試用期結束后沒有簽訂正式合同算不算正式員工?
問 我在(zai)公司已經(jing)完成了三個(ge)月的試用期,也簽訂了合同(tong),三個(ge)月過(guo)后應(ying)該按照正(zheng)式員工(gong)的標(biao)準發薪(xin)水(shui)了,公司卻(que)以(yi)未辦(ban)理轉正(zheng)手(shou)續不算正(zheng)式員工(gong)的借口拒絕(jue)支付我全額(e)工(gong)資,我該怎么(me)辦(ban)呢?
答 根據《中(zhong)華人民共和(he)國勞(lao)(lao)動(dong)法(fa)(fa)(fa)》的(de)(de)(de)規定(ding),建立勞(lao)(lao)動(dong)關系應當(dang)訂立勞(lao)(lao)動(dong)合同(tong)(tong),勞(lao)(lao)動(dong)合同(tong)(tong)應當(dang)以(yi)書面形式訂立。合同(tong)(tong)中(zhong)可以(yi)約定(ding)試(shi)(shi)用(yong)(yong)期(qi),但試(shi)(shi)用(yong)(yong)期(qi)最長不(bu)(bu)得超過六個月。也(ye)就是說,自勞(lao)(lao)動(dong)者實際工(gong)作之日(ri)起,用(yong)(yong)人單位就應當(dang)與(yu)其簽訂勞(lao)(lao)動(dong)合同(tong)(tong),試(shi)(shi)用(yong)(yong)期(qi)只是勞(lao)(lao)動(dong)合同(tong)(tong)中(zhong)一個特(te)殊的(de)(de)(de)階(jie)段(duan),即雙(shuang)方在試(shi)(shi)用(yong)(yong)期(qi)內提(ti)出解除勞(lao)(lao)動(dong)合同(tong)(tong)可以(yi)不(bu)(bu)受(shou)部分勞(lao)(lao)動(dong)法(fa)(fa)(fa)條(tiao)款的(de)(de)(de)約束(shu),而試(shi)(shi)用(yong)(yong)期(qi)到期(qi)后,這些條(tiao)款的(de)(de)(de)約束(shu)力就將自動(dong)回復,而并非(fei)需要履行諸如“轉正”的(de)(de)(de)手續以(yi)確認員工(gong)的(de)(de)(de)身(shen)份(fen),所以(yi)你(ni)所在公司的(de)(de)(de)借口是不(bu)(bu)成立的(de)(de)(de),你(ni)可以(yi)依照相關法(fa)(fa)(fa)律維護自己(ji)的(de)(de)(de)合法(fa)(fa)(fa)權益。
