試用期結束后沒有簽訂正式合同算不算正式員工?

我在公(gong)司(si)已(yi)經完(wan)成了三個(ge)月的試用期,也簽訂了合同(tong),三個(ge)月過后應該(gai)按照正(zheng)式(shi)員工的標準發薪水了,公(gong)司(si)卻以未辦理轉正(zheng)手續不算正(zheng)式(shi)員工的借口拒絕支付(fu)我全額工資,我該(gai)怎么辦呢?

根據《中(zhong)華人民共和國勞(lao)(lao)動(dong)(dong)(dong)法》的(de)規定,建立(li)(li)勞(lao)(lao)動(dong)(dong)(dong)關(guan)系應當(dang)訂(ding)立(li)(li)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong),勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)應當(dang)以書面形式訂(ding)立(li)(li)。合(he)(he)同(tong)(tong)(tong)中(zhong)可(ke)以約定試用(yong)(yong)期(qi),但(dan)試用(yong)(yong)期(qi)最長不(bu)得超過六(liu)個(ge)月。也就(jiu)(jiu)是(shi)說(shuo),自(zi)勞(lao)(lao)動(dong)(dong)(dong)者實際工(gong)作之(zhi)日起,用(yong)(yong)人單(dan)位(wei)就(jiu)(jiu)應當(dang)與其簽訂(ding)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong),試用(yong)(yong)期(qi)只是(shi)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)中(zhong)一個(ge)特殊的(de)階(jie)段,即雙方在試用(yong)(yong)期(qi)內提出(chu)解除勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)可(ke)以不(bu)受部分勞(lao)(lao)動(dong)(dong)(dong)法條(tiao)款(kuan)的(de)約束,而(er)(er)試用(yong)(yong)期(qi)到(dao)期(qi)后,這些(xie)條(tiao)款(kuan)的(de)約束力(li)就(jiu)(jiu)將自(zi)動(dong)(dong)(dong)回(hui)復,而(er)(er)并非需要(yao)履行(xing)諸如“轉(zhuan)正(zheng)”的(de)手續以確認員(yuan)工(gong)的(de)身份,所以你所在公司的(de)借口是(shi)不(bu)成立(li)(li)的(de),你可(ke)以依照相關(guan)法律維護自(zi)己的(de)合(he)(he)法權益。
