答 用人單位沒有在用工(gong)的同(tong)(tong)(tong)時(shi)與勞(lao)動(dong)者(zhe)訂(ding)立書面(mian)勞(lao)動(dong)合(he)同(tong)(tong)(tong),與勞(lao)動(dong)者(zhe)約定(ding)的勞(lao)動(dong)報酬(chou)是(shi)不明確的,新招用的勞(lao)動(dong)者(zhe)的勞(lao)動(dong)報酬(chou)按照(zhao)集體(ti)合(he)同(tong)(tong)(tong)規(gui)(gui)定(ding)的標準(zhun)執行(xing);沒有集體(ti)合(he)同(tong)(tong)(tong)或者(zhe)集體(ti)合(he)同(tong)(tong)(tong)未規(gui)(gui)定(ding)的,按照(zhao)同(tong)(tong)(tong)工(gong)同(tong)(tong)(tong)酬(chou)的原則對(dui)勞(lao)動(dong)者(zhe)發放勞(lao)動(dong)報酬(chou)。
