青島檢查用工社保情況 帶薪年假高溫費成重點

為進一步貫徹落實(shi)《勞(lao)(lao)動(dong)法(fa)(fa)》、《勞(lao)(lao)動(dong)合(he)同法(fa)(fa)》、《社(she)會(hui)(hui)保(bao)險(xian)法(fa)(fa)》等勞(lao)(lao)動(dong)保(bao)障(zhang)法(fa)(fa)律(lv)法(fa)(fa)規,構建和(he)(he)諧勞(lao)(lao)動(dong)關(guan)系,維護勞(lao)(lao)動(dong)者的合(he)法(fa)(fa)權益和(he)(he)社(she)會(hui)(hui)穩定,根據國(guo)家、省(sheng)相關(guan)部門的部署,近期,青島市人(ren)(ren)力資源社(she)會(hui)(hui)保(bao)障(zhang)部門在全市組(zu)織開展用人(ren)(ren)單位遵守勞(lao)(lao)動(dong)用工和(he)(he)社(she)會(hui)(hui)保(bao)險(xian)法(fa)(fa)律(lv)法(fa)(fa)規情況(kuang)專(zhuan)項檢查(cha)。

主要檢查(cha)(cha)用(yong)人單位與勞(lao)動(dong)者簽訂(ding)勞(lao)動(dong)合同情(qing)(qing)(qing)況(kuang);按照(zhao)法律規(gui)定(ding)(ding)(ding)(ding)(ding)支付職(zhi)工(gong)(gong)工(gong)(gong)資、執行最低工(gong)(gong)資標準及加班(ban)工(gong)(gong)資規(gui)定(ding)(ding)(ding)(ding)(ding)情(qing)(qing)(qing)況(kuang);依法參加社會保(bao)險和(he)繳納社會保(bao)險費情(qing)(qing)(qing)況(kuang);遵守(shou)(shou)禁止(zhi)使用(yong)童工(gong)(gong)規(gui)定(ding)(ding)(ding)(ding)(ding)及女職(zhi)工(gong)(gong)和(he)未(wei)成(cheng)年工(gong)(gong)特殊勞(lao)動(dong)保(bao)護規(gui)定(ding)(ding)(ding)(ding)(ding)情(qing)(qing)(qing)況(kuang);遵守(shou)(shou)工(gong)(gong)時規(gui)定(ding)(ding)(ding)(ding)(ding)及帶薪年休(xiu)假規(gui)定(ding)(ding)(ding)(ding)(ding)情(qing)(qing)(qing)況(kuang);遵守(shou)(shou)高溫(wen)天氣勞(lao)動(dong)保(bao)護規(gui)定(ding)(ding)(ding)(ding)(ding)情(qing)(qing)(qing)況(kuang);企業使用(yong)勞(lao)務(wu)派遣用(yong)工(gong)(gong)情(qing)(qing)(qing)況(kuang);其他遵守(shou)(shou)勞(lao)動(dong)保(bao)障法律法規(gui)的(de)情(qing)(qing)(qing)況(kuang)等。本次檢查(cha)(cha)活動(dong),一是突出治理(li)農民(min)工(gong)(gong)工(gong)(gong)資拖(tuo)欠問題,將招用(yong)農民(min)工(gong)(gong)較多的(de)建(jian)筑市政、交通、水利(li)等工(gong)(gong)程(cheng)建(jian)設領(ling)域企業作為(wei)檢查(cha)(cha)重(zhong)點(dian);二是著(zhu)力做好產能過剩(sheng)企業工(gong)(gong)資支付保(bao)障,對鋼鐵(tie)、煤炭等產能過剩(sheng)企業實(shi)施重(zhong)點(dian)檢查(cha)(cha)。

另外,省(sheng)人(ren)社(she)廳依據(ju)《山(shan)東省(sheng)勞(lao)動(dong)和社(she)會(hui)保(bao)障(zhang)監察條(tiao)例》的(de)有(you)關規定,授權青島市(shi)在此次專(zhuan)項檢查期(qi)間可以對(dui)省(sheng)勞(lao)動(dong)保(bao)障(zhang)監察管轄的(de)用人(ren)單位實施檢查,這也是我市(shi)首(shou)次對(dui)省(sheng)管企業(ye)進行主(zhu)動(dong)檢查。

針對近期(qi)(qi)我市高(gao)溫(wen)濕熱天(tian)(tian)氣(qi),此(ci)次(ci)專項檢(jian)查中將把防暑降(jiang)(jiang)溫(wen)費(fei)(fei)發(fa)放作(zuo)為(wei)重點檢(jian)查內容。今年企(qi)(qi)業(ye)職工防暑降(jiang)(jiang)溫(wen)費(fei)(fei)發(fa)放標(biao)準為(wei):從事(shi)室外作(zuo)業(ye)和(he)高(gao)溫(wen)作(zuo)業(ye)人(ren)員(yuan)(yuan)每(mei)人(ren)每(mei)月(yue)200元(yuan)(yuan);非高(gao)溫(wen)作(zuo)業(ye)人(ren)員(yuan)(yuan)每(mei)人(ren)每(mei)月(yue)140元(yuan)(yuan)。全年按6月(yue)、7月(yue)、8月(yue)、9月(yue)共4個月(yue)計發(fa),列入企(qi)(qi)業(ye)成本費(fei)(fei)用。防暑降(jiang)(jiang)溫(wen)費(fei)(fei)屬于勞動報酬的組成部分,要求現(xian)金發(fa)放,該發(fa)不發(fa)屬違(wei)法(fa)行為(wei)。根據《山(shan)東省(sheng)高(gao)溫(wen)天(tian)(tian)氣(qi)勞動保護辦法(fa)》(省(sheng)政府令(ling)第239號)第二十二條規(gui)定:用人(ren)單位(wei)強迫勞動者在(zai)高(gao)溫(wen)天(tian)(tian)氣(qi)期(qi)(qi)間工作(zuo)的,或者未按規(gui)定標(biao)準發(fa)放防暑降(jiang)(jiang)溫(wen)費(fei)(fei)的,由縣級以(yi)(yi)上人(ren)力資源社會保障部門責(ze)令(ling)改正;逾期(qi)(qi)未改正的,處以(yi)(yi)2000元(yuan)(yuan)以(yi)(yi)上20000元(yuan)(yuan)以(yi)(yi)下罰(fa)款;構(gou)成犯罪的,依法(fa)追究刑事(shi)責(ze)任。

在(zai)檢查過程中(zhong),對于(yu)存在(zai)問題的用(yong)(yong)人單位(wei)(wei),將(jiang)依法嚴(yan)肅處理。對違法情節嚴(yan)重和(he)拒不執(zhi)行處理決定的用(yong)(yong)人單位(wei)(wei),在(zai)依法嚴(yan)肅處理的同時,將(jiang)通過新聞(wen)媒體進行曝(pu)光。
