年假沒休夠,單位是否該支付相應的工資?

去年的年假我只(zhi)休(xiu)了兩天,要(yao)求單位支付(fu)未休(xiu)年休(xiu)假的工(gong)資報酬,可(ke)是卻被拒絕了,單位這么做合理嗎?

《企業(ye)職(zhi)工(gong)帶薪年休(xiu)(xiu)假實施辦(ban)法》第十條規定:“用(yong)人(ren)單位經職(zhi)工(gong)同意不(bu)安排(pai)年休(xiu)(xiu)假或者安排(pai)職(zhi)工(gong)年休(xiu)(xiu)假天(tian)數(shu)少于(yu)應休(xiu)(xiu)年休(xiu)(xiu)假天(tian)數(shu),應當在本年度內(nei)對職(zhi)工(gong)應休(xiu)(xiu)未休(xiu)(xiu)年休(xiu)(xiu)假天(tian)數(shu),按照其(qi)日(ri)工(gong)資收(shou)入的300%支付(fu)未休(xiu)(xiu)年休(xiu)(xiu)假工(gong)資報酬,其(qi)中包含用(yong)人(ren)單位支付(fu)職(zhi)工(gong)正(zheng)常工(gong)作期間的工(gong)資收(shou)入。所以,你所在單位的做(zuo)法是不(bu)合(he)理(li)的。
