勞動法規定的,辭職需要提前多少天?

我(wo)想辭職了,但是(shi)勞動法中規定的簽訂(ding)合(he)同的員工需要提前多少(shao)天提出申(shen)請呢?

勞(lao)(lao)(lao)動(dong)者提出解(jie)除勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong)(辭職)分三種情況: 一是(shi),依據(ju)(ju)第(di)三十(shi)(shi)七條(tiao)(tiao)的(de)(de)規(gui)定提出解(jie)除勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong),也就(jiu)是(shi)提前30天(tian)通知(zhi)用(yong)人(ren)單(dan)位,用(yong)人(ren)單(dan)位不(bu)承(cheng)(cheng)擔經(jing)濟補(bu)償(chang); 二(er)是(shi),依據(ju)(ju)第(di)三十(shi)(shi)八條(tiao)(tiao)的(de)(de)規(gui)定提出解(jie)除勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong),即用(yong)人(ren)單(dan)位有錯在先,用(yong)人(ren)單(dan)位應當按(an)照但第(di)十(shi)(shi)六條(tiao)(tiao)第(di)四十(shi)(shi)七條(tiao)(tiao)的(de)(de)規(gui)定,支付每工(gong)(gong)作一年一個月工(gong)(gong)資的(de)(de)經(jing)濟補(bu)償(chang)金;不(bu)受(shou)時間限(xian)制勞(lao)(lao)(lao)動(dong)者可(ke)(ke)以立(li)馬走人(ren)。 三是(shi),勞(lao)(lao)(lao)動(dong)者沒有任(ren)何依據(ju)(ju)違法解(jie)除勞(lao)(lao)(lao)動(dong)合(he)(he)同(tong),即不(bu)到(dao)招呼就(jiu)走人(ren)。用(yong)人(ren)單(dan)位不(bu)但不(bu)給(gei)經(jing)濟補(bu)償(chang)金,還可(ke)(ke)依據(ju)(ju)第(di)九十(shi)(shi)條(tiao)(tiao)的(de)(de)規(gui)定,給(gei)單(dan)位造(zao)成損失的(de)(de)要承(cheng)(cheng)擔賠償(chang)責(ze)任(ren)。
