實行計件工資還需要支付加班費嗎?
問 我所工(gong)作(zuo)(zuo)的(de)公(gong)司(si)實(shi)行的(de)工(gong)資(zi)(zi)制度是(shi)計件(jian)工(gong)資(zi)(zi),但是(shi)工(gong)作(zuo)(zuo)時間以(yi)外的(de)加班(ban)卻不給加班(ban)費(fei),公(gong)司(si)這么(me)做合法嗎(ma)?
答 《工(gong)(gong)資(zi)支付(fu)暫(zan)行(xing)規(gui)(gui)定(ding)(ding)(ding)》規(gui)(gui)定(ding)(ding)(ding),單(dan)位(wei)在勞(lao)動者完(wan)成(cheng)(cheng)勞(lao)動定(ding)(ding)(ding)額或(huo)規(gui)(gui)定(ding)(ding)(ding)的(de)工(gong)(gong)作(zuo)任(ren)務后(hou)(hou),安排勞(lao)動者在法(fa)定(ding)(ding)(ding)標準工(gong)(gong)作(zuo)時(shi)(shi)間以外工(gong)(gong)作(zuo)的(de),應按(an)150%、200%及最高(gao)300%的(de)標準支付(fu)工(gong)(gong)資(zi)。實行(xing)計件工(gong)(gong)資(zi)的(de)勞(lao)動者,在完(wan)成(cheng)(cheng)計件定(ding)(ding)(ding)額任(ren)務后(hou)(hou),由用人單(dan)位(wei)安排延長(chang)工(gong)(gong)作(zuo)時(shi)(shi)間的(de),也(ye)應根據(ju)上(shang)述(shu)規(gui)(gui)定(ding)(ding)(ding)的(de)原則,分(fen)別(bie)按(an)照不低(di)于其(qi)本(ben)人法(fa)定(ding)(ding)(ding)工(gong)(gong)作(zuo)時(shi)(shi)間計件單(dan)價的(de)上(shang)述(shu)倍數支付(fu)其(qi)工(gong)(gong)資(zi)。
