為進一步(bu)貫徹落實《勞動(dong)(dong)法(fa)(fa)(fa)(fa)》、《勞動(dong)(dong)合(he)(he)同法(fa)(fa)(fa)(fa)》、《社(she)(she)會(hui)保(bao)險(xian)法(fa)(fa)(fa)(fa)》等(deng)勞動(dong)(dong)保(bao)障法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規,構建和(he)諧勞動(dong)(dong)關系,維護勞動(dong)(dong)者的合(he)(he)法(fa)(fa)(fa)(fa)權益和(he)社(she)(she)會(hui)穩定(ding),根據(ju)國家、省相關部門(men)的部署,近(jin)期,青島市(shi)人力資源社(she)(she)會(hui)保(bao)障部門(men)在全市(shi)組織開展用人單位遵(zun)守勞動(dong)(dong)用工和(he)社(she)(she)會(hui)保(bao)險(xian)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規情況專項檢查。
主要檢(jian)查(cha)用人(ren)單位與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者簽訂(ding)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同情(qing)(qing)況(kuang);按照法律規(gui)(gui)定(ding)支付(fu)職(zhi)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)(zi)、執行最低工(gong)(gong)(gong)資(zi)(zi)(zi)標準及(ji)(ji)加班工(gong)(gong)(gong)資(zi)(zi)(zi)規(gui)(gui)定(ding)情(qing)(qing)況(kuang);依(yi)法參(can)加社會(hui)保(bao)(bao)險和繳納社會(hui)保(bao)(bao)險費情(qing)(qing)況(kuang);遵守禁(jin)止使(shi)(shi)用童工(gong)(gong)(gong)規(gui)(gui)定(ding)及(ji)(ji)女(nv)職(zhi)工(gong)(gong)(gong)和未成年工(gong)(gong)(gong)特殊勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)保(bao)(bao)護(hu)規(gui)(gui)定(ding)情(qing)(qing)況(kuang);遵守工(gong)(gong)(gong)時規(gui)(gui)定(ding)及(ji)(ji)帶(dai)薪年休(xiu)假規(gui)(gui)定(ding)情(qing)(qing)況(kuang);遵守高溫天氣勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)保(bao)(bao)護(hu)規(gui)(gui)定(ding)情(qing)(qing)況(kuang);企業使(shi)(shi)用勞(lao)(lao)(lao)(lao)務派遣用工(gong)(gong)(gong)情(qing)(qing)況(kuang);其他遵守勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)保(bao)(bao)障法律法規(gui)(gui)的情(qing)(qing)況(kuang)等(deng)。本次檢(jian)查(cha)活動(dong)(dong)(dong),一(yi)是(shi)突出治理農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)(zi)拖欠問題,將招(zhao)用農民工(gong)(gong)(gong)較多(duo)的建(jian)筑(zhu)市政、交通、水利等(deng)工(gong)(gong)(gong)程建(jian)設領域企業作(zuo)為(wei)檢(jian)查(cha)重點;二是(shi)著力做好產能過(guo)剩企業工(gong)(gong)(gong)資(zi)(zi)(zi)支付(fu)保(bao)(bao)障,對鋼(gang)鐵、煤炭等(deng)產能過(guo)剩企業實施(shi)重點檢(jian)查(cha)。
另外,省(sheng)人(ren)(ren)社廳依據《山東(dong)省(sheng)勞動(dong)和(he)社會(hui)保障監(jian)察(cha)條例》的有(you)關規定(ding),授權青島(dao)市在此(ci)次(ci)專(zhuan)項檢(jian)查(cha)期間(jian)可以對省(sheng)勞動(dong)保障監(jian)察(cha)管轄的用(yong)人(ren)(ren)單位實施檢(jian)查(cha),這(zhe)也(ye)是(shi)我(wo)市首次(ci)對省(sheng)管企業進(jin)行主(zhu)動(dong)檢(jian)查(cha)。
針對近(jin)期(qi)我市(shi)高(gao)溫(wen)(wen)濕熱(re)天氣(qi),此次專項檢查中將把防(fang)暑(shu)降溫(wen)(wen)費發(fa)(fa)(fa)放(fang)作(zuo)為重(zhong)點檢查內容。今(jin)年企(qi)業職工(gong)防(fang)暑(shu)降溫(wen)(wen)費發(fa)(fa)(fa)放(fang)標(biao)準(zhun)為:從事室外作(zuo)業和高(gao)溫(wen)(wen)作(zuo)業人(ren)員每人(ren)每月(yue)(yue)(yue)(yue)200元;非高(gao)溫(wen)(wen)作(zuo)業人(ren)員每人(ren)每月(yue)(yue)(yue)(yue)140元。全年按6月(yue)(yue)(yue)(yue)、7月(yue)(yue)(yue)(yue)、8月(yue)(yue)(yue)(yue)、9月(yue)(yue)(yue)(yue)共4個月(yue)(yue)(yue)(yue)計發(fa)(fa)(fa),列入企(qi)業成本(ben)費用。防(fang)暑(shu)降溫(wen)(wen)費屬于勞動(dong)報酬(chou)的(de)組成部分,要(yao)求現金發(fa)(fa)(fa)放(fang),該發(fa)(fa)(fa)不發(fa)(fa)(fa)屬違法行為。根據《山東省(sheng)(sheng)高(gao)溫(wen)(wen)天氣(qi)勞動(dong)保(bao)護辦法》(省(sheng)(sheng)政府(fu)令第(di)239號)第(di)二(er)十二(er)條規定:用人(ren)單(dan)位強迫勞動(dong)者(zhe)在(zai)高(gao)溫(wen)(wen)天氣(qi)期(qi)間工(gong)作(zuo)的(de),或(huo)者(zhe)未(wei)按規定標(biao)準(zhun)發(fa)(fa)(fa)放(fang)防(fang)暑(shu)降溫(wen)(wen)費的(de),由縣級(ji)以(yi)上人(ren)力資源(yuan)社會保(bao)障部門(men)責令改正;逾期(qi)未(wei)改正的(de),處以(yi)2000元以(yi)上20000元以(yi)下罰款;構成犯罪的(de),依法追究刑(xing)事責任。
在檢查過(guo)(guo)程(cheng)中,對于存在問題的用人單位,將依法嚴肅處理。對違法情節嚴重和拒(ju)不執行處理決定的用人單位,在依法嚴肅處理的同(tong)時,將通過(guo)(guo)新聞媒體(ti)進行曝光。
