試用期期間員工可以解除勞動合同嗎?
問 我(wo)在濟南這家公(gong)司工作(zuo)兩個(ge)月(yue)了,還(huan)有一個(ge)月(yue)就轉正(zheng)了,但是我(wo)想要(yao)辭職解除勞(lao)動合(he)同,不知道行(xing)不行(xing)呢?
答 試(shi)用(yong)(yong)期(qi)內,勞(lao)(lao)動(dong)者可隨(sui)時通知用(yong)(yong)人(ren)(ren)單位(wei)解除勞(lao)(lao)動(dong)合(he)同(tong),并且不需支付培(pei)訓費用(yong)(yong),但如果勞(lao)(lao)動(dong)者是(shi)用(yong)(yong)人(ren)(ren)單位(wei)出(chu)資(zi)招用(yong)(yong)的(de)(de),那(nei)么勞(lao)(lao)動(dong)者解除勞(lao)(lao)動(dong)合(he)同(tong)時應賠償用(yong)(yong)人(ren)(ren)單位(wei)出(chu)資(zi)的(de)(de)招、接(jie)收費用(yong)(yong)。用(yong)(yong)人(ren)(ren)單位(wei)在試(shi)用(yong)(yong)期(qi)內解除勞(lao)(lao)動(dong)合(he)同(tong),則必須要證明勞(lao)(lao)動(dong)者不符合(he)用(yong)(yong)人(ren)(ren)單位(wei)的(de)(de)錄用(yong)(yong)條件。
