中秋節(jie)是(shi)國家法定節(jie)假(jia)(jia)日(ri)(ri)(ri),有些員工因(yin)單位(wei)生產原因(yin)無法安排(pai)休(xiu)息(xi),如果中秋節(jie)不休(xiu),加(jia)(jia)班(ban)工資應該怎么算(suan)?人社局表示(shi),9月(yue)15日(ri)(ri)(ri)中秋節(jie)當天為(wei)法定節(jie)假(jia)(jia)日(ri)(ri)(ri),用人單位(wei)要求勞(lao)(lao)動者(zhe)(zhe)加(jia)(jia)班(ban)的(de),應向勞(lao)(lao)動者(zhe)(zhe)支(zhi)付3倍加(jia)(jia)班(ban)工資;9月(yue)16日(ri)(ri)(ri)、9月(yue)17日(ri)(ri)(ri)為(wei)休(xiu)息(xi)日(ri)(ri)(ri),用人單位(wei)要求勞(lao)(lao)動者(zhe)(zhe)加(jia)(jia)班(ban)的(de),應當支(zhi)付2倍加(jia)(jia)班(ban)工資,用人單位(wei)不得(de)以換休(xiu)和調休(xiu)的(de)名義(yi)拒付加(jia)(jia)班(ban)費(fei)。
記者(zhe)(zhe)了(le)解(jie)(jie)到(dao),根據國務(wu)院辦公廳《關(guan)于(yu)(yu)2016年(nian)(nian)部分節(jie)假(jia)(jia)日(ri)安(an)(an)排的(de)(de)通知》,2016年(nian)(nian)中(zhong)秋(qiu)節(jie)放假(jia)(jia)安(an)(an)排為:9月(yue)(yue)15日(ri)至(zhi)17日(ri)放假(jia)(jia)調(diao)休,共3天;其中(zhong),9月(yue)(yue)15日(ri)(星期(qi)四(si))為法(fa)定(ding)節(jie)假(jia)(jia),9月(yue)(yue)16日(ri)、9月(yue)(yue)17日(ri)(星期(qi)五、星期(qi)六)為休息日(ri)(公休日(ri));9月(yue)(yue)18日(ri)(星期(qi)日(ri))正(zheng)常上班(ban)(ban)(ban)。昨天,記者(zhe)(zhe)采訪市(shi)人(ren)(ren)(ren)社局相關(guan)部門工作人(ren)(ren)(ren)員了(le)解(jie)(jie)到(dao),依據《關(guan)于(yu)(yu)職工全年(nian)(nian)月(yue)(yue)平均工作時間(jian)和(he)工資(zi)折(zhe)算問題(ti)的(de)(de)通知》和(he)《山東省企業工資(zi)支付(fu)規定(ding)》,9月(yue)(yue)15日(ri)中(zhong)秋(qiu)節(jie)當天為法(fa)定(ding)節(jie)假(jia)(jia)日(ri),用人(ren)(ren)(ren)單位(wei)(wei)要求勞(lao)動(dong)者(zhe)(zhe)加班(ban)(ban)(ban)的(de)(de),應(ying)向(xiang)勞(lao)動(dong)者(zhe)(zhe)支付(fu)不(bu)低于(yu)(yu)日(ri)或小(xiao)時基(ji)(ji)數的(de)(de)300%支付(fu)加班(ban)(ban)(ban)工資(zi),用人(ren)(ren)(ren)單位(wei)(wei)不(bu)得以換休和(he)調(diao)休的(de)(de)名義(yi)拒付(fu)加班(ban)(ban)(ban)費;9月(yue)(yue)16日(ri)、9月(yue)(yue)17日(ri)為休息日(ri),用人(ren)(ren)(ren)單位(wei)(wei)要求勞(lao)動(dong)者(zhe)(zhe)加班(ban)(ban)(ban)的(de)(de),應(ying)當安(an)(an)排同等時間(jian)的(de)(de)補(bu)休,如不(bu)能安(an)(an)排補(bu)休的(de)(de),用人(ren)(ren)(ren)單位(wei)(wei)應(ying)向(xiang)勞(lao)動(dong)者(zhe)(zhe)支付(fu)不(bu)低于(yu)(yu)日(ri)或者(zhe)(zhe)小(xiao)時基(ji)(ji)數的(de)(de)200%支付(fu)加班(ban)(ban)(ban)工資(zi)。
中(zhong)秋節加(jia)班(ban)費計算實例:以勞(lao)動者(zhe)上一(yi)月份提(ti)供正常勞(lao)動所得實際(ji)工(gong)資(zi)扣除該(gai)月加(jia)班(ban)工(gong)資(zi)后的數額1700元(yuan)為(wei)例,如果(guo)9月15日加(jia)班(ban),用人單位支付加(jia)班(ban)工(gong)資(zi)不低于(1700÷21.75)×300%,即234元(yuan),9月16日或9月17日安排加(jia)班(ban),用人單位不能安排補休的,支付加(jia)班(ban)工(gong)資(zi)分別不低于(1700÷21.75)×200%,即156元(yuan)。這樣算來,如果(guo)中(zhong)秋節3天均加(jia)班(ban),總(zong)計可多領(ling)546元(yuan)。
記者(zhe)在(zai)(zai)采訪時了解到,實(shi)行計(ji)(ji)件(jian)(jian)工(gong)(gong)(gong)(gong)(gong)資(zi)制的(de)企(qi)業,應(ying)當(dang)依照(zhao)國家或(huo)者(zhe)行業制定(ding)(ding)的(de)勞(lao)動定(ding)(ding)額(e)標準,結合本企(qi)業實(shi)際,經征求企(qi)業工(gong)(gong)(gong)(gong)(gong)會或(huo)者(zhe)職工(gong)(gong)(gong)(gong)(gong)代表的(de)意見,合理確定(ding)(ding)勞(lao)動定(ding)(ding)額(e)和計(ji)(ji)件(jian)(jian)單價。勞(lao)動者(zhe)完成計(ji)(ji)件(jian)(jian)定(ding)(ding)額(e)后,企(qi)業安排其在(zai)(zai)法定(ding)(ding)標準工(gong)(gong)(gong)(gong)(gong)作時間以(yi)(yi)外工(gong)(gong)(gong)(gong)(gong)作的(de),應(ying)當(dang)按(an)(an)照(zhao)以(yi)(yi)上政策條款(kuan)的(de)規定(ding)(ding),分別(bie)按(an)(an)照(zhao)不低于計(ji)(ji)件(jian)(jian)單位的(de)200%、300%支(zhi)付加(jia)班工(gong)(gong)(gong)(gong)(gong)資(zi)。加(jia)班工(gong)(gong)(gong)(gong)(gong)資(zi)支(zhi)付應(ying)當(dang)在(zai)(zai)下一個工(gong)(gong)(gong)(gong)(gong)資(zi)發放(fang)日前發放(fang)給勞(lao)動者(zhe),如果企(qi)業拒不支(zhi)付的(de),企(qi)業職工(gong)(gong)(gong)(gong)(gong)可以(yi)(yi)向當(dang)地勞(lao)動監察(cha)部門(men)投訴。
加班工資計發基數
根據《山東省企業(ye)(ye)工資(zi)支付規定(ding)》:“企業(ye)(ye)應當按照(zhao)勞(lao)(lao)動者上一(yi)月(yue)(yue)份提供正(zheng)常(chang)勞(lao)(lao)動所得實(shi)際工資(zi)扣除(chu)該月(yue)(yue)加(jia)班工資(zi)后(hou)的(de)數額(e)確(que)定(ding)(但不得低于當地最低工資(zi)標準);勞(lao)(lao)動者上一(yi)月(yue)(yue)份沒有提供正(zheng)常(chang)勞(lao)(lao)動的(de),按照(zhao)向前順推(tui)至(zhi)其提供正(zheng)常(chang)勞(lao)(lao)動月(yue)(yue)份所得實(shi)際工資(zi)扣除(chu)該月(yue)(yue)加(jia)班工資(zi)后(hou)的(de)數額(e)確(que)定(ding)。”
加班工資適用范圍
根據《山(shan)東省企(qi)(qi)業(ye)工(gong)(gong)資(zi)支付(fu)規(gui)定(ding)》:“經批(pi)準(zhun)(zhun)實行(xing)(xing)綜合(he)計算工(gong)(gong)時工(gong)(gong)作(zuo)制度的(de)(de)企(qi)(qi)業(ye),在綜合(he)計算工(gong)(gong)時周期(qi)內實際(ji)工(gong)(gong)作(zuo)時間超(chao)過法定(ding)標準(zhun)(zhun)工(gong)(gong)作(zuo)時間的(de)(de)部分應(ying)當視為加班,用人單(dan)位按不(bu)(bu)低于勞(lao)動(dong)(dong)者本(ben)人小時工(gong)(gong)資(zi)標準(zhun)(zhun)的(de)(de)150%支付(fu)加班工(gong)(gong)資(zi)。如(ru)果用人單(dan)位是在法定(ding)節假日安排勞(lao)動(dong)(dong)者工(gong)(gong)作(zuo)的(de)(de),應(ying)按照不(bu)(bu)低于勞(lao)動(dong)(dong)者本(ben)人日或(huo)小時工(gong)(gong)資(zi)的(de)(de)300%另行(xing)(xing)支付(fu)加班工(gong)(gong)資(zi)。實行(xing)(xing)不(bu)(bu)定(ding)時工(gong)(gong)時制的(de)(de)企(qi)(qi)業(ye),不(bu)(bu)適(shi)用有關(guan)加班工(gong)(gong)資(zi)的(de)(de)規(gui)定(ding)。”
