實行計件工資還需要支付加班費嗎?
問 我(wo)所(suo)工作(zuo)的公司實行(xing)的工資(zi)制度是計件工資(zi),但是工作(zuo)時(shi)間以外(wai)的加(jia)(jia)班卻不給加(jia)(jia)班費,公司這么做合法(fa)嗎?
答 《工(gong)(gong)資支付(fu)暫行規(gui)(gui)定(ding)》規(gui)(gui)定(ding),單(dan)位(wei)在(zai)勞(lao)(lao)動者完(wan)成(cheng)(cheng)勞(lao)(lao)動定(ding)額(e)或規(gui)(gui)定(ding)的(de)工(gong)(gong)作任務后(hou),安排勞(lao)(lao)動者在(zai)法(fa)定(ding)標準工(gong)(gong)作時間(jian)以外工(gong)(gong)作的(de),應按150%、200%及最高300%的(de)標準支付(fu)工(gong)(gong)資。實行計件工(gong)(gong)資的(de)勞(lao)(lao)動者,在(zai)完(wan)成(cheng)(cheng)計件定(ding)額(e)任務后(hou),由用人單(dan)位(wei)安排延長工(gong)(gong)作時間(jian)的(de),也應根據上述(shu)規(gui)(gui)定(ding)的(de)原則,分別按照不低于其本人法(fa)定(ding)工(gong)(gong)作時間(jian)計件單(dan)價的(de)上述(shu)倍數支付(fu)其工(gong)(gong)資。
