辭職后能否要求支付未休年假的工資?

答 《企(qi)業職工(gong)帶薪年(nian)(nian)(nian)休(xiu)(xiu)(xiu)假(jia)實施辦法》第十二條規定(ding):用人(ren)單(dan)位與職工(gong)解除或者終止勞動合同時,當年(nian)(nian)(nian)度未安排職工(gong)休(xiu)(xiu)(xiu)滿應(ying)休(xiu)(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)(xiu)假(jia)的(de),應(ying)當按(an)照(zhao)職工(gong)當年(nian)(nian)(nian)已(yi)工(gong)作時間折算應(ying)休(xiu)(xiu)(xiu)未休(xiu)(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)(xiu)假(jia)天數并(bing)支付未休(xiu)(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)(xiu)假(jia)工(gong)資(zi)報(bao)酬(chou),但折算后不足1整天的(de)部分不支付未休(xiu)(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)(xiu)假(jia)工(gong)資(zi)報(bao)酬(chou)。你(ni)可(ke)以根據相關規定(ding)向公司爭取(qu)你(ni)的(de)應(ying)有的(de)報(bao)酬(chou)。
