日(ri)前,山東(dong)省濟南(nan)市(shi)社保(bao)局將(jiang)個(ge)體靈活就業人員繳(jiao)納城鎮企(qi)業職(zhi)工(gong)(gong)養老(lao)保(bao)險的(de)(de)基數進行(xing)了規(gui)范,自2015年(nian)1月1日(ri)起,無雇傭工(gong)(gong)的(de)(de)城鎮個(ge)體工(gong)(gong)商戶和(he)靈活就業人員參(can)加(jia)濟南(nan)市(shi)城鎮企(qi)業職(zhi)工(gong)(gong)養老(lao)保(bao)險的(de)(de),統(tong)一(yi)按(an)照濟南(nan)市(shi)在(zai)崗(gang)職(zhi)工(gong)(gong)的(de)(de)平均工(gong)(gong)資作為繳(jiao)費基數。
企業不得讓員工以靈活就業者身份繳納養老保險
記者(zhe)了解到(dao),原(yuan)政策(ce)規(gui)定(ding),靈(ling)活(huo)(huo)(huo)就業人(ren)員的(de)繳(jiao)費基數上限(xian)(xian)為(wei)(wei)在崗職工(gong)(gong)月平均工(gong)(gong)資的(de)300%、下限(xian)(xian)為(wei)(wei)60%,而新(xin)規(gui)定(ding)將上限(xian)(xian)降低(di)至100%、下限(xian)(xian)為(wei)(wei)60%不變(bian),參保(bao)人(ren)可(ke)(ke)在此區間內(nei)靈(ling)活(huo)(huo)(huo)選擇。相關(guan)工(gong)(gong)作人(ren)員告訴記者(zhe),這樣(yang)做不僅可(ke)(ke)以保(bao)障低(di)收入靈(ling)活(huo)(huo)(huo)職業者(zhe)的(de)權益,同(tong)樣(yang)可(ke)(ke)以規(gui)范(fan)部(bu)分有雇傭工(gong)(gong)的(de)個體(ti)工(gong)(gong)商戶和企業。
濟(ji)南市社保(bao)(bao)局的(de)工(gong)(gong)作人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)同(tong)時提(ti)醒,根(gen)據法律規定,無(wu)雇(gu)工(gong)(gong)的(de)個體工(gong)(gong)商戶、未在用(yong)人(ren)(ren)(ren)(ren)單位參(can)加基(ji)本(ben)養老(lao)(lao)(lao)保(bao)(bao)險(xian)的(de)非(fei)全日制從業人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)以及其(qi)他靈活就(jiu)(jiu)業人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)可以參(can)加基(ji)本(ben)養老(lao)(lao)(lao)保(bao)(bao)險(xian),由個人(ren)(ren)(ren)(ren)繳(jiao)(jiao)納(na)基(ji)本(ben)養老(lao)(lao)(lao)保(bao)(bao)險(xian)費(fei)。有雇(gu)傭工(gong)(gong)的(de)個體工(gong)(gong)商戶應以單位為申(shen)報主體為雇(gu)傭員(yuan)(yuan)(yuan)工(gong)(gong)繳(jiao)(jiao)納(na)基(ji)本(ben)養老(lao)(lao)(lao)、基(ji)本(ben)醫療、工(gong)(gong)傷(shang)、失(shi)業、生育五(wu)險(xian)。相(xiang)比之下,靈活就(jiu)(jiu)業者自行繳(jiao)(jiao)納(na)只能夠繳(jiao)(jiao)納(na)基(ji)本(ben)醫療保(bao)(bao)險(xian)和基(ji)本(ben)養老(lao)(lao)(lao)保(bao)(bao)險(xian)。如果企業出錢讓職工(gong)(gong)按個體靈活就(jiu)(jiu)業人(ren)(ren)(ren)(ren)員(yuan)(yuan)(yuan)參(can)保(bao)(bao),這樣(yang)做既違反(fan)《勞動法》和《社會保(bao)(bao)險(xian)法》的(de)規定,又不利于保(bao)(bao)護職工(gong)(gong)的(de)合法權(quan)益,在職工(gong)(gong)發生工(gong)(gong)傷(shang)、失(shi)業、生育等(deng)情況時,無(wu)法享受相(xiang)應社保(bao)(bao)待(dai)遇。
繳費金額最高774.6元,基本醫保不變
記者經(jing)過(guo)計算,自(zi)明年(nian)1月(yue)1日起,個體靈活就業人員基本養老保(bao)(bao)險每(mei)月(yue)低(di)繳(jiao)納(na)(na)金額(e)為(wei)464.8元,最高(gao)繳(jiao)納(na)(na)774.6元。基本醫(yi)療保(bao)(bao)險繳(jiao)納(na)(na)金額(e)不變,按照5.5%的(de)比(bi)例(li)參(can)(can)加基本醫(yi)療保(bao)(bao)險的(de)每(mei)月(yue)繳(jiao)納(na)(na)額(e)為(wei)231.02元,按照10%的(de)比(bi)例(li)參(can)(can)加基本醫(yi)療保(bao)(bao)險的(de)每(mei)月(yue)繳(jiao)納(na)(na)額(e)為(wei)387.3元。
超(chao)額繳費者須重新簽訂(ding)扣(kou)款協議(yi),斷繳將影響(xiang)醫(yi)保報銷。
濟南(nan)市(shi)社(she)(she)保局的工作人(ren)員提醒(xing),目前繳(jiao)(jiao)(jiao)費(fei)(fei)基數高于我市(shi)社(she)(she)會(hui)保險繳(jiao)(jiao)(jiao)費(fei)(fei)年度內執行的在崗職工月平均工資(zi)繳(jiao)(jiao)(jiao)費(fei)(fei)的個體(ti)靈活就業人(ren)員,應盡(jin)快聯系(xi)所在代征機構,在1月份申(shen)報繳(jiao)(jiao)(jiao)費(fei)(fei)前重新(xin)簽訂(ding)社(she)(she)會(hui)保險扣款協議。以(yi)免因(yin)繳(jiao)(jiao)(jiao)費(fei)(fei)基數超限,耽誤(wu)個體(ti)繳(jiao)(jiao)(jiao)費(fei)(fei)的申(shen)報和扣款,從而形成繳(jiao)(jiao)(jiao)費(fei)(fei)間斷。
同時,根據(ju)《濟南(nan)市職工基(ji)本醫(yi)療(liao)保險(xian)辦法》第二十(shi)二條規定:靈活就業人員自(zi)欠繳職工基(ji)本醫(yi)療(liao)保險(xian)費(fei)次月(yue)(yue)起(qi)(qi),統籌基(ji)金(jin)暫停(ting)支付其醫(yi)療(liao)費(fei)用(yong)。連(lian)續(xu)欠費(fei)不足6個月(yue)(yue)的,自(zi)補足欠費(fei)和滯納(na)金(jin)的次月(yue)(yue)起(qi)(qi)恢(hui)復享受待遇;連(lian)續(xu)欠費(fei)6個月(yue)(yue)以(yi)上的,自(zi)重(zhong)新繳費(fei)的第7個月(yue)(yue)起(qi)(qi)享受待遇。
