實行計件工資還需要支付加班費嗎?

我所工(gong)作(zuo)的公(gong)司實行的工(gong)資(zi)(zi)制度是計件工(gong)資(zi)(zi),但(dan)是工(gong)作(zuo)時間(jian)以外的加班卻(que)不給加班費,公(gong)司這么做合法嗎?

《工(gong)資支(zhi)付(fu)暫行規(gui)定(ding)(ding)》規(gui)定(ding)(ding),單(dan)位(wei)在勞動(dong)者完(wan)成勞動(dong)定(ding)(ding)額(e)或(huo)規(gui)定(ding)(ding)的工(gong)作(zuo)(zuo)任務(wu)后,安(an)排勞動(dong)者在法定(ding)(ding)標準(zhun)工(gong)作(zuo)(zuo)時(shi)間(jian)以外工(gong)作(zuo)(zuo)的,應按150%、200%及最高300%的標準(zhun)支(zhi)付(fu)工(gong)資。實行計件工(gong)資的勞動(dong)者,在完(wan)成計件定(ding)(ding)額(e)任務(wu)后,由用人單(dan)位(wei)安(an)排延長(chang)工(gong)作(zuo)(zuo)時(shi)間(jian)的,也應根據上(shang)述規(gui)定(ding)(ding)的原(yuan)則,分別按照不低于其本人法定(ding)(ding)工(gong)作(zuo)(zuo)時(shi)間(jian)計件單(dan)價的上(shang)述倍(bei)數(shu)支(zhi)付(fu)其工(gong)資。
