi)。
